A RESOLUTION OF THE CITY OF RENTON, WASHINGTON,
APPROVING FINAL PLAT (JACQUES 24th ST.; FILE NO. LUA-04-
019FP).
WHEREAS, a petition for the approval of a :final plat for the subdivision of a certain tract
of land as hereinafter more particularly described, located within the City of Renton, has been duly
approved by the PlanningIBuildinglPublic Works Department; and
WHEREAS, after investigation, the Administrator of the PlanningIBuildinglPublic Works
Department has considered and recommended the approval of the :final plat, and the approval is
proper and advisable and in the public interest; and
WHEREAS, the City Council has determined that appropriate provisions are made for
the public health, safety, and general welfare and for such open spaces, drainage ways, streets or
roads, alleys, other public ways, transit stops, potable water supplies, sanitary wastes, parks and
recreation, playgrounds, schools, schoolgrounds, sidewalks and other planning features that
assure safe walking conditions for students who walk to and from school; and
WHEREAS, the City Council has determined that the public use and interest will be
served by the platting of the subdivision and dedication;
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF RENTON, \

VoiceStream PCS ill Corporation master use agreement with the City of
Renton to install wireless communication facilities within the City of Renton
right-of-way. Conduit and cable will be installed underground using
conventional trenching, horizontal boring, and directional drilling methods.
This master use agreement between the City and VoiceStream PCS ill
Corporation is for a period of ten years. The Committee further recommended
that the Mayor and City Clerk be authorized to execute the master use

Mayor Keolker-Wheeler stated that staff will consider HCA's request for this
type of traffic control measure as part of the City's traffic calming process
which was adopted by CQuncii on August 5, 2002.
Additionally, Ms. DeMastus announced that a briefing on safety issues related
to the Olympic pipeline will take place at the HCA meeting on May 27th.
Sue Larson-Kinzer, 1733 NE 20th St., Renton, 98056, stated that regardless of
the outcome of the Jones Ave. Short Plat appeal, she appreciates the time and
energy the Hearing Examiner has spent on the matter, and the assistance
provided by a fonner Development Services Division planner. Ms. Larson-
Kinzer stated that she is aware that the City is revising its Comprehensive Plan,
and asked for more infonnation about the process.
Mayor Keolker-Wheeler asked staff to forward the Comprehensive Plan review
process schedule to Ms. Larson-Kinzer. She noted that Council is briefed on
the matter monthly at a Committee of the Whole meeting, and the Planning
Commission addresses it at almost every meeting. CAO Covington added that
she is welcome to address comments regarding the Comprehensive Plan to the
Planning Commission, as the commission makes recommendations to Council.

SUMMARY OF ACTION:
The recommendation for approval of the referenced final plat is submitted for Council action.
This fmal plat subdivides 1.78 acres into 11 single family residential lots with water, sanitary
sewer, storm drainage, street lighting, curb and gutter, sidewalks and street improvements.
Design and construction of utilities, lighting and pavement will be approved, accepted or
deferred (and a security device posted) as required through the Board of PUblic Works prior to
recording the plat. All conditions placed on the preliminary plat by the City of Renton will be
met prior to recording the plat.
STAFF RECOMMENDATION:

FINDINGS, CONCLUSIONS & RECOMMENDATION
Having reviewed the record documents in this matter, staff now makes and enters the following:
FINDINGS:
1. The applicant, James Jacques Construction LLC, filed a request for approval of an 11 lot Final
Plat. .
2. The yellow file containing all staff reports, the State Environmental Policy Act (SEPA)
documentation and other pertinent materials was entered into the record as Exhibit No.1.
3. The Environmental Review Committee (ERC), the City's responsible official, issued a
Determination of Non-Significance-Mitigated on November 7, 2000, for the subject proposal.
4. The subject proposal was reviewed by all departments with an interest in the matter.
5. The subject site is located at Camas Ave NE and NE 24th St. The new plat is located in Section
5, Twp. 23 N. Rng. 5 E.
6. The subject site is a 1.78 acre parcel.
7. The Preliminary Plat received City of Renton Council approval on April 9, 2001.
8. The property is located within the R-8 zoning designation (single family - 8 dwelling units/acre).
9. The Final Plat complies with both the Zoning Code and the Comprehensive Plan.

10. The Preliminary Plat was subject to a number of conditions as a result of both environmental
review and plat review. The applicant has complied with the conditions imposed by the ERC:
1. The applicant shall install a siltfence along the down slope perimeter of the area that is to be
disturbed The silt fence shall be in place before clearing and grading is initiated, and shall
be constructed in conformance with the specifications presented in of the King County
Surface Water Design Manual. This will be required during the construction of both off-site
and on-site improvements as well as building construction.
Silt fencing has been installed, in conformance with the specifications presented in the
King County Surface Water Design Manual, along the area that is to be disturbed. This
silt fencing will be maintained throughout plat infrastructure and building construction.
2. Shallow drainage swales shall be constructed to intercept surface water flow and route the
flow away from the construction area to a stabilized discharge point. Vegetation growth
shall be established in the ditch by seeding or placing sod Depending on site grades, it may
be necessary to line the ditch with rock to protect the ditch from erosion and to reduce flow
rates. The design and construction of drainage swales shall conform to the specifications
presented in KCSWDM Temporary pipe systems can also be used to convey storm water
across the site. This will be required during the construction of both off-site and on-site
improvements as well as building construction.
Swales have been installed to intercept surface water flow and route flow away from the
construction area to a stabilized discharge area.
3. The project contractor shall perform daily review and maintenance of all erosion and
sedimentation control measures at the site during the construction of both off-site and on-site
improvements as well as building construction.
The project contractor has performed daily checks and necessary maintenance of all
erosion and sedimentation control measures at the site on all construction. The City of
Renton's inspector has also been on site periodically to verify maintenance of these
TESC measures.
4. Weekly reports on the status and condition of the erosion control plan with any
recommendations of change or revision to maintenance schedules or installation shall be
submitted by the project Engineer of record to the public works inspector for the construction
of the civil improvements of the plat. Certification of the installation, maintenance and
proper removal of the erosion control facilities shall be required prior to recording of the
plat.
Ongoing reports on the status of the erosion control plan have been submitted by the
project Engineer to the public works inspector.
5. The applicant shall pay the appropriate Traffic Mitigation Fee based on a rate of$75.00 per
each new trip attributable to the project, estimated to be 9.55 average weekday trips per new
residence. The Transportation Mitigation Fee is due prior to the recording of the plat.
The mitigation fees will be paid prior to recording the plat.
6. The applicant shall pay the appropriate Fire Mitigation Fee based on a rate of$488.00 per
new single family residential lot created by the proposed plat. The fee is due prior to the
recording of the plat.
The mitigation fees will be paid prior to recording the plat.

7. The applicant shall pay the appropriate Parks Mitigation Fee based on a rate of$530. 76 per
each new single family residential lot. The fee is due prior to the recording of the plat.
The mitigation fees will be paid prior to recording the plat.
8. The water quality treatment and detention shall be designed to be in compliance with the
King COWlty Surface Water Design Manual. The system will require retention of the 100-
year storm plus thirty percent (30%) for safety factor.
The surface water detention system has been designed to provide detention for the 100-
year storm event with a 30% safety factor.
11. In addition, the applicant has complied with the conditions imposed as a result of Preliminary
Plat:
1. Compliance with ERC Mitigation Measures: The applicant is required to comply with the
Mitigation Measures, which were required by the Environmental Review Committee
Threshold Determination.
The applicant stated that all mitigation fees would be paid when mylars are submitted.
2. The applicant shall either draft and record a Homeowners' Association or a maintenance
agreement for the maintenance of all common improvements, including private stormwater
facilities. A draft of the document shall be submitted to the City of Renton Development
Services Division for review and approval by the City Attorney prior to the recording of the
final plat.
The maintenance agreement shown on the face of the plat has been reviewed and
approved by the City Attorney.
3. The applicant shall achieve an agreement with the eastern neighbor to assure that any grade
transition for the new road is safe and stable.
Both project applicants have complied with this item.
4. The City, applicant and eastern neighbor shall work to achieve appropriate alignment and
location for utilities so that they may be used by the lot east of the subject site.
City staff, both applicants and the engineer have all worked together to achieve
alignment on both projects.
The Final Plat generally appears to satisfy the conditions imposed by the preliminary plat process and
therefore should be approved by the City Council.
RECOMMENDATION:
The City Council should approve the Final Plat with the following conditions:
I) All plat improvements shall be either constructed or deferred to the satisfaction of City staff prior
to the recording of the plat.
2) All fees shall be paid prior to the recording of the plat.

9. The Final Plat complies with both the Zoning Code and the Comprehensive Plan.
10. The Preliminary Plat was subject to a number of conditions as a result of both environmental
review and plat review. The applicant has complied with the conditions imposed by the ERe:
1. The applicant shall install a silt fence along the down slope perimeter of the area that is to be
disturbed. The silt fence shall be in place before clearing and grading is initiated, and shall
be constructed in conformance with the specifications presented in of the King County
Surface Water Design Manual. This will be required during the construction of both off-site
and on-site improvements as well as building construction.
Silt fencing has been installed, in conformance with the specifications presented in the
King County Surface Water Design Manual, along the area that is to be disturbed. This
silt fencing will be maintained throughout plat infrastructure and building construction.
2. Shallow drainage swales shall be constructed to intercept surface water flow and route the
flow away from the construction area to a stabilized discharge point. Vegetation growth
shall be established in the ditch by seeding or placing sod. Depending on site grades, it may
be necessary to line the ditch with rock to protect the ditch from erosion and to reduce flow
rates. The design and construction of drainage swales shall conform to the specifications
presented in KCSWDM Temporary pipe systems can also be used to convey storm water
across the site. This will be required during the construction of both off-site and on-site
improvements as well as building construction.
Swales have been installed to intercept surface water flow and route flow away from the
construction area to a stabilized discharge area.
3. The project contractor shall perform daily review and maintenance of all erosion and
sedimentation control measures at the site during the construction of both off-site and on-site
improvements as well as building construction.
The project contractor has performed daily checks and necessary maintenance of all
erosion and sedimentation control measures at the site on all construction. The City of
Renton's inspector has also been on site periodically to verify maintenance ofthese
TESC measures.
4. Weekly reports on the status and condition of the erosion control plan with any
recommendations of change or revision to maintenance schedules or installation shall be
submitted by the project Engineer of record to the public works inspector for the construction
of the civil improvements of the plat. Certification of the installation, maintenance and
proper removal of the erosion control facilities shall be required prior to recording of the
plat.
Ongoing reports on the status of the erosion control plan have been submitted by the
project Engineer to the public works inspector.
5. The applicant shall pay the appropriate Traffic Mitigation Fee based on a rate of$75.00 per
each new trip attributable to the project, estimated to be 9.55 average weekday trips per new
residence. The Transportation Mitigation Fee is due prior to the recording of the plat.
The mitigation fees will be paid prior to recording the plat.
6. The applicant shall pay the appropriate Fire Mitigation Fee based on a rate of$488.00 per
new single family residential lot created by the proposed plat. The fee is due prior to the
recording of the plat.

7. The applicant shall pay the appropriate Parks Mitigation Fee based on a rate of$530. 76 per
each new single family residential lot. The fee is due prior to the recording of the plat.

8. The water quality treatment and detention shall be designed to be in compliance with the
King County Surface Water Design Manual. The system will require retention of the 100-
year storm plus thirty percent (30%) for safety factor.
The surface water detention system has been designed to provide detention for the 100-
year storm event with a 30% safety factor.
11. In addition, the applicant has complied with the conditions imposed as a result of Preliminary
Plat:
1. Compliance with ERC Mitigation Measures: The applicant is required to comply with the
Mitigation Measures, which w.ere required by the Environmental Review Committee
Threshold Determination.
The applicant stated that all mitigation fees would be paid when mylars are submitted.
2. The applicant shall either draft and record a Homeowners' Association or a maintenance
agreement for the maintenance of all common improvements, including private stormwater
facilities. A draft of the document shall be submitted to the City of Renton Development
Services Division for review and approval by the City Attorney prior to the recording of the
final plat.
The maintenance agreement shown on the face of the plat has been reviewed and
approved by the City Attorney.
3. The applicant shall achieve an agreement with the eastern neighbor to assure that any grade
transition for the new road is safe and stable.
Both project applicants have complied with this item.
4. The City, applicant and eastern neighbor shall work to achieve appropriate alignment and
location for utilities so that they may be used by the lot east of the subject site.
City staff, both applicants and the engineer have all worked together to achieve
alignment on both projects.
The Final Plat generally appears to satisfy the conditions imposed by the preliminary plat process and
therefore should be approved by the City Council.
RECOMMENDATION:
The City Council should approve the Final Plat with the following conditions:
1) All plat improvements shall be either constructed or deferred to the satisfaction of City staff prior
to the recording of the plat.
2) All fees shall be paid prior to the recording of the plat.

Please note that the comments above address the plat review. You will want to continue working with
the City inspector, Dan Thompson, to insure that the project has a final walk through and sign-offby
the inspector. This includes any punchlist items from the inspector an~or the City Maintenance
Division. You will want to verify that you have the proper street n~es on the street name signs
(along with completing all street signage) that ate required to be installed prior to recording. Please

Fire Prevention Comments:
All roadway and street signage work needs to be completed.
As-Built Concerns:
The construction permit plan mylars must be checked-out from the sixth floor public works counter
and updated or replaced with a complete As-Built plan set. All plan sheets, including those
constructed per design, must be verified, stamped and signed as As-Built by a licensed surveyor or
engineer. The mylars are labeled As-Built in large block letters and stamped by a PE or PLS. Submit
an ASCI file along with your As-Built drawings.
The civil drawings shall accurately reflect the construction activity. The civil drawings also need to
show all watermain, sanitary sewer, and storm drainage systems easements which shall be consistent
with the As-Built location of the utility. Once the above have been addressed, submit one set of As-
Built bluelines of the civil drawings to my office. The inspector will be reviewing the bluelines and if
all is in order I will then call for the civil mylars to be returned. These final mylars must be submitted
for our permanent records.

Construction Cost Data Concerns:
At the same time the As-Built bluelines are submitted, the owner of the development or authorized
agent shall supply the detailed construction cost of the public Water system, Sanitary Sewer System,
Storm Drainage Systems, street improvements and street lighting on the Cost Data and Inventory
Form and sign it at the bottom. This form is to reflect only those facilities that will be turned over to
the City. An example of items that are NOT turned over are sidesewer stubs, water service lines and
private storm drainage facilities. Return the original form to my office. The Bill of Sale is to reflect
the items and quantities as shown on the Cost Data and Inventory form (both are enclosed).
A maintenance bond is required in the amount of 10% of the grand total of the water, sewer, storm,
street and street lighting costs as shown on the Cost Data Inventory form.·A standard City of Renton
maintenance bond form is enclosed. The permit bond will be released upon receipt and acceptance of
the maintenance bond, of the above documentation and final sign':offby the inspector.
Fees:
The applicant shall pay the Fire Mitigation Fee of $488 per each new single family lot prior to the
recording of the final plat.
The applicant shall pay the Transportation Mitigation Fee of $644625 prior to the recording of the
final plat. The applicant shall pay the Parks Mitigation Fee of $530.76 per each new single family lot
prior to the recording of the final plat. . .. .
General:
I have one additional comment on the plat drawing. Lot 8 is currently showing a 41' public drainage
easement. The detention vault on this project is privately owned and maintained. I am not aware of
any reason why this is a public easement. The callout should be revise~to read 'Private drainage and
access easement'. Also note that there is a typographical error in the Access Easement language on
sheet 1 of the plat, it should read 'municipality' .
A copy of the plat has been sent to the City Attorney for review of the language submitted for the
maintenance agreement for the maintenance of all common improvements, including private
stormwater facilities as required by Recommendation 2 of the Hearing Examiners report. I will keep
you informed.

Please review the attached Maintenance Agreement as to legal form. Per the Hearing Examiner's
report under Recommendation item 2, the applicant shall either draft and record a homeowner's
association or maintenance agreement for the maintenance of all common improvements,
including private storm water facilities.
The attached plat discusses maintenance on sheet 1 under the heading of Private Drainage
Easement.
A copy of the Hearing Examiner's report dated January 16,2001, is attached for reference and

Bob Mac Onie and I have reviewed the above referenced final plat submittal and have the
following comments:
Comments for the Applicant:
The City of Renton land use action number, noted on said submittal, should be revised to LUA-
04-0 19-FP. Also, remove the "SHPL" which is shown after the land use action number. This is
not a short plat subdivision.
Is there to be a utility easement to the City of Renton, Puget Sound Energy, QWEST
Communications, COMCAST, etc. for utility facilities? Are said facilities to be in the dedicated
right of way? If not, see the attachment for an example of language required for said easement on
the plat drawing -modify as needed. Is the 15' utilities easement shown over the westerly 15' of
Lots 1 through 7, over the northerly 15' of Lot 7 and the 20' utilities easement over Lots 11 and 8
noted for said public and private utilities? If said easement is not yet shown, note it now (if not in
street right of way).
Currently, most of said easements shown on the latest plat submittal are not noted as either public
or private, or new (if that is the case). Provide language on the drawing stating whether said
easements are public or private (or both) and who benefits from the easements.
Complete City of Renton Monument Cards, with reference points of all new right of way
monuments set as part of the plat, if any.
An approval block for the City of Renton Finance Director needs to be added to Sheet 10f 2.

The Pacific Northwest Title Company FIRST AMENDED PLAT CERTIFICATE, Title Order
No. 412497 and dated February 12, 2004, states that the subject property is vested in JIM
JACQUES CONSRUCnON, LLC. The first title report, dated September 1,2000, notes the
vested owner as James H. Jacques, as his separate estate. Revise the ownership signature line
under the "DECLARA nON" block as needed.
Note that the plat property falls within Zone ~ of the City of Renton Aquifer Protection Area
(Sheet 1 of 2).
The private access easement requires a "NEW PRIV A TE EASEMENT FOR INGRESS,
EGRESS & UTILITIES MAINTENANCE AGREEMENT" block. See the attachment.
The retaining wall noted to the east of the subject plat property is not pertinent to the plat and
should be removed from the drawing.
Note discrepancies between bearings and distances of record and those measured or calculated, if
any.
The "ACCESS EASEMENT' AND "PRN ATE DRAINAGE EASEMENT" blocks, noted on
Sheet 1 of 2, infer that there is a private drainage easement located somewhere on said plat.
Currently, the only drainage easement noted is labeled "PUBLIC". Review and revise as needed.

Dear Development Services Staff:
This letter outlines the compliance with the conditions of approval for the Jacques 24th
ST Plat LUAOO-127, PP
1. All mitigation fees will be paid when Mylars are submitted.
2. The final plat improvements are being installed at this time and will be completed
soon.
3. The Mitigation measures contained in the Determination of Non-Significance have
been completed with the exception of the Mitigation fees which will be paid with the
submittal of the Mylars.
4. The maintenance agreement required by condition #2 of the Hearing Examiners
approval is shown on sheet 1 of 2 of the Final Plat. .
5. Conditions #3and #4 has been complied with during construction of the plat
improvements.
Please review the plat for the final recording of the short plat. If there are any questions
please give me a call at 360-422-5056.
