Said here tofore mentioned grantee, its s uccessors or assigns , shall have
the right, without prior notice or proceeding at law, at such times as may be
necessary to enter upon said above described property fc,r the purpose of con-
structing, maintaining, repairing, altering or reconstructing said utility, or
making any connections therewith , and such construction, maintaining, repai ring,
altering or reconstruction of such utility shall be accomplished in such a manner
that the private improvements existing in the right right(s)-of-way shall not be
� disturbed or damaged, or in the event they are disturbed or damaged, they will
� be replaced in as good a condition as they were immediately before the �property
O was entered upon by the Grantee.

a�p The Grantor shall fully use and enjoy the aforedescribed premises,
N including the right to retain the right to use the surface of said right-of-way
� if such use does not interfere with installation and main.tenance of the utility
line. However, the grantor shall not erect buildings or structures over, under
or across the right-of-way during the existence of such utility.
This easement, shall be a covenant running with the land and shall be bind-
ing on the Grantor, his successors , heirs and assigns. Grantors covenant that
they are the lawful owners of the above properties and that they have a good and
lawful right to execute this agreement.

� BEGINNING on the East margin State Highway #5 129.5 feet South of South
line Cedar River Pipe Line, being 2721 .62 feet East and 16.8 feet North of
West one-quarter corner of Section; thence East parallel to pipe line right-of-
- way 333 feet, more or less, to West margin Renton Shorelands 2nd Supplemental
p1at; thence Southwesterly along said Boundary to point 197.35 feet South of
South line said pipe line, measured at right angles; thence West 303 feet, more
or less to East margin of Highway; thence North 68 feet, more or less, to i
beginning. �
Said Utility Easement being described as follows:`
BEGINNING at the intersection of the centerline of South 3rd Street with
the centerline •of Rainier Avenue South in the Southeast one-quarter of Section 18,
Township 23 North�, Range 5 East, W.M. ; thence` Northwesterly along the centerline
of Rainier Avenue South, said centerline being the arc of a curve to the right,
radius 811 .42 feet, a distance of 293.19 feet to the point of tangency of said
curve; thence North 3° 57' 00" East a distance of 49.93 feet; thence South
86° 03' 00" East a distance of 40 feet to a point on the Easterly margin of
Rainier Avenue South, the true point of beginning; thence Northerly, along said
Easte rly margin, a distance of 2.50 feet; thence Easterly, perpendicularly to said i
