� hereinafter called "Grantor(s)", and the CITY OF RENTON, a Municipal Corporation
� of King CoLmty, {aashington, hereinafter called "Grantee".

� WITNESSETH: I
That said Grantor(s) , for and in consideration of the sum of $ ,�,�
paid by Grantee, and other valuable consideration,
do by these presents, grant, bargain, sell, convey, and warrant unto the said
Grantee, its successors and assigns, an easement for public utilities (storm
drainage) with necessary appurtenances over, through, across and upon the �
following described property in King County, Washington, more particularly
described as follows :
A drainage easement 10 feet in width over the Northerly 10 feet, measured
perpen dicularly to the Northerly line, of the following described property:
All that portion of Tract 56, C.D. Hillman's Lake Washington Garden of Eden
Division No. 1, according to the plat recorded in Volume 11 of plats, page 63,
records of King County, Washington and of the North 1/2 of the abandoned Pacific
Coast Railroad R/W adjoining; also together with the vacated alley adjoining.
� The Grantors may relocate said drainage easement upon meeting the following
conditions:
l. 2`he design of drainage relocation must meet the approval of the Grantee.
2. All expenses incurred in relocatinc} the drainage system shall be borne
by the Grantors.
3. The Grantors shall be required to convey an executed drainage easement
covering said relocation to the Grantee
The Grantee shall relinquish this easement when the above conditions have
been fulfilled.
Together with a temporary construction easement described as:
- The Northerly 30 feet of the above described property.
Said temporary construction easement shall remain in force during construction
and until such time as the utilities and appurtenances have been accepted for the
operation and maintenance by the Grantee but not later than �---

Said heretofore mentioned grantee, its successors or assigns, shall
have the right, without prior notice or proceeding at law, at such times as
, may be necessary .to enter upon said above described property for the purpose
--- of constructing, maintaining, rep airing, altering or reconstructing said
utility, or making any connecti,ons therewith, without incurring any legal
,D obligations or liability therefore, provided, that such construction, main-
.._., taining, rep airing, altering or reconstruction of such utility shall be
�i accomplished in such a manner that the private improvements existing in the right
�,, right(s)-of-way shall not be disturbed or damaged, or in the event they are
..._. disturbed or damaged, they will be replaced in as good a condition as they were
�Q immediately before the p roperty was entered upon by the Grantee.

N The Grantor shall fully use and enjoy the aforedescribed premises,

including the right to retain the right to use the surface of said right-of-way
if such use does not interfere with installation and maintenance of the utility.
However, the grantor shall not erect buildings or structures over, Lmder or
across the right-of-w ay during the existence of such utility.
This easement, shall be a covenant rLmning with the land and shall be bind-
ing or� the Grantor, his successors , heirs and assigns. Grantors covenant that
they are the lawful owners of the above properti.es and that they have a good and
