Project Description: Special Fence Permit for existing six-foot high fence along Union Avenue NE.
The applicant has erected a six-foot high fence along Union Avenue NE. The property owner was
notified after the fence was constructed that the fence did not meet code unless a Special
Administrative Fence Permit was issued. As a result of the code enforcement action, the applicant
has elected to apply for a Special Administrative Fence Permit in order to keep the existing fence.
In addition, the applicant is proposing to place approximately two to five feet of landscaping in
front of the fence.

Project Description: The applicant is requesting approval to allow a six-foot high wooden fence
to remain within the side yard along the street (Union Avenue NE) setback of the subject site.
The fence was constructed adjacent to the western property boundary and approximately two to
five feet from the existing sidewalk in Union Avenue NE.
The applicant has included a site plan and elevation, which includes varied landscaping along
the front of the fence. As a result of the fence location from the sidewalk and proposed
landscaping plan, the Special Administrative Fence Permit is approved subject to one condition.

Decision: The subject fence has been designed to include vegetation along the front of the
fence, which provides relief from being a vast blank wall along the public walkway. In addition,
the fence would not be located within the clear vision area of NE 2nd Street and Union Avenue
NE, which alleviates site distance concerns. As such, the fence is approved subject to the
following condition:
Conditions of Approval:
1. The applicant shall be required to call for a final fence inspection prior to final sign off.
The fence shall be required to match the proposed fence site plan and elevation
dated April 30, 2004. This condition shall be subject to the review and approval of the
City of Renton's Development Services Division.
Advisory note: If any of the above-listed conditions cannot be achieved, the applicant can
limit the height of the fence to four feet above the sidewalk grade in its current location or
remove the fence entirely.

I have received notification that the existing fence built along the perimeter of my
property is violating a maximum four-foot rule in height and is also an obstruction to
traffic.
Although the newly built fence is higher than four feet, it is not an obstruction to traffic in
any way. The letter states that the fence must be 20 feet away from the curb for drivers
and pedestrians to have a clear view of any dangerous oncoming traffic. The fence is 33
feet away from the curb and in no way is an obstruction to traffic, but instead gives a
clear view to all that pass on the comer of 2nd NE Place and Union Avenue NE.
All citizens have a right to privacy. If we are not able to keep our fence standing it will
violate our rights as property owners to be able to maintain a strong sense of privacy.
Our new home is located along Union Avenue NE where there exists a heavy traffic ~ow
during all hours of the day. Without the fence our property is vulnerable and open to
everyone that passes. It also heightens our concern for privacy because a bus stop is
located literally a couple steps away from our back yard. It would only make sense to
keep our existing fence to deter any unwanted behavior such as littering, vandalism, pet
feces, and nosy passersby.
The existing fence is made out of quality cedar while plans of landscaping to beautify and
compliment the fence are still being planned.
It is very important that my family can enjoy our right to privacy like any other citizens
and should be allowed to maintain our fence.
