Dear Mr. Christ:
We have reviewed the latest site plan drawings submittedon June 16th by
Ashley Shoreline Design & Permitting for.the proposed pier reconstruction at
Southport in conjunction with historic aerial photos .. EvidE?ntly; a large portion of
the preexisting pier shown onthe plariwaS'removed at some.point in the p~st.
An aerial photo from 1995 indicatesthaf the portion of the pier you noW propose
to repair was already removed at that time. . . .
This letter is sent to advise you that we consider the proposed new construction .
to be more extensive than can be authorized under a' Shoreline Permit
Exemption. As we are unable to isslje a shoreline permit exemption, the pier
reconstruction will require enviro'nmental review anda Shoreline
Substantial Development Permitin advance of building permit issuance.
The proposed boatlift will also require a Shoreline Conditional Use Permit
in addition to building and electrical permits.
I have enclosed anapplication for aCity Shoreline Substantial Development
'PermiUenvironmental review. If you have any questions regarding this letter or
the application package, please feel free to contact Laureen Nicolay at425-430-
7294. Please also contact state and federal agencies (i.e. State Department of
Fish and Wildlife, Army Corps) to determine what permits they may require for
the project.

A couple of items ...... in the Sunday Times SECO was advertising Southport as an area for Boat Moorage,
boat storage and Boat access, etc.
Additionally Larry, I am going to forward to you the easement language the City has with Boeing for the 20'
recorded easement adjacent to the Southport Property. In our discussions we talked about securing a 50
year easment for Southport over the flume area with the potential to move the trail to the Boeing property
when Boeing leaves. In last week's e-mail I believe Alex indicated that we should not count on Boeing
leaving and so we would be left with using the 20' easement area. The current Boeing regime did not
know of this easement as Paul Crane recorded this many many years ago. Boeing has not been very
supportive of the City exercising it's right to use this area due to wing span overhang issues, utilidor
issues, etc. The easement language does have some restrictive uses.
I also said that I would contact our granting agencies regarding the minimum length for recreational
easements. The State grants (lAC) require a minimum length of 50 years. Funding is limited to $300,000
with a 50% match. The Federal Land and Water Conservation Fund (LWCF) requires an easement that
runs with the property in perpetuity. LWCF monies were utilized to construct Coulon Park and the
connection from Coulon to the Boathouse would rank high for funding again. Funding is unlimited with a
50% match. I have another call in the the granting agency to ascertain whether development of the
easement area is tied to the funding or whether all portions of the entire project area must meet the grant
funding requirements.
I'll try to get the Boeing easement and language information to you by Friday, Larry.

Larry,
I do not think the City should be implying approval for use of the flume for moorage at this time. The
agreement should be limited to the easement discussion, and not other land use issues. If we elect to
keep this language in the agreement, then we should include language noting the requirement for proper
permitting by the City (which may be denied) and other appropriate government agencies.

THIS PEDESTRIAN PROMENADE EASEMENT AGREEMENT ("Easement"),
effective this __ day of ,2004, is made by and between SOUTHPORT, LLC
and THE BRISTOL AT SOUTHPORT, LLC, each a Washington limited liability company
(collectively "Grantor"), and CITY OF RENTON, a Washington municipal corporation
("Grantee").
RECITALS
A. Grantor is the owner of real property located in King County, Washington
legally described on Exhibit A attached hereto (the "Grantor Property").
B. The Gene L. Coulon Memorial Beach Park, a municipal public park operated by
Grantee, is located northeasterly of the Grantor Property (the "Park"). The Park contains a
public walkway a portion of which is along the southern shoreline of Lake Washington (the
"Walkway").
C. Grantee desires to extend the Walkway across a portion of the Grantor
Property.
D. Grantor has agreed to grant an easement across that portion of the Grantor
Property depicted on Exhibit B attached hereto and legally described on Exhibit C attached
hereto and by this reference incorporated herein (the "Easement Area") for the benefit of
Grantee, for public sidewalk and pedestrian purposes, subject to the terms and conditions set
forth herein.
E. Grantor previously granted Grantee a pedestrian access easement across a
portion of the Grantor Property through that certain Pedestrian Promenade Easement dated
November 14, 2000 and recorded under King County Recording No. 20001117001232 (the
"Prior Easement"). This Easement replaces and supersedes in its entirety the Prior Easement,
which is hereby terminated.
AGREEMENT
NOW THEREFORE, the parties agree as follows:
1. Grant of Easement. Grantor hereby grants to Grantee a perpetual, non-
exclusive easement over, across, and upon the Easement Area for public sidewalk and
pedestrian access purposes.
2. Reservation of Rights. Grantor reserves the right to use the Easement Area for
any purpose not inconsistent with the rights herein granted, including maintaining, inspecting,
repairing, replacing, and operating any below-ground utilities located now or in the future
within the Easement Area.

3. Hours of Easement Access. The easement rights granted in Section I above
shall be limited to those hours during which the Park is open to the general public.
4. Improvement of Easement Area.
a. Grantee Improvements. Grantee shall have the right from time to time
and at Grantee's sole cost and expense to improve the surface of the Easement Area for public
sidewalk and pedestrian access purposes. Grantee agrees to give Grantor not less than thirty
(30) days prior written notice before commencing any improvement within the Easement
Area, will consult with Grantor regarding such improvements to confirm that such
improvements are consistent with and to the extent requested by Grantor are intergrated with
Grantor's use of the Property adjacent to the Easement Area, and all such improvement work
shall be conducted so as not to unreasonably interfere with the use and enjoyment of the
remainder of the Grantor Property. Above ground improvements within the Easement Area
shall be subject to the advance written approval of Grantor, and shall not interfere or impede
in any manner with access to and from the Easement Area from the Grantor Property and
across the Easement Area
b. Grantor Improvements. Grantor shall have the right, but not the
obligation, to improve the Easement Area in a manner generally consistent with Grantor's use
of the Grantor Property and in accordance with development of the Grantor Property and the
surrounding area Any improvements constructed by Grantor within the Easement Area shall
be at the sole cost and expense of Grantor. All such improvements constructed by Grantor
shall preserve the fundamental use of the Easement Area for public sidewalk and pedestrian
access purposes.
c. Grantor Approval. Upon completion of any improvements by Grantor
within the Easement Area, all subsequent improvements by Grantee within the Easement Area
shall be subject to the advance written approval of Grantor, shall be designed to be consistent
with Grantor's use of the remainder of the Property, and shall not interfere or impede in any
manner with access to and from the Easement Area from the Grantor Property and across the
Easement Area.
d. Standard of Improvements. Any improvements constructed by Grantor
or Grantee within the Easement Area shall be of first class design and materials, and shall be
at an improvement level at least equal to the standards for other sidewalks and pedestrian
walkways maintained by Grantee along the Lake Washington shoreline and/or adjacent to
other parks owned or managed by Grantee.
5. Maintenance of Easement Area. Grantee shall maintain the Easement Area at
its sole cost and expense, and at a level at least equal to the standards for other sidewalks and
pedestrian walkways maintained by Grantee along the Lake Washington shoreline and/or

adjacent to other parks owned or managed by Grantee. All such maintenance shall be
undertaken in a manner so as not to unreasonably interfere with the use and enjoyment of the
remainder of the Grantor Property. To the extent Grantee (with the consent of Grantor)
installs garbage collection containers along the Easement Area, Grantee agrees to collect such
garbage on a regular basis. The foregoing shall not prevent Grantor from also maintaining
portions of the Easement Area if Grantor elects to do so (but without any obligation of
Grantor to do so).
6. Relocation of Easement Area Grantor shall have the right to relocate the
Easement Area from time to time in connection with a general improvement plan for the
Grantor Property and surrounding area, provided that the new location of the Easement Area
shall be no more than 20 feet from its current location and shall be sufficient to serve the
Grantee for the same purposes and in the same manner as the location designated in this
Easement. Grantor shall perform any such relocation at its sole cost and expense. Upon such
relocation, and at the reque~t of Grantor, Grantor and Grantee shall amend this Easement to
specify the new location of the Easement Area.
7. Binding Effect. The Easement shall burden the Grantor Property and be for the
benefit of Grantee.
8. Indemnification. Grantee hereby releases, indemnifies and promises to defend
and save harmless Grantor from and against any and all liability, loss, damage, expense,
actions and claims, including costs and reasonable attorneys' fees incurred by Grantor in
defense thereof, asserted or arising directly or indirectly on account of or out of acts or
omissions of Grantee in the exercise of the rights granted herein and/or in connection with the
use of the Easement Area; provided however this paragraph does not purport to indemnify
Grantor against liability for damages arising out of bodily injury to persons or damage to
property caused by or resulting from the gross negligence or willful misconduct of Grantor, or
its agents or employees.
9. General Provisions.
9.1 Notices. Any notice, request, approval, consent, or other
communication required or permitted to be given by any party to any other hereunder shall be
in writing and shall be deemed to have been duly given when delivered personally or by
overnight courier; or received following deposit as prepaid certified mail (return receipt
requested) with the United States Postal Service; and addressed to the appropriate party at its
address set forth below, or at such other address as such party shall have last designated by
notice to the other.

9.2 Attorneys' Fees. If any suit or other proceeding is instituted by any of
the parties to this Easement arising out of or pertaining to this Easement, the substantially
prevailing party shall be entitled to recover its reasonable attorneys' fees and all costs and
expenses incurred from the substantially nonprevailing party, in addition to such other
available relief.
9.3 Entire Agreement. This Easement constitutes the entire agreement of
the parties hereto with respect to the matters dealt with herein. This Easement shall not be
modified unless done so in writing and signed by both parties.
9.4 Governing Law. This Easement shall be governed by and construed in
accordance with the laws of the state of Washington.
9.5 No Abandonment. Failure to act by either party under this Easement
shall not constitute abandonment of the Easement. This Easement shall only terminate by
written agreement executed by both Grantor and Grantee and recorded with the King County
Recorder's Office.
9.6 Severability. The invalidity of any provision of this Easement as
determined by a court of competent jurisdiction, shall in no way affect the validity of any other
provision hereof.

The purpose of this letter is to confinn the commitment of Seco Development, Inc. and the City of
Renton to negotiate in good faith regarding (i) the improvement of the existing flume/dock structure on
the westerly portion ofthe Seco property adjacent to the Renton Boeing plant to allow public use, boat
moorage and similar uses; and (ii) the grant of an easement to the City over the improved flume/dock
structure as part of the pedestrian waterfront trail the City is planning along the south shore of Lake
Washington.
Our efforts will include cooperation to detennine the ability to plank over or otherwise improve the
flume/dock structure to make it safe and to make it useable for both pedestrian passage and boat
moorage. However, we would not propose any changes to the flume structure itself, lower the edges of
the flume or redirect the out fall of the flume in any way.
Regarding the pedestrian easement, the grant of the easement would be conditioned upon the
improvement ofthe flume/dock structure in the manner noted above. The easement would be for an
interim period as part of the trail system until the Boeing Renton plant was redeveloped, at which time
the trail would be relocated onto the Boeing property and the easement over the flume/dock structure
would be terminated. The easement would be non-exclusive, would generally affect the westerly
portion of the flume/dock structure, and would permit continued use of the easterly and northerly
portions of the dock/flume structure for boat moorage and other dock purposes. The City is going to
investigate what terms will be required in this easement to meet the requirements for likely federal and
state funding sources for the trail system.
Of course, neither the City nor Seco is obligated to reach agreement on any of the issues set forth
above, and neither party would be under a legal commitment until formal documents are signed.
However, we acknowledge the mutual benefits to both the City and Seco of the trail system and we
jointly commit in good faith to seek a mutually satisfactory arrangement.

When Seco Development was granted permission to repair the center section of the pier, they also began removing
other damaged sections of the pier. Since that time they have removed the floating breakwater, most to the decking
and stringers, leaving the piles and some caps. They removed this material because it was being tom off during
high wind and wave events, posing a hazard to other structures.
Michael Christ is working on the easement agreement, as soon as it is available we will be turning it in for review
them recording.

SUBJECT: Southport Trail and Dock Easement
Attached is a memorandum that provides clarification of the intent of the trail easement
agreement at Southport.
There has been some question as to the status of the "dock" that runs north-south,
perpendicular to the bulkhead at Southport. Mr. Christ has maintained, I believe, that this
structure is not included in the easement area. As the memo states, ',' .. .it has been
. intended that the City would have an easement to access and use the dock as a future
connection to trails to the west." The north-south is the only dock, of possibly two or
more there, that could provide a "connection to trails tothe west."
Apparently, the language was clarified to state, " ... shall dedicate a public recreation
easement for physical access to and use of the dock to ensure long-term opportunities for
public access tp the shoreline." There may be a problem in that it was not clear, even in
the revised language of the mitigation document, which dock was the one referred to.

SUBJECT: Southport Mitigation Document -Final
Based upon the memos to ERC dated September 9 and 10, 1999, and the comments from the last
ERC meeting regarding trail maintenance and ftre access to the promenade, changes have been
incorporated into the Southport Mitigation Document. Typographical and grammatical editing
have also occurred. The Mitigation Document will be published on Friday, September 17, 1999,
and you will receive a copy of it.
Since the ERC meeting on September 13, 1999, Lisa Grueter noted language that could be a
potential interpretation problem, and after discussions with Jennifer Henrting, made a change that
better reflected the intent of the mitigation measure related to trail easements:
• The property owner(s) and developer(s) as appropriate, shall dedicate, develop, and maintain
a public recreation easement for physical access along the promenade and shall dedicate a
public recreation easement for physical access to and use of the dock to ensure long-term
opportunities for public access to the shoreline.
The clarification was made because it has been intended that the City would have an easement to
access and use the dock as a· future connection to trails to the west. As written prior to the
clarification the language could have been misinterpreted as requiring an easement up to, but not
including the dock.
As a general note, we are interpreting the mitigation measures as being applicable to the activities
analyzed in the SEIS. For instance, if impact pile driving is conducted then there are noise and
vibration mitigation measures related to that activity. If impact pile driving is not used, some
noise and vibration measures would not apply.

Dear Sir:
Seco Development would like to repair the existing pier at their Southport development site. The existing piles
will be used with a great number being removed from the near shore littoral zone. The size, shape, and footprint of
the pier will be reduced in size.

The Current use of the property is Commercial, mixed use, apartment. The site is located along the shores of Lake
Washington. The proposed use will remain commercial, mixed use, apartment. Previously existing pier and log
boom structures encompassed 10,359 square feet of overwater coverage. The log boom structure and thirteen (13)
feet of the twenty (20) food wide pier removal results in 5,165 square feet of total remaining overwater coverage.
This is a reduction of 5, 194 square feet of overwater coverage. The center section of the pier (2,550 SF) has been
previously repaired. This proposed stage of pier repair encompasses 2,644 square feet.
Fifty-six non-treated piles, ranging in size from 12" to 16" will be removed. The remaining piles and walers are
essential to the integrity of the ecology block and sheet pile bulkhead, running the length of the shoreline. These
piles will be used to construct the reduced width pier of seven (7) feet. The seven (7) feet is the minimum width
necessary to cover the pile and waIer structure supporting the bulkhead A free standing portable boatlift will be
installed.
The lake bed consists of sand and gravel. No drainage issues will be raised by the proposed project. The estimated
cost of the project is $9,800.00. There will be no fill or excavation with the proposed project. No trees will be
removed The project will occur over the water. The entire shoreline consists of bulkhead.
