WSaid heretofore mentioned Grantee, its successors or assigns,

q shall have the right, upon prior notice, at such times as may be

� necessary to enter upon said Real Property for the purpose of opera-

W ting, maintaining and repairing said sewer line, provided,, that such

z opera�ing, maintaining and repairing of said se�ver line shall be

� accomplished in such a manner that the private improvements existing

'�' in and on said Real Froperty shall not be disturbed or damaged, and

� said Real Property will be restored to as good a condition as it was

� � (2) acts and omissions of Grantor in its use of its Real Property

� � which af�ect Grantee' s employees, agents, contractors and other
parties benefiting from said sewer line; provided ho�vec�er, this
paragraph does not purport to indemnify Grantor against liability

for damages arising out of bodily irijury� to persons or damage to i
property caused by or resulting from the sole negligence of Grantor
or Grantor ' s agents or employees . -
2. The Grantor shall fully use and enjoy said Real Property ,
including the right to retain the right to use the surface thereof
if such use does not interfere with the operation and maintenance of
said sewer line.
3. The Grantor shall have the right to construct , reconstruct

� and maintain buildings or structures over and on said Real Property
� provided that clearance of at least 4 feet from the exterior of the
�
O sewer line, as constructed, and the bottom of any foundation for said
� -
� � buildings or structures are maintained, and provided, further, there
shall not be any footings or bearing points for any permanent
improvement over said sewer line as constructed; and provided that
should the Grantor exercise the right to construct such permanent
improvement , Grantee shall be allowed the right of ingress and egress
over other real property of the Grantor for the purpose of reaching
the portion of the Real Property blocked by such improvement .
In the event of the construction of a b uilding improvement over
said Real .Property, Grantor agrees to notify Grantee of Grantor' s
intent to so construct , and Grantor shall submit a plan therefor and
give the Grantee a reasonable right to inspect same, and take such
steps as are necessary to protect the sewer line installed within
the Real Property.
4 . Grantee will allow the Grantor the right to connect to said
sewer line in the future provided that Grantor or his successors pay
the normal charges as required by other parties desiring to connect .
5. Should the Grantee cease to use this Easement for the
purposes specified herein for a period of two (2) years, it shall
notify the Grantor of such nonuse, and the rights granted herein
shall revert to the Grantor, and Grantor' s Real Property shall be .
freed from this Easement as fully and completely as if this Easement
had not been granted.
6. This Easement , shall be a covenant running with the Real
Property and shall be binding on the Grantor, his successors,- heirs
and assigns.

EXHIBIT "A" .
To Easement by and between Puget Western, Inc. , as Grantor, and �,
the City of Renton, as Grantee.
A strip of land, fifteen (15.) feet in width, having
seven and one-half (7-1/2) feet of such width on each
side of the centerline of a 42 inch storm sewer line '��.;
crossing the following described tract of land situate `���,
