Project Description / Background: The applicant, Rite Aid, is requesting a Temporary Use Permit for outdoor storage of two metal cargo containers on their property for storage purposes. The metal containers are presently on site and located at the north wall of the Rite Aid building. They are being proposed for use as storage units during an interior remodel, and then for storage of holiday merchandise, if permitted. No permits were requested for this outdoor storage use prior to placement of the containers on the Rite Aid site. Robert Arthur of the Development Services Division issued a Notice of Violation, Violation Index Number C04-0598, to the manager of Rite Aid, Elizabeth Fabien, investigated on August 5, 2004. The notice was made for prohibited outdoor storage according to the Renton Municipal Code Sec. 4-2-060M. The subject site is located on the comer of NE Sunset Blvd and NE 12th St. The cargo containers are located at the north side of the Rite Aid building. The property abutting the site to the north is zoned Center Suburban (CS) and is currently developed as multi-family residential with one duplex and one four-plex. At the north-east of the site is the Sunset Plaza Shopping Center. To the west is Kirkland Ave. NE and beyond it the new Renton Fire Station #12. According to Renton Municipal Code Section 4-2-060M outdoor storage is not permitted in the CS zone except conditionally for storage in association with rental services. A Temporary Use Permit may be issued for an unpermitted use on a short-term basis. It must be approved, modified or conditioned according to the criteria in RMC Sec. 4-9-240H, which requires consideration of the impact of the use on property or improvements in the vicinity of the site. Findings 1) Request: The applicant, Rite Aid Corporation, has requested approval for a Temporary Use Permit to perm it outdoor storage of two cargo containers at the north side of their building for storag e during a remodel and subsequently to store holiday merchandise. The containers Vtfould be on the site 24 hours a day. From September 1, 2004 to September 25, 2004 the containers would be used to store materials and goods during an interior store remodel. From September 26. 2004 through December 15, 2004 the applicant proposes to store holiday merchandise. 2) Temporary Use Permit: The applicant has submitted the application materials required for processing and making an administrative decision on the proposal. 3) Existing Land Use: Land uses surrounding the subject site include: North: multi- family residential and shopping center; South: convenience store, gas station; East commercial; and West: fire station. 4) Zoning: Center Suburban (CS) zone. The purpose of the CS zc> ne is to provide commercial and multi-family uses which complement eachother. Outdoor storage is not a permitted use in this zone. Outdoor storage is permitte-d under certain conditions in the Commercial Arterial (CA) and the three industrial z<>nes (U, MI, HI) where it is more consistant wit~ the purpose of the zones. 5) Topography: The site is relatively flat. 6) Lot and Building Size: The site is 76,500 square feet. The exiisting building is 16,750 square feet and the temporary containers are 640 squa. re feet. The lot coverage is approximately 22.7%. 7) Consideration of Temporary Use Decision Criteria Section 4-9-240H lists 5 crit&ria that the Zoning Administrator is asked to consider, along with all other relevant information, in making a decision O~ Temporary Use Permit application. These incJude the following: a. The temporary use will not be materially detrimental to th,e public health, safety, or wellbeing, nor injurious to property or improvemer.ts in the vicinity of the temporary use; ancl Outdoor storage of cargo containers on the Rite Aid site undermines the quality and intent of development in the Center Suburban (CS) zone. Ti"le purpose of the CS zone is to promote corn mercial and retail development that se rYes the needs of local residents. Businesses permitted in this zone are meanlt to complement residential uses and should have limited adverse impact on residential uses. Businesses needing outdoor storage are generally allowed in 20nes associated with more intense development, such as the industrial zones (IL. 1M, IH). Even in the zones where it is allowed, outdoor storage must be addressed in a formal site plan review and its impact must be tempered with screening. The cargo containers placed outside of the Rite Aid on Sunset Boulevard create a detrimental visual impact to businesses and residents near the site. Further all owing Rite Aid to have cargo containers on its site for storage of holiday merchandise would extend the duration of impact to the neighborhood beyond what is justifiable. If the store is in need of more storage for seasonal fluctuation, this need could be addressed by appropriately expanding indoor storage capacity or seeking off-site storage. b. Adequate parking facilities and vehicle ingress and egress are provided to serve the temporary use and any existing uses on the site; and The proposal would not effect parking. c. Hours of operatation of the temporary use are specified, and would not adversely impact surrounding uses; and The outdoor storage is proposed to occupy the site 24 hours a day from September 1, 2004 to December 15, 2004. d. The temporary use will not cause nuisance factors Salch as noise, light, or glare which adversely impacts surrounding uses; and Other than the visual impacts described in 7.a., the proposal is not expected to result in more nuisance than what is currently occuri.,g under normal store operations. The containers are not lit separately. Noise would only result when materials are placed in and removed from the containers. e. If applicable, the applicant has obtained the required ris;Jht-of-way use permit N/A E. Conclusions 1. The subject site is located at 3116 NE Sunset Blvd., within the Center Suburban (CS) zoning designation. 2. The CS zone does not permit outdoor storage. 3. The analysis of the proposal according to zone-related land use regulations and Temporary Use Permit decision criteria is found in the body of the Staff Report. F. Decision The Temporary Use Permit for siting of two temporary cargo containers at the Rite Aid on Sunset Blvd, File No. LUA04-111 is approved with modific~tion. The permit will be issued for the period of October 13, 2004 to October 28,2004. The applicant will be given until October 28, 2004 to remove the containers. An appeal of the decision must be filed within the 14 day appeal period (RCW 43.21.C.075(3); WAC 197-11-680). An appeal to the Hearing Examiner is govemed by Title IV, Section 4-8-11_ B, which requires that such appeals be filed directly with the Hearing Examiner via the City of Renton City Clerks Office. Appeals must be made in writing on or before 5:00 PM on October 27, 2004. Any appeal must l:Je accompanied by a $75.00 fee and other specific requirements. THE APPEARANCE OF FAIRNESS DOCT:RINE provides that no ex parte (private one-or.-one) .communications may occur conceming the land use decision. The Doctrine applies not only to the initial decision, but to Appeals to the Hearing Examiner as well. All comrTlunications after the decision/approval date m'-lst be made in writing through the Hearing Examiner.
