C. Project Description / Background:
The applicants, Paul and LOlle Walser, are requesting approval of an administrative variance
from the required rear yard setbacks in the R·8 zone (section 4-2-110A). The subject site is
located at 817 Monroe Avenue NE (Parcel No. 780920-0060),
The development standards of the R-8 zone require a rear yard setback of 20 feet Tile
setback IS measured from the property tine to the bUilding footprint. The applicant IS
proposing a reduction of the rear yard setback to range 110m 10 feet to 12 feet in order to
construct a second story deck over an eXisting covered patio.
The applicant submitted a site plan showing the new addition on the site. The proposed 614
sq, It. second story deck would replace an existing 560 square foot covered patio structure
and a 225 square foot at·grade deck that are currently located within the required 20 foot
rear yard setback area, The proposed lot coverage would be approximately 19 percent. a
reduction from the current lot coverage of 20 percent. The variance proposal would maintain
the required interior 5-loot side yard setback.
FINDINGS, CONCLUSIONS & DECISION
Having reviewed the written record in the matter. the City now makes and enters the
following:
D. Findings
1) Request: The applicant has requested approval for an administrative vallance from
the required 20-foot rear yard setback in the R-8 zone (section 4-2-110A) for the
property located at 817 Monroe Avenue NE, A rear yard setback ranging from 10
feet on the north end of the deck to 12 feel 011 the south end of the deck is
requested.
2) Administrative Variance; The applicant's administrative variance submittal materials
comply with the requirements necessary to process a vallance. The appl>cant's sIte
plan and other project drawings are enterEld as Exhibits 1 through 3.
3) Existing Land Use; Land uses surroundlllg the sublect site Include: North; single·
family reSidential: South: sirlgle·family residential; East single· family residential, and
West: Single-family residential.
4) Zoning; The site is located in the Residential· 8 (R·S) dwelling units per acre zone
The development standards for this zone require II IS-foot front yard setback. 20-foot
rear yard setback, 5·loot Interior side yard setbll.ck. and a IS-foot side yard alOrlg a
street setback. MaXimum lot coverage is 35 percent or 2.500 sq It for lots 5.000 sq.
ft. or greater.
4) Topography: The topography of the site is flat.
5) Lot and Building Size: T~le site alea is 12.563 square feet. The existlllg single-
family home (Inctuding a carport and covered patio) totals approximately 2.253 square
feet with a 225 square foot detached at-grade deck. The existing footprint of the
residence including the covered patio. detached at grade deck. and carport is
approXimately 2,478 square teet, and the proposal is to remove 1,077 square feet of
footprint (carport, shed, covered patio alld detached at-grade deck) and add 900
square feet of footprint (2"0 story addition and 2'" story deck). which results in a
building tot coverage of 19 percent (19%).
CONSISTENCY WITH VARIANCE CRITERIA
Secfion 4-9-2508.5.8. Lists 4 critena that the Zoning Administrator is askod to consider,
along with all other relovant information, In makmg a d"cision on an Administrative Variance
applicafioll. Thew IIlclude the followillg.
The Zoning Administrator shall have authority to grant an administratIVe variance
upon making a determination, in writing. that the conditions specified below have
been lound to exist:
a. That the applicant suffers undue hardship and the variance is necessary
because of special circumstances applicable to subject property, including
sile, shape, topography, location or surroundings of the subject property,
and the strict application of the Zoning Code is found to deprive subject
property owner of rights and privileges enjoyed by other property owners in
the vicinity and under identical lone classification:
The applicants cont"nd that special circumstancas apply to the subject site, Which
impose limitations 011 the lot. Specifically, the applicants indicate that the property
is constrained by a PSP&L Transmission Lille Easemellt that encompasses 54.1 %
of their lot area. The PSP&L Easement is located on the eastern portion of the
property alld the reSidence is located located on the wester protion of tile property.

The appiical1ts' proposal indicates that an eXisting 560 sq. It. patio and 225 sq. It. at
grade detached deck are currently located below the proposed addition area Within
the required rear yard setback, and that their proposal is to construct a second
story addition with a second story deck over a portion of the eXisting covered patio
and detached at grade deck.
The 20-fool rear yard setback arld PSP&L Easement in front of the residence limits
the available building area. Therefore, the applicant is requesting \0 encroach mto
the rear yard setback by 8 feet on the southern ertd of the deck al1d 10 feet on the
northern end of the deck in order to construct their second story deck addition as
illustrated In Exhibit 2. In this case, the applicant IS creating a hardship by
proposing to construct a 614 square foot second story deck off of a proposed
second story addition to their eXisting single-family residence. If the applicant
redesigned their proposal, they could meet the setback requirements and ellllllnate
the need for a variance.
b_ That the granting of the variance witt not be materially detrimental to the
public welfare or injurious to the property or improvements in the vicinity and
zone In which subject property is situated:
A reduction of the rear yard setback to range from 10 to 12 feet for the construction
of a second story deck addition would be injurious to the adjacent property owners
according to two letters staff received during the comment period for the Notice of
Application. The letters Indicate that approval of this variance request would
negatively impact the level of privacy in the" respective buckyurd.
The applicant contends tflUI the existing covered patio and detached at-grade deck
would be removed and that the second story deck would be located over what's
existing and that the intrusion into the rear yard setback area would be less than
what IS currently existing. However, according to Section 4-2-110D of the Renton
Municipal Code, allowed projections Into setback areas Include uncovered decks
not exceeding t8 inches above grade, therefore the existing at-grade deck is
permitted and is not considered a non-conforming structure. While staff
acknowledges that the covered patio area is an existing non-conforming structure,
the applicant s proposal is to construct a deck that IS 54 square feet larger in area
than the existing covered patio and would be constructed at a higher elevation than
the existing patio. Therefore, approval of the proposed variance request would be
injurious to property in the vicinity.
c. That approval shall not constitute a grant of special privilege inconsistent
with the limltatlon upon uses of other properties in the vicinity and zone in
Which the subject property is situated:
The approval of the variance request would be a grant of special priVilege as other
property owners in the vicinity and R-S ;:one would not be permitted to construct an
addition il1to required setbacks, when the hardship created is self-Imposed by the
size and design oj the proJect.
d_ That the approval as determined by the Zoning Administrator is a minimum
variance that will accomplish the desired purpose:

The applicants contend that the request is a minimum variance needed in order to
construct a second story deck addition to their proposed addition as the PSP&L
Easement prohibits them from using a large portion oj their front yard.
The variance requested is not the minimum variance necessary to accomplish the
desired purpose, as the proposed second story deck IS 54 squsare feet larger than
the existing non-collformlng covered p8tio The applicants are proposing to expand
an existing non-conformity_ The applicants could redesign their proposal to
construct a less intrusive second story addition and a smaller deck that would meet
all of the setback requirements, therefOrE! eliminating the need lor a variance.
E. Conclusions
1. The subject site is located at 817 Monroe Avenue NE, within the Residential· 8
Dwelling Units per Acre (R-B) zoning designation,
2. The R·8 zone requires a minimum 20-foot front yard setback from the property
boundary (section 4-2-110A), The applicant is proposing an 8 to 10-foot reduction of
the rear yard to 10 feet along the northern end of the proposed deck and 12 feet
along the southern end of the proposed deck,
3. The analysis of the proposal according to variance criteria is found In the body of the
Staff Report.
4, Staffs analysis concludes that the applicant"s proposal is not justified based on the
four applicable criteria needed to grant a variance
F. Decision
The Administrative Setback Variance for the Walser Variance, File No. LUA-05-002, V-
A, is Denied.

I have outlayed 5000 Dollars for plans and engineering fOI a home
improvement and needed to apply for ~ varience to put a deck on the back of
our home and was told by the planning board NO problem, We had 2 neighbors
complain that we would be able to look in ti1elr yards, we can already see in
their yards as there is a 6 \0 10' elevation difference betweon our yard and
theirs, So we wore denied OUf varience for thiS reason? I and my f~mily
w~nt to know how much common sense these people have that make t11ese
decisions?? I am not building the deck to look in their yards but for the
view of the mountlans and to complete the expansion of the home. I am
trying to prOVide a bigger home for my family and improve the value of the
homes in the neighborhood, as well as my own, I did not buy a home in King
Counly because of lheirplanning commislon having a lack of common sense, I
bought In the City of Renton because I had been told that they were easy to
deal with and had a head on tIleir shoulders, what happened?? I feel like we
are talking to a brick wall. ThiS project only means money in the City's
cofer -Matenals, permits and larger property taxes,
I am just saying that I and my family are very dissapolnted in the
action thai the Planning board has come up with and tlleir LACK of logic
instituted here. Look at all the new houses going up which have no yards or
are looking In their neighbors house's. If I was a developer and bought
thiS property and wanted to build lhis there would not be any problem at
all··ll would be approved in a flash, but the regular joe that wants to add
to their home gets hosed--I csn not build forward because of a right of way
across my properly, so we changed our plans and are just asking for a small
deck on the back of the house and they say NO!! I wonder why peopte do not
like do things by the book-I now understand why, this is rediculous And
by the waY--One neighbor has a grudge agianst us and has a deck that he can
see In our yard, But I can not have one--OUHR!

We vcry mnch appreciated our conversation with you the other day regarding our
concerns about the above project application. The property in question is directly
adjacent to our rear prope-rty line.
While respecting the desire of onr ocighbor, who has not made any contact with us,
to improve her property, we have some serious ml~givings about the project.
The first COnCern is that adding a second story deck wiU raise the height of our
neighbo .. t~ activities to such a degree that her si~t line will be directly down into
our back yard aud patio area, thnN serionsly compromising the privacy of our own
hack yard and patio space.
The second concern is that a good deal of the present skyline, from our penpective,
will be eliminated, and the morning sun will be blocked to a greater extent than at
pre"'nt, makin!!: our honse darker.
Both of the ahove factors may well ha.'e a negati\'e Impact on the value of our
property. We have contacted a realtor and ha"e been told that this may, Indeed, be
the case.
Thus, we suhmit our objection to the setback variance reqnested and express onr
hope that the city will uphold its propcrty code protections of the privacy and other
real assets of onr property.

We are requesting a variance for a deck to be slightly into the back yard setback of our
home located at 817 Monroe Ave NE, Renton, WA 98056.
We are planning to add an upstairs to our current home. We would also like to construct
a deck off the backside of the home. Our property is long and narrow. Due to the
setbacks en each side of the home we would net be able to build a deck off either side. In
the front of the house we have power lines that run overhead and there is a PSP&L Trans
Line Easement that encompasses 54.1 % of the lot so we arc unable to construct in that
direction. In reviewing all options available to us it was determined that the only feasible
option would be on the backside of the home. This option would also make logistic sense
for the overall appearance of the home and surrounding homes. Maintaining high
marketability for our hom", and the neighhorhood.
Currently we have a covered patio where the proposed deck will be constructed. The
covered patio will be removed and the proposed deck will be smaller than the existing
covered patio. So our existing lot covernge with the addition and deck ",ill be less than
existing.
In addition to the parcel on which our home is built, we also own a small piece of
property directly behind us property tax #780920-0066-05.
The new addition and deck will not cause any new view obstruction versus existing. An
utility and services will remain the same with no alteration of these on the property.
