The following is in response to the review comments regarding the second review of the subject lot
line adjustment.
1. Based on a telephone conversation with Bob MacOnie, it was decided that the applicants for
the Sixth Street Lot Line Adjustment, LUA-04-139-LLA, would deal with the resolution of
the encroaching building, due to the fact that the only purpose for the Change Lot Line
Adjustment is to divide the vacated right-of-way ofNE 5th Street. It was also decided by Bob
that depicting the encroaching building on the Chang Lot Line Adjustment would be
sufficient to allow the City to move forward with their approval. The building has been added
to the survey.
2. The appropriate symbols and legend have been added to the drawing.
I trust this will satisfy the City's concerns regarding the review comments for the Chang Lot Line
Adjustment.

Format and Legal Description Review
Bob Mac Onie and I have reviewed the above referenced lot line adjustment submittal and have
the following comments:
Comments for the Applicant:
There exists an issue of encroachment of a building onto adjusted Parcel B from Parcel C of this
lot line adjustment. Said building should be shown on Sheet 1 of 2. This issue of encroachment
has already been noted in review comments concerning the Sixth Street Lot Line Adjustment,
LUA-04-139-LLA, on the adjoining property to the west. It has been determined by the city that
this encroachment problem needs to be resolved prior to the approval of this subject lot line
adjustment and the Sixth Street Lot Line Adjustment. The encroachment is of long standing and
may invest the owner of Parcel C with additional rights in Parcel B that are not currently being
addressed.
Note what was set at the comers of the adjusted lots. There is no legend to indicate what the
symbol, used at said comers, represents.

Format and Legal Description Review
Bob Mac Onie and I have reviewed the above referenced submittal and have the following
comments:
Comments for the Applicant:
Note the City of Renton land use action number and land record number, LUA-04-108-LLA and
LND-30-0284, respectively, on the drawing sheets in the spaces already provided.
Tie to the City of Renton Survey Control Network. The city will check the geometry when the
ties are provided.
At one point on the east line of Parcel C, there is noted a 10.14' difference in width (to the
centerline) for Rainier Ave. (from 50' to 40'). City Records indicate that the width of Rainier Ave
is 40' all along the east line of said Parcel.
It does not appear that legal descriptions were submitted with the Land Use Permit Master
Application, as they should have been.
Indicate what has been, or is to be, set at the new comers of the proposed lots.
Note discrepancies between bearings and distances of record and those measured or calculated, if
any.
Note the addresses of the parcels on the drawing.
Note encroachments, if any.

The subject properties do not fall within the boundaries of Zone 1 or 2 of the City of Renton
Aquifer Protection Area. Remove the "AQUIFER PROTECTION NOTICE" block from Sheet 2
of2.
Note whether the adjoining properties are platted (give plat name and lot number) or unplatted.
The word "CONCRETE" is misspelled, in a reference to a found 4" concrete monument on the
centerline of Taylor Ave NW (Sheet 1 of 2).
"WASHINGTON" (the last reference to said word) is misspelled in every notary block noted on
Sheets 1 and 2 of 2.
Note that if there are easements, restrictive covenants or agreements to others (City of Renton,
neighboring properties, etc.) as part of this subdivision, they can be recorded concurrently with
the lot line adjustment. The lot line adjustment and the associated document(s) are to be given to
the Project Manager as a package. The lot line adjustment will be recorded first (with King
County). The recording number(s) for the associated document(s) (said documents recorded
concurrently with, but following the plat) need to be referenced on the lot line adjustment
submittal.

I am writing this letter to address the items required by the City of Renton regarding a
Project Narrative for the Peter Chang Boundary Line Adjustment.
Mr. Chang's property located at 505 Rainier Avenue North and his neighbors, Mr. Miller
located at 515 Rainier A..venue South and IDA Group, LLC property located at 212 NW
5th Street.
The purpose of the proposed boundary line adjustment is to divide the property within the
recently vacated portion of NW 5th Street according to the wishes of the adjoining
owners. There will be ~o changes to any of the properties that would leave a parcel with
less area than it had prior to the right of way vacation. The original platted lot lines are
not being affected.
Mr. Chang's property is; currently used as a restaurant/lounge. The Miller's property is
used as automobile service garage and the IDA Property is currently undeveloped
residential property, the application of this boundary line adjustment does not propose
any changes to the current use of the property.

On behalf of our client, Mr. Peter Chang, I am requesting a preliminary review with
representatives of the Development Services Division to review a boundary line
adjustment between Mr. Chang's property located at 505 Rainier Avenue North and his
neighbors, Mr. Miller located at 515 Rainier Avenue South and IDA Group, LLC
property located at 212 NW 5th Street. I am also requesting to waive certain submittal
requirements, including the following items from Number 6 of the BLA submittal
requirements.
• Ground floor square footage of all structures.
G Location, dimensions, and square footage of any existing structures to remain, and
dimensioned distances to property lines
• Location of existing critical areas on or adjacent to site (wet1ands~ steep slopes;
etc.)
• And Numbers 7,8,9 and 10.
Mr. Chang's property is currently used as arestaurantllounge. The Miller's property is

received by It.
3. SECURED OBLIGATIONS. This Deed of Trust secures performance of
(I) each agreement of Grantor contamed 1Il the Agreement and/or this Deed of Trust (but

thereon accordmg to the terms of the Agreement, and all other existIng and future

IS secured by thIS Deed of Trust (collectively the "Secured Obligations"), includmg all
renewals, modifications and extensions thereof and substitutIons therefore, it bemg the
express mtent of Grantor and Bank that this Deed of Trust and the estate held by Trustee
hereunder shall contInue in effect notWIthstanding that from time-to-tlme no Secured
ObbgatIons of Grantor to Bank may eXIst. and shall survIve as secunty for all new or
additional Secured Obhgatlons of Grantor to Bank from time-ta-time arising Nothmg
contaIned m this Deed of Trust shall be construed as obbgatmg Bank to make any future
advance to Grantor. THE AGREEMENT MAY CONTAIN PROVISIONS ALLOWING

Property, and all cliums for labor, materials, suppbes or otherwise WhiCh, Ifunpald, might
become a llen or charge upon the Property. If required by Bank and at the time of making
each payment to Bank under the Agreement, Grantor shall depoSit mto a non-mterest-
beanng reserve account With Bank, hereby pledged to Bank as secunty for the Secured
Obltgations, a sum esbmated by Bank: sufficient to pay when due taxes and assessments on
the Property and prelDlwn5 on required insurance;
( e) Insurance.
(1) Casualty. Insure continuously with premiums prepaid, With
finanCIally sound and reputable InsurerS acceptable to Bank, all Improvements on the
Property agaInst all nsks, casualties and losses through standard fire and extended coverage
msurance or otherwise, including. WIthout linutatJon, Insurance agalDSt fIre, theft, casualty,
vandaltsm, loss of rents and busmess interruption and any other nsk Bmk may reasonably
request The Insurance polICIes shall be in an aggregate amount of not less than the full
replacement cost of allnnprovements on the Property, including the cost of demolItion and
removal of debns, and shall name Bank as loss payee under a lender loss payable
endorsement in form satisfactory to Bank. All deductJbles shall be in amounts acceptable
to Bank. The amounts collected under the msurance pohcles may be applIed to the
Secured Obligations in any manner as Bank determmes, and such applicabon shall not
cause dIscontinuance of any proceeding to foreclose upon thIS Deed of Trust. In the event
of foreclosure, all of Grantor's rights m the insurance polIcies shall pass to purchaser at the
foreclosure sale;
(11) Flood. Obtain flood msurance if the Property IS located m a
deSIgnated flood hazard area (as determIned by Bank, WIth such determination to be made
at Grantor's expense) and where federally subsidized flood insurance is avmlable.
(m) L1abIhty MalDtain comprehellSlve general pubhc liabIlity
msurance msunng against habllIty from risks associated WIth the use, ownership and
operaoon of the property.
(IV) Tltle. Provlde to Bank a 1992 A L T.A. form of lender's
extended coverage btle insurance for the full amount of Bank's conurutment under the
Agreement insuring the first lien priority of this Deed of Trust. Such polIcy shall be lSSUed
by a title company acceptable to Bank. The policy shall contain such endorsements as
Bank may reasonably request.
(f) Hazardous Waste. NotIfy Bank WIthm 24 hours of any release of a
reportable quantIty of any Hazardous Substance, or of the receipt by Grantor of any notIce,
order or conunurucation from any governmental authority which relates to the eXIstence or
potential for envIronmental pollutIon of any kmd existing on the Property, or results from
the use of the Property or any surrounding property. Grantor shall mdemnify, defend and
hold Bank and Its successors and assigns harmless from and agmnst any and all claims,
demands, penaltIes, fees, hens, damages, losses, expellSes, and liabIlitIes ansmg out of or

In any way connected with any alleged or actual past or future presence on or under the
Property of any Hazardous Substance from any cause whatsoever; It bemg intended that

winch originated on or under the Property after the date Bank or any t1urd party acquIres

Substances" shall mean any substance or material whIch may be hazardous to the health
or safety of any person, including without limitation any substance or matenal which IS

(g) SIte ViSIts. Observation and TestIng. Permit Bank and Its agents and
representanves, at any reasonable tune, to enter and VlSlt the Property for the purpose of·
performmg appraisals andlor mspectmg the Property, taking and removmg soil,
groundwater and other samples, and conduct1Og tests on any part ofthe Property Grantor
agrees that Bank neither has nor undertakes any duty or obhgation to examme or mspect
the Property, and that any inspectIon by Bank is solely for the purpose of protectmg Its
secunty and Its nghts under thiS Deed of Trust If Bank beheves It has an obhgatIon to
msclose any report or finmngs made as a result of Its mspecbon of the Property, then Bank
may make such dIsclosure.
(h) Costs and Expenses Pay, reimburse and 10demrutY Bank for all of
Bank's reasonable costs and expenses incurred 10 connecbon with the enforcement of
Bank's nghts and Grantor's obbgatIons under thIS Deed of Trust, foreclosing upon trus
Deed of Trust, defendmg any acnon or proceedtng purporbng to affect the rights or dutIes
of Bank or Trustee under tlnsDeed of Trust, or managing the Property and collecting the
Payments, mcludIng, WIthout lmutatJon, all reasonable attorneys' fees and value of the
servJces of staff counsel, legal expenses, collectIon costs, costs of tItle search, and trustee's
and receiver's fees.
5. NEGATIVE COVENANTS. Grantor shall not, without Bank's pnor
written consent:
(a) Pavrnents Accept or collect Payments more than one month m
advance of the due date,
(b) Contracts. Termmate, mOOtY or amend any provIsion of the
Contracts or enter mto a Contract with a tenn, including options or renewal nghts, of more
than 3 years andlor containmg an option to purchase;
(c) Use. Change the present use or intended use of the Property, or
scope of the development or improvements of the Property, or permIt or consent to any
restnctIon that would prevent or otherwise ImpaJr the use or development of the Property,
or permit thereon the generatIon, procesSIng, storage or disposal of any Hazardous
Substance; or
(d) RestrictIons on Conveyances. Cause, pennit or allow the transfer,
conveyance or encumbrance of the Property or of any mterest in the Property, or the
transfer of any mterest m the Grantor, whether voluntary, mvoluntary or by operatIon of
law
. 6. EMINENT DOMAIN In the event any portIOn of the Property 15 taken
through emment domam, the amount of the award to which Grantor IS entitled shall be
apphed to the Secured Obligations.

7 PROTECTION OF BANK'S INTEREST. If Grantor shall fad to pay any
amounts which may become a lien on the Property, pursuant to Section 4 (d), or flul to
mamtam adequate msurance on the Property, as reqUIred by Sectlon 4 (e), Bank may at Its
sole option pay such obhgations and/or obtaIn such 1Osurance.
8 ADDITIONS TO SECURED OBLIGATIONS. Any payments required
under Sections 4.(d), 4.(e), 4 (f), 4 (g) or 4.(h), but not made when demanded, shall
Immediately be deemed added to the Secured OblIgations, and shall accrue mterest at the
highest rate of Interest accrumg from tIme to bme under the Secured Obligations.
9. RECONVEYANCE Trustee shall reconvey such portion of the Property
to the person entitled thereto upon wntten request of Bank, or upon satisfaction of the
Secured Obltgatlons and written request for reconveyance made by Bank or any person
interested In the ·Property, accompanied by Trustee's standard reconveyance fee, which fee
shall be Grantor's obligation.
10. SUCCESSOR TRUSTEE. In the event of death, mcapacity, disabihty,
dissolution, resignation of refusal to act by the Trustee, Bank may appoInt a successor
trustee and, upon the recording of such appomtment In the records of the county In wluch
thiS Deed of Trust is recorded, the successor trustee shall be vested with all powers of the
ongmal Trustee
11. EVENTS OF DEFAULT. The occurrence of any of the following events
shall, at Bank's option, and at any tIme without regard to any preVIous knowledge on
Bank's part, constItute a default under the terms ofttus Deed of Trust, the Agreement, the
Secured Obligations, and all related loan documents:
(a) Non-payment of Principal or Interest. Any payment of prinCipal or
mterest on the Secured Obligations is not made when due, or
(b) F8Ilure to Perform. Any tax, assessment, insurance preInlum, hen,
encwnbrance or other charge agaInst the Property Is·not paid when due; or any other term,
covenant or agreement of Grantor contaIned 10 this Deed of Trust, the Agreement, or In any
other document with Bank, or In wluch Grantor grants a secunty Interest in the Property, IS
not promptly performed or satisfied
12. REMEDIES UPON DEFAULT. If any default occurs and is continumg,
and subject to any apphcable notice and cure period proVided for 10 the Agreement, Bank
may, at its option:
(a) Termmate Commitment. Terminate any outstanding and unfulfilled
comnlltment to Grantor;
(b) Accelerate. Declare any or all of the Secured ObligatIons, together
With all accrued 1Oterest, to be immediately due and payable Without presentment, demand,
protest or notice of any land, all of which are expressly W8lved by Grantor,
(c) Payments. Pay such sums as may be necessary to obtam a current
appraisal, to Inspect and test the Property, and to pay any tax, assessment, insurance
premIUm, hen, encumbrance or other charge agamst the Property, all WithOut prejudice to
Bank's right to accelerate the Secured Obligations and foreclose upon tius Deed of Trust.
Grantor shall reimburse Bank: upon demand, for all such amounts paid by Bank, With
mterest thereon from the date of such payment at the htghest rate that IS, from time to brne,
applicable on any of the Secured Obbgatlons All unrelmbursed amounts shall be added to
and become a part of the Secured ObbgatlOns;

(d) Collectlon of Payments Tenntnate the license granted to Grantor to
collect the Payments; take possesslOn of, manage and operate the Property under the tenns
of the Contracts, and demand and collect all Payments, mcludmg endorsmg tn the name of
Grantor any check, draft or other mstrument glVen as payment, either by Itself or through
an agent or Judicially-appointed receiver The Payments shall be appbed first to payment
of the costs of managing the Property and collecting the Payments, and then to the Secured
Obbgatlons;
(e) Trustee's Sale. DIrect the Trustee, upon wntten request, to sell the
Property and apply the sale proceeds in accordance With Waslungton's Deed of Trust Act
(RCW §61.24 010, et seq) Any person, except Trustee, may bid at the Trustee's sale, and
(f) . Other Remedies. Pursue all other aVaIlable legal and eqUitable
remedies, mcluding, Without lmutatlon, foreclosing upon this Deed of Trust as a mortgage
Grantor expressly WaIves any defense or nght, m any action or proceedlDg in connection
WIth the Secured Obligations, that Bank must first resort to any other secunty or person.
