The applicant is requesting an administrative setback variance from the
20-foot front yard setback required in the Residential -8 dwelling units per
acre (R-8) zoning designation. The proposed variance would allow the
existing single-family residence to remain in its current location and make
it possible to subdivide the existing parcel into two lots. The proposed
Skywire Short Plat (LUA-04-023-SHPL-A) would reconfigure the lot that
the existing hOLlse is proposed to remain on so that the 14.86-foot setback
that was previously the side-yard-along-a-street would be the front yard.
Therefore, the applicant is requesting to allow a 14.86-foot front yard
where 20 feet is required in order to keep the existing hOLlse in its current
location and allow for the proposed two-lot subdivision (LUA-04-023) to
proceed.

C. Project Description / Background:
The applicants, Troy and Debbie Anderson, are requesting an administrative variance from
the required front yard setback of the R-8 zone found in Renton Municipal Code (RMC)
Section 4-2-11 OA. According to King County Assessor record, the property located at 2906
NE 5 th Place is currently developed with an approximately 1,090 square foot single-family
residence that was built in 1943. The existing house is located 14.86 feet from the southern
property line along NE 5th Place.
The applicants have applied for a short plat on the subject property. The proposed
configuration of the two-lot short plat changes the existing 14.86-foot setback for the existing
house from a side-yard-along-a-street setback to a front yard setback. Development
standards of the R-8 zone require a minimum s ide-yard-along-a-street setback 0 f 1 5 feet
and a front yard setback of 20 feet.
In order to proceed with the proposed two-lot short plat, the applicants are requesting
administrative approval of a setback variance to allow an existing non-conforming 14.86-foot
side-yard-along-a-street setback to become a non-conforming front yard setback.

FINDINGS, CONCLUSIONS & DECISION
Having reviewed the written record in the matter, the City now makes and enters the
following:
D. Findings
1) Request: The applicants, Troy and Debbie Anderson. have requested approval for
an administrative variance from the required 20-foot front yard setback of the R-8
zone (RMC 4-2-11 OA) for the property located at 2906 NE 5111 Place. Approval of a
14.86-foot front yard setback is requested.
2) Administrative Variance: The applicants' administrative variance submittal
materials comply with the requirements necessary to process a variance. Relevant
submittal items are attached to this report.
3) EXisting Land Use: Land uses surrounding the subject site include: North: single-
and multi-family residential, zoned R-10; South: NE 5111 Place right-of-way and single-
family residential. zoned R-8; East: single-family residential zone R-8 and R-10; and
West: Index Avenue NE right-of-way and single-family residential, zoned R-8.
4) Zoning: The site is located in the Residential - 8 (R-8) dwelling units per acre zone.
The development standards for this zone require a 20-foot front and rear yard
setbacks and 5-foot interior side yard setbacks.
5) Lot and Building Size: According to King County Assessor records, the site is
approximately 11,328 square feet and contains an approximately 1,090 square foot
single-family residence.
5) Consistency with Variance Criteria: RMC Section 4-9-250B.5.a. lists 4 criteria that
the Zoning Administrator is asked to consider, along with all other relevant
information, in making a decision on an Administrative Variance application. The
Zoning Administrator shall have authority to grant an administrative variance upon
making a determination, in writing, that the conditions specified below have been
found to exist:

a. That the applicant suffers undue hardship and the variance Is necessary
because of special circumstances applicable to subject property, including
size, shape, topography, location or surroundings of the subject property,
and the strict application of the Zoning Code is found to deprive subject
property owner of rights and privileges enjoyed by other property owners in
the vicinity and under Identical zone classification.
The existing dwelling was constructed in 1943, prior to the implementation and
enforcement of current setback regulations. Moving the structure to a location that
would conform to the setback requirements of the R-8 zone or demolishing the
existing house in order to rebuild a new house meeting setbacks would place an
undue and unnecessary hardship on the property owner. The strict enforcement of
the Zoning Code would deprive the subject property owners of the privilege to
subdivide that other property owners in the vicinity under the identical zoning
classification would enjoy.
b. That the granting of the variance will not be materially detrimental to the
public welfare or Injurious to the property or Improvements in the vicinity and
zone In which subject property Is situated.

The granting of the variance would not be materially detrimental to the public
welfare. The existing single-family house has been in its current location since
1943. The impact of the dwelling on the property and improvements in the vicinity
has been established for over 60 years. No additional adverse impacts are
anticipated in association with the granting of a variance.
c. That approval shall not constitute a grant of special privilege
inconsistent with the limitation upon uses of other properties in the vicinity
and zone in which the subject property is situated.
Approval of the variance would not provide an exception from zoning standards that
would be unlikely to be approved for other similarly developed properties under the
same zoning designation. The approval of this variance request would not result in
more non-conforming yards than currently exist. The currently non-conforming
14.86-foot setback would simply change from a side-yard-along-a-street to a front
yard. The approval of the requested variance would allow the legal non-conforming
structure to remain in its current location and allow the proposed two-lot Skywire
Short Plat (LUA-04-023, SHPL-A) to proceed.
d. That the approval as determined by the Zoning Administrator is a
minimum variance that will accomplish the desired purpose.
The approval of the proposal is the minimum variance necessary that would
accomplish the desired purpose for the existing house and proposed short plat.
The variance being requested is for the exact distance from the south property line
to the existing dwelling, as measured by Darrell L. Offe, Washington State
Professional Engineer.
E. Conclusions
1) The subject site is located at 2906 NE 5111 Place, within the Residential - 8
Dwelling Units per Acre (R-8) zoning designation.
2) The R-8 zone requires a minimum 20-foot front yard setback, pursuant to RMC 4-
2-110A. The applicant is proposing to re-orient the lot on which the existing
house is located to change an existing side-yard-along-a-street setback to a front
yard setback.
3) The approval of this variance would result in a 14.86-foot front yard setback
where a 20-foot front yard setback is required.
4) The requested variance complies with the variance criteria as found in RMC
Section 4-9-250B.5.a and discussed in this report.
F. Decision
The Administrative Setback Variance for the Skywire Setback Variance, File No. LUA-
04-042, V-A, is approved.

Land Use Decision Appeal Process: Appeals of the land use decision must be filed in
writing on or before 5:00 PM May 19, 2004. If no appeals are filed by this date, the action
will become final. Appeals must be filed in writing together with the required $75.00
application fee with: Hearing Examiner, City of Renton, 1055 South Grady Way, Renton, WA
98055. City of Renton Municipal Code Section 4-8-11 O.E governs appeals to the Examiner.
Additional information regarding the appeal process may be obtained from the Renton City
Clerk's Office, (425) 430-6510.
The Appearance of Fairness Doctrine: provides that no ex parte (private one-on-one)
communications may occur concerning the land use decision. The Doctrine applies not only
to the initial decision, but to Appeals to the Hearing Examiner as well. All communications
after the decision/approval date must be made in writing through the Hearing Examiner. All
communications are public record and this permits all interested parties to know the contents
of the communication and would allow them to openly rebut the evidence in writing. Any
violation of this doctrine could result in the invalidation of the appeal by the Court.

Project Narrative:
Skywire Properties Short Plat
2906 NE 5th Place
Renton
The Skywlre Properties Short Plat Is a subdivision of lot 7 of Block 23 of the plat of Renton Highlands
No. 2 Into two Individual building lots. The existing house on the property (2906 NE 5th Place) would
remain. The current parcells 13,394 square feet; the proposed lots would consist of 8,514 square
feet for the existing house and 4,880 square feet for the new lot. The current zoning of the parcells
R8. The property currently has street Improvements along the frontage of NE 5th Place and along
Index Avenue NE.
The site currently has a gravel surfaced driveway and parking area along all sides of the existing
house. Currently drainage from the site flows over the property to NE 5th Place and then Into the
street drainage system; conSisting of catch basins and conveyance pipes. The existing house roof
drainage flows through downspout lines and splashes onto the ground. The drainage flows overland
to the street. The low point of the project is at a catch basin within Index Avenue at the Intersection
with NE 5th Place. The proposed new house would be conveyed to the street catch basin via a new 4"
drainage pipe. The new development would generate less PGIS (pollution generating Impervious
surface) since the existing driveway would be converted Into a house and covered garage. The
proposed exposed driveway surface would be less than the existing Impervious surfaces prior to
redevelopment.
The current property has no significant trees as defined by City code. As such, no trees would be
removed to provide the new development.
A frontage improvement waiver would be requested to defer any necessary construction within the
right-of-way. An approved waiver would defer the frontage improvements until a time the City saw-fit
to Improve the entire neighborhood.
If the waiver were granted, the total construction necessary to create the new lot would be minimal.
The proposed services would be Installed at the time of the building pertilit of the new house. The
water service would be Installed by the City of Renton under a water permit; the side sewer would Qe
Installed at the same time as the storm stub. These Improvements would cost approximately $3,500.
Construction Mltlgatl~n:
The project Is located within a developed neighborhood. The existing parcells a cOrner lot on NE 5th
Street and Index Avenue NE. There are no antiCipated Improvements or construction proposed to
create the short plat. Normal home building construction will follow the recording of the short plat.
The utility services will be installed as part of the home building permits.

#4 -Justification for the Variance Request
The applicant suffers undue hardship and the variance Is necessary because of special
circumstances applicable to subject property, Including size, shape, topography, and location or
surroundings of the subject property; and the strict application of the Bul/dlng & Zoning Code Is
found to deprive subject property owner rights and privileges enjoyed by other property owners In
the vicinity and under Identical classification.
• City position is existing house fronts Index; therefore needs to have 15' as side yard from NE 5th
Place.
Currently, the existing house appears to be non-conforming in that it is 14.86' from NE 5th
Place
Neighbor to the south enjoyed same opportunity to short plat -Sierra Homes;
Lot to the north is zoned R-10; it appears this lot and lot to the south are smaller than subject
lot, yet afforded multiple dwellings.
The granting of the variance will not be materially detrimental to the public welfare or Injurious to
the property or Improvements In the vicinity and zone In which subject property is situated.

Existing house and garage are accessed and addressed off of NE 5th Place (see
pictures). Further, the front door points towards NE 5th Place. Therefore, It appears
existing house Is non-conformlng by 5.14' (20' front yard set back). Our feeling Is that
the proposed short plat will not change or Impact the existing house's non
conformance.
Approval shall not constitute a grant of special privilege Inconsistent with the limitation upon
uses of other properties In the vicinity and zone In which the subject property Is situated.
• There is an existing walkway along the Index side of the existing house; if over four feet high;
then needs to be more set back towards the proposed new lot line.
Distance between back of sidewalk and comer of existing house is 24.5 feet; this is one of
the largest front yards in the neighborhood. The proposed short plat will not affect this
dimension. For new subdivisions in the City of Renton, the required distance between house
(not garage) and back of sidewalk is 12 feet -front yard set back. Footnote: Other projects in
the City of Renton (new lots) allow a house into the front yard set back but not garage.
The approval, as determined by the Reviewing OfficIal, Is the mInimum variance that will
accomplish the desired purpose.
Removing 5' of the existing house benefits NO one in the neighborhood;
Alternative Option -vacate over sized right-of-way by 5' putting it onto the lot for a 20' front yard set
