Subsequently, at our request, on November 22, 1996 Tom Boyns forwarded futther materials to me. I am pleased to report that I have located our file and you will find enclosed the original of the Statutory Warranty Deed. The Statutory Warranty Deed was tendered to.the City Attorney's office the year prior to my � assuming the City Attomey's position. The Deed was to be delivered to the City, pursuant to paragraph 1 of the agreement, once written notice to Boeing of the City's intention to use the deeded property had been given and a one year period of time had elapsed, during wluch Boeing had the right to continue to occupy the deeded properry. After the ane year period of time my office was authorized to deliver the Deed. Therefore, we could have tendered the Deed to the City some time ago. The agreement goes on to recite other conditions which would be noted by reference to the paragraphs in the agreement. � 2. Renton warrants that all buildings and im�rovements abutting Park Avenue North are legal and valid nonconforming uses and that the City won't require removal or relocation of those buildings or improvements. - 3. Park Avenue widening must be completed within twenty years of the agreement, i.e. March �, 22, 1996. I 4. Renton assumes responsibility to widen Park Avenue and to relocate certain Boeing improvements and to preserve and maintain pedestrian vehicle�crossing access to a standard not less than that in 1976. I have been provided with a copy of the vacation ordinance so paragraph 5 has been satisfied. The only thing that I need to assure occurred before delivering the Deed is that the City gave the ' necessary notice to Boeing before proceeding with the widening of Park Avenue. Since the widening has been com}�leted, either the notice has been given, waived, or is now impossble. Therefore, I unconditionally deliver the Deed to the City of Renton. This request has been incorporated into the project design. Now that the project is in the final design phase, the following items must be agreed upon as soon as possible: Right-of-way: Widening entirely on the east side of the road as requested by Boeing will require additional right-of-way on the east within the Agreement area. Also, additional right-of-way outside of the Agreement area will be required. Widening Park Avenue North will not require all of the right-of- way originally purchased by Renton from Boeing. 'The widening will not require all the right-of-way the City owns between North 6th and North Sth Streets, adjacent to Boeing. The attached map shows the approximate locations of needed and excess right-of-way. � The City has no need for property that will not be used. Renton proposes that the right-of-way not I needed be sold to Boeing at the 1976 rate and the additional right-of-way needed for widening be purchased from Boeing by Renton at the 1976 rate. Additional Costs: In the 1976 Agreement, Boeing paid the City of Renton to relocate specific existing infrastructure in the right-of-way purchased for the widening. With the widening being done entirely , on the east side, infrastructure currently located in the area needed for additional right-of-way may have ' to be relocated. Additional giade adjustments and modifications to improvements on the adjacent property may also be necessary as a result of widening entirely to the east. Also, adjustments to infrastructure in the right-of-way to be sold to Boeing may no longer be necessary. In accordance with City Permits R0023 and R0074 (copies attached), Boeing will need to remove the canopies to the extent required for the road and sidewalk construction. After the widening is finished, Boeing can apply for new permits to reinstall the canopies. This work could be coordinated with the widening project.
