That said Grantor, for and in consideration of the sum of Ten
Dollars ($10.00) paid by Grantee, and other valuable consideration,
, does by these presents , grant, bargain, sell, convey, and warrant
unto the said Grantee, its successors and assigns, a temporary con-
struction easement for a public utility (street improvement) with
- necessary appurtenances over, through, across and upon the following
described property in King County, Washington, more particularly
described as follows :

The Southeasterly 10 feet of the Northwesterly 13.5 feet,
measured perpendicularly to the Southeasterly margin of
the East Valley Highway, of the following described
property:
That portion of the Southeast one-quarter of the North-
west one-quarter of Section 31, Township 23 North, Range
5 East, W:M. , in King County, Washington, described as
follows :
BEGINNING at the intersection of the Easterly margin of
S .H. ##167, also known as E. Valley Highway, and the
Southerly margin of Carr Road, also known as South 180
Street, as conveyed to King County by deed recorded in
Auditor 's File No. 5807908, records of King County, said
point being the true point of beginning;
Thence South 89°06 '29" East along the Southerly margin of
Carr Road, a distance of 62 .03 feet;
Thence North 37°10 '31 " East along said margin a distance
of 9. 92 feet; thence South 89°06 '29" East a distance of
99. 97�-feet ; thence South 37°10 ' 31 " West a distance of
241. 00 feet; thence North 52°49 '29" West a distance of
110.44 feet; thence North 89°06 '29" West, a distance of
25 .00 feet to the Easterly margin of said S .H. #167;
Thence North 37°10 ' 31 " East along said Easterly margin a
distance of 150.00 feet to the true point of beginni.ng; ` ��
This Construction Easement is subject to the terms and condi-
tions of Exhibit A, which is attached hereto, and by this reference

made a part hereof.

� The said Grantee shall have the right, without prior institu-
tion of any suit or proceeding at law, at such times as may be neces-
sary to enter upon said above described property, without incurring
� any legal obligation or liability therefore, provided that such
.�. constructing of such street improvement project shall be accomplished
U in such a manner that the shru bbery, drives and walkways and land
� contours existing in the right-of-way shall not be disturbed or

O, destroyed or in the event that they are disturbed or destroyed, they
�- will be replaced in as good a condition as they were immediately before
�- the property was entered upon by the Grantee.
This temporary construction easement shall be a covenant running
with the land and shall be binding on the Grantor 's successors, heirs,
and assigns until acceptance of the street improvement project by
the Grantee, or until October 1, 1974, whichever shall first occur . �

l. The property interests herein are conveyed �together with

BEGINNING at the Southwest corner of the above described
tract of land and running;
� Thence Southerly along the Easterly margin of S.H. #167

� Thence Northeasterly in a straight line to a point on

Situate in the County of King, State of Washington.

2 . The City of Renton shall pay Grantor Twenty-Four Hundred
� and Eighty Dollars ($2480.00) for the taking in damages and, in
addition, shall (a) relocate the I.D. sign so that it no longer
overhangs the right-of-way, (b) relocate the floodlight and pole,
and (c) move Grantor ' s improvements off of the 32-foot strip, all
in accordance with Grantor 's specifications and to a location to be
determined by Grantor. �
3 . The foregoing specific actions to be taken by the City
of Renton shall be at its sole expense and in addition to the
$2480.00 to be paid Grantor for the taking in damages.
4 . This written instrument shall be of no force or effect
after October 1, 1974, unless the consideration of $2480.00 has been
paid Grantor, and the action required to be taken by Grantee has
not been performed prior to October l, 1974.
