C. Project Description / Background:
The applicant, Cambridge Homes, is requesting approval of an administrative variance from
the required side yard along a street setback in the R-8 zone (section 4-2-11 OA). The subject
site is located at 1820 NE 38th Street. The project site is located near the corner of Lincoln
Place NE, Lincoln Avenue NE and NE 38th Street.
The subject site was approved for a six lot short plat on November 12, 2002. As a result of
that short plat approval, access to the proposed lot was required from Lincoln Place NEiNE
38th Street; however, that street only contains a 20-foot paved (emergency access) surface
within a 60-foot right-of-way.
The development standards of the R-8 zone require a minimum side yard along a street
setback of 15 feet. The setback is measured from the property line to the closest point of the
structure. The applicant is proposing a reduction of this setback to 11 feet in order to
construct a suitable single-family residence within the lot.
The variance proposal would maintain the required 20-foot front and rear yard setbacks and
the interior five-foot side yard setback. However, as the lot is limited in depth due to a steep
slope setback the applicant is requesting an Administrative Variance in order to encroach
into the side yard along the street setback. It should also be noted that Lincoln Place NE/NE
38th Street is a 60-foot right-of-way but is only utilized as a 20-foot emergency access.
Therefore, the setback looks much larger as the majority of the adjacent right-of-way is
undeveloped.
The proposal meets the all other R-8 development standards including: maximum building
height, lot coverage, and front, rear and interior side yard setbacks.

Having reviewed the written record in the matter, the City now makes and enters the
following:
D. Findings
1) Request: The applicant, Cambridge Homes, has requested approval for an
administrative variance from the required 15-foot side yard along a street setback in
the R-8 zone (section 4-2-11 OA) for the property located at 1820 N E 38th Street. An
11-foot side yard along a street setback is being requested.
2) Administrative Variance: The applicant's administrative variance submittal materials
comply with the requirements necessary to process a variance. The applicant's site
plan and other project drawings are entered as Exhibits No.1 through 3.
3) EXisting Land Use: Land uses surrounding the subject site include: North: single-
family residential; South: single-family residential; East single-family residential; and
West: ravine, zoned for single-family residential.
4) Zoning: The site is located in the Residential - 8 (R-8) dwelling units per acre zone.
The development standards for this zone require a 20-foot front and rear yard
setback, 5-foot interior side yard setback, and a 15-foot side yard along a street
setback. Maximum lot coverage is 35 percent or 2,500 square feet, which ever is
greater.
5) Topography: The topography of the site is generally flat with a gradual slope to the
west. Approximately 115 feet from the eastern property boundary the site severely
slopes down to a ravine (west).
6) Lot and Building Size: The site (Lot 6 of the Elsa Ridge Short Plat) is 12,921 square
feet. The proposed single-family home totals 2,936 square feet and is approximately
1,692 square feet on the first floor, which results in a building lot coverage of
approximately 13%.
7) CONSISTENCY WITH VARIANCE CRITERIA
Section 4-9-2508.5.a. Lists 4 criteria that the Zoning Administrator is asked to
consider, along with all other relevant information, in making a decision on an
Administrative Variance application. These include the following:
The Zoning Administrator shall have authority to grant an administrative variance
upon making a determination, in writing, that the conditions specified below have
been found to exist:
a. That the applicant suffers undue hardship and the variance is necessary
because of special circumstances applicable to subject property, including
size, shape, topography, location or surroundings of the subject property,
and the strict application of the Zoning Code is found to deprive subject
property owner of rights and privileges enjoyed by other property owners in
the vicinity and under identical zone classification:
The applicant contends that special circumstances apply to the subject site, which
impose limitations on the lot. Specifically, the applicant indicates that the property
is constrained by a 45-foot building setback from the top of a native ravine located
west of the proposed residence, which ultimately slopes down to May Creek. The
45-foot slope setback, in addition to the 20-foot front yard setback, limits the

available building lot depth. Therefore, the applicant is requesting to encroach the
side yard along a street setback by four feet, in order to make the building slightly
wider than what the code allows. In this case, the hardship is the constrained lot
depth due to the steep slope setback (45 feet from the top of the slope), which
ultimately constrains the building depth.
Access to the proposed single-family residence is from Lincoln Place NElNE38th
Street. While the City has a full 60-foot right-of-way width, only 20 feet of the street
is being utilized for vehicular and emergency access. As a result, the reduction in
the side yard along the street setback will seem insignificant as the actual paved
portion of the right-of-way is located over 20 feet from the edge of the proposed
single-family residence.
b. That the granting of the variance will not be materially detrimental to the
public welfare or injurious to the property or improvements in the vicinity and
zone in which subject property is situated:
The applicant contends that the street will never be fully developed and further
development to the west is unlikely because of the native ravine in the area. As a
result, with the four-foot encroachment, the proposed single-family residence will
appear to be located over 20-feet from the paved portion of the street. Therefore,
the granting of the variance would not be materially detrimental to the public
welfare. Staff anticipates the proposed single-family residence would enhance the
site by adding a new structure to a vacant lot.
c. That approval shall not constitute a grant of special privilege inconsistent
with the limitation upon uses of other properties in the vicinity and zone in
which the subject property is situated:
The applicant contends that approval does not constitute a special privilege since
there is over 20 feet of land between the proposed single-family residence
fayade/foundation and the paved portion of Lincoln Place NEINE 38th Street. The
construction of the proposed single-family residence would maintain the
appearance of a standard side yard along a street setback as it would be located
ap~roximately 20 feet from the edge of pavement of curb of Lincoln Place NEINE
38 h Street. Furthermore, all other pertinent R-8 development standards, including
lot coverage and building height would be met as a result of this proposal.
d. That the approval as determined by the Zoning Administrator is a minimum
variance that will accomplish the desired purpose:
The applicant contends that the request is a minimum variance needed in order to
construct a new single-family residence, which would emulate other existing homes
constructed within the same development. By locating the single-family residence
four feet closer to the side property line, the structure would then be located 11 feet
away from the property boundary and provide enough width to accomplish the
desired purpose. Therefore, the variance request is the minimum necessary, as
determined by the applicant and City staff.,
E. Conclusions
1. The subject site is located at 1820 NE 38th Street, within the Residential - 8 Dwelling
Units per Acre (R-8) zoning designation.
2. The R-8 zone requires a minimum 15-foot front side yard along a street setback from
the property boundary (section 4-2-110A). The applicant is proposing a four-foot
reduction of this requirement to 11 feet.

The administrative land use decision will become final if the decision is not appealed within 14 days of the date of
approval. An appeal of the decision must be filed within the 14 day appeal period (RCW 43.21.C.075(3); WAC
197-11-680). An appeal to the Hearing Examiner is governed by Title IV, Section 4-8-11.8, which requires that
such appeals be filed directly with the Hearing Examiner via the City of Renton City Clerks Office. Appeals must
be made in writing on or before 5:00 PM on September 3, 2004. Any appeal must be accompanied by a
$75.00 fee and other specific requirements.
THE APPEARANCE OF FAIRNESS DOCTRINE provides that no ex parte (private one-on-one) communications
may occur concerning the land use decision. The Doctrine applies not only to the initial deCision, but to Appeals
to the Hearing Examiner as well. All communications after the decision/approval date must be made in writing
through the Hearing Examiner. All communications are public record and this permits all interested parties to
know the contents of the communication and would allow them to openly rebut the evidence in writing. Any
violation of this doctrine could result in the invalidation of the appeal by the Court.

I'm curious why a variance is necessary. I assume the developer measured the
property prior to drawing up plans for subdividing the lot and I also assume that
he was aware of the 15-foot side yard required~by the City:of Renton. It seems to
me that any discrepancies in the developer's plans should have been taken into
account when he applied for land use permits;:' I think that the City of Renton
should enforce the zoning regulations which ,they established for the R-8 zoning
regulation.

I would like to go on record as opposing the requested administrative variance. As you indicate,
the IS-foot side yard is a required factor determined by the city's R-8 zoning designation. It was
established at the time the applicant applied for their land use pem1its. The applicant was fully
, aware of all the regulation prior to construction. Therefore the city should not be granting
variances just to satisfy the needs of a builder. The city needs to keep builders in strict
enforcement of the regulations and be responsible for enforcing the zoning regulations that have
been established. .

The proposal is to construct a Northwest Architects' single-family residence house plan #M3S55A3Ff-2 on
Lot 6 of the short plat of Elsa Ridge located at 1820 NE 38th Street, Renton. Lot 6 is 12,921 square feet
having a proposed building footprint of 2,936 square feet. A pre-sale of this plan and lot are pending the
approval of the reduced setback. '
Permits required: Administrative Variance, Building Permit
Zoning designation: The property is zoned Single Family Residential R-8. The surrounding area is zoned
single-family residential. Further to the North along NE 40th is multi-family zoning.
Current Use: Single family residential under construction
Special features: A 40% steep slope·exists along the Westerly side of the lot.
Soli Type/Drainage: The site is underlined with fine to medium sands to depths of 16 feet and greater.
The drainage design for the short plat prepared by Peterson Engineers utilizes infiltration dry wells for the
proposed houses, walks, and driveways.

Lot 6 is subject to this administrative variance request. The lot is proposed for single-family detached
residence. To be able to accommodate the proposed house footprint, a variance is request to reduce the
side yard setback from a street from 15' to 11'-1".
Access: Access to the lot is proposed off of the access tract created during the construction of the short'
plat. Direct access from Lincoln Place (NE 38th Street) was not allowed as part of the short plat.

Total estimated cost / Fair market value: Estimated cost $510,000; Market value $590,000
Estimated quantities: Approximately 110 cubic yards of material will be moved on site to provide for the
foundation of the house. This material is planned to remain on site for backfill and landscaping. \ '
Trees removed: No trees are proposed to be removed during the construction of the house. Tree clearing
and site grading were performed during the construction of the short plat improvements.
Dedication to the City: No land is proposed to be dedicated under the building permit.
Proposed size, number and range: The lot is 12,921 square feet, no further subdivision is proposed.
Job shacks, sales trailers, and model home:' Lot 1 of the short plat will be used as the model home for
the project.

ELSA RIDGE LOT 6
1820 NE 38th Street
JUSTIFICATION FOR VARIANCE REQUEST
This variance is to request the reduction from 15' to 11' along the building setback on Lincoln Place
NE (NE 38th Street). The Code requires a 15' side yard along a road.
The Elsa Ridge Short Plat (LUA-02-086) abuts Lincoln Avenue NE to the East and Lincoln Place NE (NE
38th Street) to the South. Along the Westerly side of the property is a 40% and greater slope. The
short plat was conditioned to NOT allow direct access from the lots onto Lincoln Avenue or Lincoln
Place. Access was required to be from private access tracts. Therefore the access into Lot 6 is off of
an access tract serving Lot 6 and Lot 5. During the staff review and public hearing for the short plat,
there was discussion of vacating Lincoln Plate NE. The City Staff required the right-of-way to remain
to allow for loop access to Jones Avenue NE. The existing roadbed along Lincoln Place is 16' of gravel
that meanders within the 60' right-of-way. The road is used by primarily by one adjoining property
owner, emergency access to Jones Ave, and Lots 5 and 6 of Elsa Ridge. There is minimal traffic along
this section of road.
The building envelope for Lot 6 is constrained by a 45' setback from the top of the 40% slope on the
West, required access from a private access tract to the East, and adjoins Lincoln Place NE (NE 38th
Street) to the South. The lot is recorded as 195' long by 66' wide; however based upon the physical
and required constraints; the building envelope is only 55' deep by 46' wide. These physical and
required constraints lend to an undue hardship on the property owner, Cambridge Homes. The house
plan for Lot 6 is 50' wide. The other lots within the short plat allow for larger building envelopes.
Within the surrounding area it has been noted that resent property owners have been given the
privilege of a reduced side yard setback from a road. The addresses of these properties are as
