Sai d heretofore menti oned grantee. i ts successors or assi gns, shal l '
have the right, without prior notice or proceeding at law, at such times as
may be necessary to enter upon said above described property for the purpose
of constructing, maintaining, repairing, altering or reconstructing said
utility, or making any connections therewith, without incurring any lega]
� obl igations or ]i abi 1 i ty therefore, provi ded, that such construction, main- �
tt� taining, repairing, altering or reconstructian of such utility shall be �
� accorr�lished -in such a manner that the prtvate improvements existing �in the right
� righ�(s)-of-way shall not be disturbed or damagzd, or in the event they are
N disturb�d or damaged, they will be replaced in as good a conditiQn as. they w�re
� immediate]y before the property was entered upon by the Grantee. �

The Grantor shall fully use and enjoy the aforedescribed premises,
� including the right to retain the r�ght to use the surface of said right-of-way
if such use does not interfere with installation and maintenance of the utility
line. However, the grantor shall not erect buildings or structures over., under
or across the •right-of-wa�y during the existence of such utility.
This easement� shall be a covenant running with the land and shall be Lind-
ing on the Grantor, his successors, heirs and assigns. Grantors covenant that
they are the lawful owners of°the'-above praperties and that they have a good and
lawful right to execute this agreement.
