Said heretofore mentioned grantee, its successors or assigns , shall
have the right, w�thout prior notice or proceeding at law, at such ti�nes as
may be necessary to enter upon said above described property for the purpose
� of constructing, maintaining, repairing, altering or recanstructing said
ut�lity, or making any connections therewith, without incur•ring any legal
obl i gations or 1 i abi 1 i ty therefore, provi ded, that such construction, main-

taining, repaaring, altering or reconstruction of such utility shall be
y accon�lishe.d in such a manner that the prtvate improvements existing in the right
right(s)-of-way shall not be disturbed or damag�d, or in the event �hey are
disturbed or damaged; they wi 11 be repl aced in as good a condi tio.n as they evere
immediately before the property was ente red upon by the Grante�.
� The Grantor shall fully use and enjoy the aforedescribed premises, �
� including the right to�retain the right to use the surface of s�id right-o�-way
�. if such use does not interfere with installation and maintenance of the ut�ility
p line. However, the grantor shal] not :e rect buildings or structures over, under
