c. Project Description / Background:
The applicants, Marc and Karen Pritchard, are requesting approval of an administrative
variance from the required front yard setback in the R-8 zone (section 4-2-110A). The
subject site is located at 2807 Mountain View Avenue N. The project site is abutting Lake
Washington to the west and Mountain View Avenue N and the Northern Pacific Railroad
right-of-way to the east.
The site is 13,162 square feet in area, however the majority of the site is covered by water.
Approximately 2,205 square feet of land is above the high water line. An additional 25-foot
setback from the Ordinary High Water Mark is required under the Shoreline Regulations. As
a result, the site has 939 square feet of buildable area.
The existing single-family residence is a one-story 440 square foot cottage. The structure
currently appears to be non-conforming with regards to front, side and rear setbacks. The
existing front setback is approximately 15 feet. This structure is proposed to be removed in
order to construct a new single-family residence.
The development standards of the R-8 zone require a minimum front yard setback of 20
feet. The setback is measured from the property line to the closest point of the structure.
The applicant is proposing a reduction of this setback to zero feet in order to construct a
2,259 square foot (1,975 sq ft with 284 sq ft attached garage) single-family residence within
the lot. The actual footprint of the proposed residence is 827 square feet.
The variance proposal would meet the required interior five-foot side yard setbacks. In order
to comply with the required 25-foot setback from the Ordinary High Water Mark (OHWM)
and retain an acceptable buildable area for a new residence the applicant is requesting an
Administrative Variance in order to encroach into the front yard setback. Due to the limited
depth of the lot, the applicant wishes to place the new structure at a zero front yard setback.
The applicant's proposed plans show front porch steps and front roof overhang encroaching
into unimproved right-of-way along the front property boundary. The applicant will be

condition of approval that the applicant's plans must be revised to remove any encroachment
outside of the property boundary.
The proposal meets all other R-8 development standards including: maximum building
height, lot coverage, rear and interior side yard setbacks as well as required 25-foot setback
from the OHWM.
FINDINGS, CONCLUSIONS & DECISION
Having reviewed the written record in the matter, the City now makes and enters the
following:
D. Findings
1) Request: The applicant, Marc and Karen Pritchard, has requested approval for an
administrative variance from the required 20-foot front yard setback in the R-8 zone
(section 4-2-110A) for the property located at 2807 Mountain View Avenue N. A zero
fobt front yard setback is being requested.
2) Administrative Variance: The applicant's administrative variance submittal materials
comply with the requirements necessary to process a variance. The applicant's site
plan and other project drawings are entered as Exhibits No. 1 through 5.
3) Existing Land Use: Land uses surrounding the subject site include: North: single-
family residential; South: single-family residential; East: Mountain View Avenue Nand
the Northern Pacific Railroad right-of-ways; and West: Lake Washington.
4) Zoning: The site is located in the Residential - 8 (R-8) dwelling units per acre zone.
The development standards for this zone require a 20-foot front and rear yard
setback, 5-foot interior side yard setback, and a 15-foot side yard along a street
setback. Maximum lot coverage is 35 percent or 2,500 square feet, which ever is
greater.
5) Topography: The topography of the site has a gradual downward slope from the
northeast to the southwest of approximately 20%.
6) Lot and Building Size: The site is 13,162 square feet. The land area out of the high
water line is approximately 2,205 square feet. The proposed single-family residence
totals 2,259 square feet with a footprint of approximately 827 square feet on the first
floor. Therefore, building lot coverage for this site is approximately 38%(827/2,205 =
38), which is typical for this neighborhood. .
7) Encroachment: The proposed new single-family structure shows the front porch
stairs encroaching over the front property boundary approximately 5 feet. The roof
overhang is also encroaching over the front property line into the public right-of-way.
The plans are to be revised to remove these encroachments.
8) EXisting Structure: The existing one-story 440 square foot single-family structure is
to be removed in order to construct the new two-story 2,259 square foot single-family
residence.
9) Consistency With Variance Criteria:
Section 4-9-2508.5.a. Lists 4 criteria that the Zoning Administrator is asked to
consider, along with aI/ other relevant information, in making a decision on an
Administrative Variance application. These include the fol/owing:

The Zoning Administrator shall have authority to grant an administrative variance upon
making a determination, in writing, that the conditions specified below have been
found to exist:
a. That the applicant suffers undue hardship and the variance is necessary
because of special circumstances applicable to subject property, including
size, shape, topography, location or surroundings of the subject property,
and the strict application of the Zoning Code is found to deprive subject
property owner of rights and privileges enjoyed by other property owners in
the vicinity and under identical zone classification:
The applicant contends that special circumstances apply to the subject site, which
impose limitations on the lot. Specifically, the applicant indicates that the property
is constrained by the 25-foot Shoreline Regulation setback from the Ordinary High
Water Mark (OHWM) on Lake Washington. Therefore, the applicant is requesting
to encroach into the front yard setback by 20 feet, in order to have a building
. footprint of 827 square feet and meet the required interior side setbacks. 'In this
case, the hardship is the constrained lot depth due to the Shoreline Regulation
setback (25 feet from the OHWM), which ultimately constrains the buildin~ depth.
The lots in this area along Mountain View Avenue N located in C. D. Hillman's
subdivision are partially covered by water. The actual usable land area of the
subject lot is 2,205 square feet, or 17% (from the High Water Mark) of the lot
2,205/13,162 = 0.17).
b. That the granting of the variance will not be materially detrimental to the
public welfare or injurious to the property or improvements in the vicinity and
zone in which subject property is situated: .
The applicant contends that. the proposed residence will be consistent with the.
neighborhood and will not impede or damage access to adjoining properties. One
letter was received from a neighbor voicing concern but not objection to the project
and its impact on traffic and pc;lrking. This neighborhood has limited parking and is
accessed by 20-foot wide Mountain View Avenue N. Staff does not anticipate the
proposal to increase traffic fiow congestion or parking, as it is to remain the same
use as currently. The single-family residence will cause no increase of required
parking and has an attached one-car garage. The estimated value of the proposed
residence will be $159,000 to $200,000. The applicant is aware no encroachments
will be permitted into the right-of-way and will have the plans revised prior to
application of building permit. Therefore, the granting of the variance would not be
materially detrimental to the public welfare. Staff anticipates the proposed new
single-family residence would enhance the site by replacing a one-story cottage
valued at $8,000.
c. That approval shall not constitute a grant of special privilege inconsistent
with the limitation upon uses of other properties in the vicinity and zone in
which the SUbject property is situated:

The applicant contends that approval does not constitute a special privilege since
there have been front setback variances granted for adjacent properties. The zero
front yard setback that is requested is relative to the actual size of the usable land.
Furthermore, all other pertinent R-8 development standards, including lot coverage
and building height would be met as a result of this proposal.

d. That the approval as determined by the Zoning Administrator is a minimum
variance that will accomplish the desired purpose:
The applicant contends that the request is a minimum variance needed in order to
construct a new single-family residence, which would emulate other existing homes
constructed within the same development. The proposed house dimensions are
29'6" wide by 27'6" deep. By locating the single-family residence at the front
property line, with zero setback, a modest structure would be allowed with a one-
car garage and meet the 25-foot rear setback to the Ordinary High Water Mark.
Therefore, the variance request is the minimum necessary, as determined by the
applicant and City staff.
E. Conclusions
1. The subject site is located at 2807 Mountain view Avenue N, within the Residential -
.8 Dwelling Units per Acre (R-8) zoning designation.
2. The R-8 zone requires a minimum 20-foot front yard setback from the property
boundary (section 4-2-11 OA). The applicant is proposing a 20-foot reduction of this
requirement to zero feet.
3. The analysis of the proposal according to variance criteria is found in the body of the
Staff Report.
4. One letter was received which voiced concern that the approval of the variance will
further worsen the traffi~ and parking conditions in the area. The letter did not state
objection to the request. .
F. Decision
The Administrative Setback Variance for Pritchard Variance, File No. LUA-04-099, V-A,
SME is approved with the following condition:
1. The applicant shall revise the site plan and building plans to remove any
encroachments along the front property line prior to the issuance of the building
permit. .

The administrative land use decision will become final if the decision is not appealed within 14 days of the date of
approval. An appeal of the decision must be filed within the 14 day appeal period (RCW 43.21.C.075(3); WAC
197-11-680). An appeal to the Hearing Examiner is governed by Title IV, Section 4-8-11.8, which requires that
such appeals be filed directly with the Hearing Examiner via the City of Renton City Clerks Office. Appeals must
be made in writing on or before 5:00 PM on October 5, 2004. Any appeal must be accompanied by a $75.00
fee and other specific requirements.
THE APPEARANCE OF FAIRNESS DOCTRINE provides that no ex parte (private one-on-one) communications
may occur concerning the land use decision. The Doctrine applies not only to the initial decision, but to Appeals
to the Hearing Examiner as well. All communications after the decision/approval date must be made in writing
through the Hearing Examiner. All communications are public record and this permits all interested parties to
know the contents of the communication and would allow them to openly rebut the evidence in writing. Any
violation of this doctrine could result in the invalidation of the appeal by the Court.

The following Utility and Transportation comments concern the Environmental (SEPA) review
for the new single-family residence.
EXISTING CONDITIONS
WATER -This project site is located in the 320 Water Pressure Zone. The static water pressure
at the street level is approximately 130psi. There is an existing 6" water main located in
Lake Washington Blvd .. The site is outside the Aquifer Protection Area.
SEWER -There is an existing 8-inch sewer main in the Lake Washington Shoreline.
SURFACE WATER -The site drains to Lake Washington directly.
STREETS -This site fronts on Mountain View Ave N. This is a sub-standard street (no curb,
gutter or sidewalks).
CODE REQUIREMENTS and RECOMENDATIONS
1. No drainage improvements are required with this proposal.
2. The steps shown on the plot plan for the new SFR are encroaching on the City Right
of Way. This encroachment is not allowed. In addition, any sub-surface building
footings may not encroach within the right-of-way.
3. It is recommended that the existing side-sewer be replaced on the up-land side (or to
land-side of the bulkhead).
4. Pressure Reducing Valves (PRVs) are required on the existing or new water service
line.
CONDITIONS
1. Temporary Erosion Control shall be installed and maintained in accordance with the
Department of Ecology Standards and staff review.

Dear Ms. Weil,
We are writing this letter to express our concerns regarding the requested front yard
setback variance at 2807 Mountain View Ave N.
We have two basic concerns about the reduction in the required front yard setback at this
location.
Our first concern is safety of auto traffic and pedestrian traffic on Mt View Ave. We are
concerned that limited sight distance at the site and the closeness of the garage entrance
to Mt. View Ave. will create a safety hazard for both cars and pedestrians exiting the
residence and cars and pedestrians on Mt. View Ave.
Our second concern is the lack of onsite parking when the structure is placed so close to
the street. Parking on Mt. View Ave. is generally in short supply. Without a driveway to
accommodate additional vehicle parking it is likely that all visitors to the residence will
be forced to park throughout the neighborhood. These additional parked vehicles could
impact access to the driveways of neighboring properties and will definitely reduce the
overflow parking available for the preexisting residences. We are concerned that granting
this variance will further worsen the already difficult parking situation in our area of
Mountain View Ave. and create a hardship for the neighboring properties.
We ask that the City of Renton assess and address both of these concerns before
approving any variances or issuing building permits for this property.

The City of Renton requires property owners to let their neighbors know of most proposed land
use changes. Typical land proposals requiring notification include variances, platting and site
plan approval. The city requires written notice before holding a hearing on the proposed
change.
The King County Department of Assessments will help property owners in this process. Their
Public Information section is on the 7th floor on the King County Administration Building, 500
Fourth Avenue, Seattle. They have staff, computer terminals, maps, and other materials
needed to identify all affected parcels. .
;
1. Identify your subject property and obtain its quarter-section-township-range map
coordinates. Use the Kroll books, or the self-service terminals, or ask the County's
public information staff for assistance. The terminals and staff are located on the 7th
floor of the King County Administration Building.
2. Get a copy of the appropriate quarter section map from the County public information
staff, plus a scaled template of the required radius. The County can make photocopies
if needed of portions of these maps. Map copies may be made on the 7th floor.
3. Locate your subject property on the map, then use the template to identify all adjacent
parcels within the required distance. (Adjacent maps may be necessary in case of
overlaps.) Determine the Assessor's account number of the parcels from the
information included on the map. Public Information staff can assist you in determining
the account numbers.
4. You may use the self-service terminals to look up information on individual accounts.
The Tax Information screen includes the taxpayer/owner mailing address. The Property
Characteristics screen and the index browse screens contain the property street-
addresses in case you need to contact tenants/occupants where different from the
taxpayer. Printouts may be made of any of these screen displays at 15 cents each.
5. To Obtain Computerized Address Labels and/or Printouts: Obtain a Batch Request
Sheet and Source Sheet(s) from public information staff. Fill out the request sheet and
list the parcel/account numbers on the source sheet(s).

Project Narrative
We are / have applying / applied for the following land use permits: Residential Building Permit,
Shoreline Exemption, and Zoning Variance for the site listed above. The 13,162 square foot
property is currently zoned R-8, and so are the surrounding properties. The site is currently
occupied by an existing 440 SF single family residence and a 486 SF residential dock on Lake
Washington. The existing SFR will be removed, and replaced with the proposed SFR. The lot
slopes down to the lake approximately 20% the edge of the asphalt to the Southwest. Soil has
adequate drainage. There will be no off-site improvements, and vehicular access will be from
Mountain View Ave
The project is estimated to cost $159,000 with a fair market value of $200,000. The excavation
will only be that which is typically required for a foundation, with minimal fill being deposited
on the sides ofthe structure, to maintain the 2-story classification. There will be no trees
removed and we will grant the City of Renton a utility easement along the southern property line
for the sewer access point. The structure is at least 25' -0" from the Ordinary High Water Mark,
the shoreline is naturalized and there are an existing bulkhead and rockery along the northern
property line. There are no existing or potential residential units that will have an unobstructed
view of this project in the event is exceeds the 35' height limitation.

We request an administrative zoning setback variance for the front building setback requirement
for the property listed above. The adjacent properties have been approved for a zero front yard
se~back and the denial of this request will result in a hardship and diminished use ofthe subject
property. As it stands, upon approval of the variance, the useable portion of the property is only
