� of King County, Washington, hereinafter called "Grantee."

� That said Grantor(s) , for and in consideration of the sum of $
aid by Grantee, and other valuable consideration,
do by t ese presents , grant, bargain, sell , convey, and warrant unto the said
Grantee, its successors and assigns , an easement for right-of-way, landscaping,
- -' utilities, and other related purposes with necessary appurtenances over, through,
across and upon the following described property in King County, Washington, more
particularly described as follows :
A strip of land 13 feet in width over a portion of the easterly 13 feet of the
following described property:
An easement for landscaping purposes over the easterly 13 feet, measured
perpendicularly to the westerly margin of Logan Avenue North, of the southerly 490
feet, measured perpendicularly to the northerly margin of Commercial Waterway
District #2, of the following described property:
All that portion of the Southeast one-quarter of the southeast one-quarter of
Section 7 and of Government Lot 1 in Section 18, Township 23 North, Range 5 East, '
W.M. , lying easterly of Commercial Waterway District #2 right-of-way; westerly of I
Logan Avenue North, as deeded to King County, Washington by deed recorded under
auditor's file No. 3261297 of King County, Washington:
TOGETHER with that portion of the City of Seattle Electric Transmission Line
right-of-way according to deed recorded in Volume 3079 of deeds , page 148, records
of King County, Washington, and recorded under King County Auditor's file No.
4166571 ;
EXCEPT the following described property:
BEGINNING at the intersection of the south margin of North 6th Street
(6th Avenue North) (Yesler Street) and the east margin of Commercial Waterway #2;
• thence South 13° 29' 00" East along the easterly marg;in of said Commercial Water- ,
; way #2 a distance of 328.75 feet; thence North 39° 45` 45" East, para11e1 to and
320 feet distance from the south margin of. North 6th Street (6th Avenue North) , a
. distance of 366.34 feet; thence North 0° 14' 15" West and at right angles to the

thence West along the southerly line of North 6th Street (6th Avenue North) to the

Said heretofore mentioned gra.ntee, its successors or assigns, shall
have the right, without prior notice or proceeding at law, at such times as
_ may be necessary to enter upon said above described property for the purpose
�-� 7 of constructing, maintaining, repairing, altering or reconstructing said
right-of-way, landscaping, utilities and related purposes or making any
� connections theret�ith, without incurring any legal obligations or liability
� therefore, provided, that such construction, maintaining, repairing, altering
� or reconstruction of such right-of-way or improvements shall be accomplished
C� in such a manner that the private improvements existing in the right(s)-of-way
� ' sha11 not be disturbed or damaged, or in the event they are disturbed or damaged,
ap they wi11 be replaced in as good a condition as they were immediately before the
Oproperty was entered upon by the Grantee.
� The Grantor shall fu11y use and enjoy the aforedescribed premises, including '
the right to retain the right to use the surface of said right-of-way if such use
does not interfere with installation and maintenance of the right-of-way, land-
. scaping, utilities and related purposes. However, the grantor shall not erect
buildings or structures over, under or across the right-of-way during the existence
of said improvements.
� This easement, shall be a covenant running with the land and sha11 be binding
on the Grantor, his successors, heirs and assigns. Grantors �covenant that they are
the lawful owners of the above properties and that they have a good and lawful
right to execute this agreement.
