Dear Director Pietsch:
I am the new owner of the property identified in a letter sent to my agent. Patrick
White, dated October 14, 2005. I bought this property in April of 2005.
This letter from the City indicates that an eariier Comprehensive Plan
Amendment had been submitted to the City for its environmental review in an
application by the former owner, Sabina Molina. I have also received a notice of
hearings before the City's Planning Commission about a change the City's
Comprehensive Plan from low density residential to single family residential and
that hearings. This notice states that hearings are to be held before the Planning
Commission on November 2, 2005.
I understand that the earlier request made for the comprehensive plan
amendment to R-8 densities was based upon express promises that planning
staff made to the prior owner, Sabina Molina, whom I purchased the property
from. These promises, that annexation zoning were to be at R-8 densities, were
also made to Mr. White sometime in January of 2005 and in the early Spring of
2005.
When the City brought the proposed annexation to the King County Review
Board in August of 2005, I again stated in a declaration exactly these
circumstances. Again, Mr. White and I were told by City planning officials that
the City would zone this property as R-6 upon annexation to the City. Based
upon reports made to the Boundary Review Board, I asked that the record be
corrected to show the circumstances on what zonIng we were promised in the
a~nexation petition.
I have been shown reports that the City presented to the County Boundary
Review Board in August of 2005. showing that the property will receive R-4
zoning;f it is annexed to the City. This is in direct violation of the promises made
to me and to Mr. White that the future zoning densities would be R-8. There
simply Is no reason for these hearings to be held. Because the City has not kept
its word and breach its agreement and Is actively seeking to zone this property
as R-5. I am as the current owner. by this lett~r formally withdrawing the
application for the comprehensive plan amendment. rezone, and environmental
review request made with the City. 'am requesting that the City not conduct any
further hearings on these matters and remove these matters from any further
consideration by the Planning Commission and City offices.

OPTIONAL DETERMINATION OF NON-5IGNIFICANCE (DNS): As Ihe Lead Agency. the City of Renlon ha. delermined
that Significant environmental Impacts are unlikely to result from the proposed zoning. Therefore. as permitted under the
RCW 43.21C.110, the City of Renton Is using the Optional DNS process to gtve notice that a DNS is lIk.ely to be issued.
Comment periods for the project and the proposed DNS are integrated into a single comment period. There will be no
comment period following the Issuance of the Threshold Determination of Non-Significance (ONS). A 14-day appeal
period will follow the Issuance of the DNS.

An open record public hearing was held on these Issues before the Renton
Planning Commission on October 5, 2005 and has been continued until
November 2, 2005 ..
The proposed amendments are consistent with the relevant land use
designations and land use policies of the Renton Comprehensive Plan adopted in
November 2004.
Environmental Checklist prepared January14, 2005.
This non-project action will be subject to the CIty's SEPA Ordinance and
Development Regulations and other applicable codes and regulations as
appropriate.
Proposed Mitigation Measure,: The analysis of the proposal does not reveal any adverse envIronmental impacts
requiring mitIgation above and beyond existing code provisions. However, mitigation may be necessary and may be
imposed at the time of a site specific development proposal on the subject annexation site.

OPTIONAL DETERMINATION OF NON-SIGNIFICANCE (DNS): As the Lead Agency, the City of Renton has determined
that significant environmental impacts are unlikely to result from the proposed zoning. Therefore, as permitted under the
RCW 43.21 C.11 0, the City of Renton is using the Optional DNS process to give notice that a DNS is likely to be issued.
Comment periods for the project and the proposed DNS are integrated into a single comment period. There will be no
comment period following the issuance of the Threshold Determination of Non-Significance (DNS). A 14-day appeal
period will follow the issuance of the DNS.

Planning Commission on October 5, 2005 and has been continued until

The proposed amendments are consistent with the relevant land use
designations and land use policies of the Renton Comprehensive Plan adopted in
November 2004.

This non-project action will be subject to the City's SEPA Ordinance and
Development Regulations and other applicable codes and regulations as
appropriate.
Proposed Mitigation Measures: The analysis of the proposal does not reveal any adverse environmental impacts
requiring mitigation above and beyond existing code provisions. However, mitigation may be necessary and may be
imposed at the time of a site specific development proposal on the subject annexation site.

PROJECT NARRATIVE FOR MOLINA COMPRHENSIVE PLAN CHANGE
This request is for a change from Residential Low Density to Residential Single Family
with concurrent zoning ofR8.
The site is a 3.2 acre parcel located at 9609 S 192nd St, Renton, 98055
The property contains a single family residence and the use is single family residential.
The site slopes gently to the southwest and contains no wetlands, water bodies or steep
slopes.
The existing structure is located in the northwest portion of the property.
A. The Comprehensive Plan Amendment will not degrade public health, safety or
welfare as it will not change the ultimate usage of the property from what its
current potential already is. The existing County R6 zoning is roughly equivalent
to Renton's R8 zoning.
B. There is a high demand for new, medium priced single family residences in the
City of Renton at this time. The proposed Comprehensive Plan Amendment will
facilitate fulfilling the demand for this type of home.
C. The Comprehensive Plan Amendment is compatible with the existing
Comprehensive Plan in that it will maintain the existing character of the
neighborhood and act as a buffer to the north which is Residential Medium
Density allowing up to fourteen dwelling units per acre.
D. The Comprehensive Plan Amendment is compatible with the surrounding
neighborhood. Similar zoning exists to the south and to the east of the subject
property and higher density zoning (RIO to R14) is contiguous with the northern
boundary of the subject property. All adjacent zoning is compatible residential
zomng.
E. The Comprehensive Plan Amendment will have virtually no effect on utilities,
transportation, parks or schools because of the minimal increase of the potential
dwelling units involved as a result ofthis proposal. Additionally, if the subject
property were to remain in unincorporated King County with its current zoning,
no impacts would result from its current potential development.
F. The subject property is surrounded by similar zoning to that requested in this
proposed Plan Amendment. Physically the subject property has soils consistent
with the requirements for the type of construction proposed. The property has a
gentle slope which maximizes the efficiency of a plat storm
drainage/retention/detention plan. All necessary utilities for development are
present.

REQUEST FOR COMPREHENSIVE PLAN CHANGE
My property is currently in unincorporated King County, however we are part of an
annexation petition to become incorporated into the City of Renton.
The zoning on my property in King County is R6. The City of Renton's Land Use
Comprehensive Plan shows that my property is designated Residential Low Density
which would equate to R4 zoning.
I am requesting that the Plan be amended to show my property as Residential Single
Family with R8 zoning. As the County's zoning is based on gross square feet for density
purposes and the City's zoning is based on net square feet, the requested R8 zoning
would allow about the same number of dwelling units as currently allowed in the County.

PURPOSE OF CHECKLIST:
The State Environmental Policy Act (SEPA), Chcipter 43.21C RCW, requires all governmental agencies to"
consider the environmental impacts of a proposal before making decisions. An Environmental Impact
Statement (EIS) must be prepared for all proposals with probable significant adverse impacts on the
quality of the environment. The purpose of this checklist is to provide information to help you and the
agency identify impacts from your proposal (and to reduce or avoid impacts from the proposal, if it can be
done) and to help the agency decide whether an EIS is required.
INSTRUCTIONS FOR APPLICANTS:
This environmental checklist asks you to describe some basic information about your proposal.
Governmental agencies use this checklist to determine whether the environmental impacts' of your
proposal are Significant, requiring preparation of an EIS. Answer the questions briefly, with the most
precise information known, or give the best description you can.
You must answer each question accurately and ca~efully, to the best of your knowledge. Inmost cases,
you should be able to answer the questions from your own observations or project plans without the need
to hire experts. If you really do not know the answer, or if a question does not apply to your proposal, write
"do not know" or "does not apply". Complete answers to the questions now may avoid unnecessary
delays later.
Some questions ask about governmental regulations, such as zoning, shoreline, and landmark
designations. Answer these questions if you can. If you have problems, the governmental agencies can
assist you.
The checklist questions apply to all parts of your proposal, even if you plan to do them over a period of
time or on different parcels of land. Attach any additional information that will help describe your proposal
or its environmental effects. The agency to which you submit this checklist may ask you to explain your
answers or provide additional information reasonably related to determining if there may be significant
adverse impact.

2. If the proposed Insured has or acquires actual knowledge of any defect, lien,
encumbrance, adverse claim or other matter affecting the estate or interest or mortgage
thereon covered by this Commitment other than those shown in Schedule B hereof, and
shall fail to disclose such knowledge to the Company in writing, the Company shall be
relieved from liability for any loss or damage resulting from any act of reliance hereon to
the extent the Company is prejudiced by failure to so disclose such knowledge. If the
proposed Insured shall disclose such knowledge to the Company, or if the Company
otherwise acquires actual knowledge of any such defect, lien, encumbrance, adverse claim
or other matter, the Company at its option may amend Schedule B of this Commitment
accordingly, but such amendment shall not relieve the Company from liability previously
incurred pursuant to paragraph 3 of these Conditions and Stipulations.
3. Liability of the Company under this Commitment shall be only to the named proposed
Insured and such parties included under the definition of Insured in the form of policy or
policies committed for any only for actual loss incurred in reliance hereon in undertaking in
good faith (a) to comply with the requirements hereof, or (b) to eliminate exceptions shown
in Schedule B, or (c) to acquire or create the estate or interest or mortgage thereon
covered by this Commitment. In no event shall such liability exceed the amount stated in
Schedule A for the policy or policies committed for and such liability is subject to the
insuring provisions, the Conditions and Stipulations, and the Exclusions from Coverage of

4. Any action or actions or rights of action that the proposed Insured may have or may bring

all liability and obligations hereunder shall cease and terminate six months after the effective date

CONDITIONS AND STIPULATIONS
1. The term mortgage, when used herein, shall include deed of trust, trust deed, or other
security instrument.
2. If the proposed Insured has or acquires actual knowledge of any defect, lien,
encumbrance, adverse claim or other matter affecting the estate or interest or mortgage
thereon covered by this Commitment other than those shown in Schedule· 8 hereof, and
shall fail to disclose such knowledge to the Company in writing, the Company shall be
relieved from liability for any loss or damage resulting from any act of reliance hereon to
the extent the Company is prejudiced by failure to so disclose such knowledge. If the
proposed Insured shall disclose such knowledge to the Company, or if the Company
otherwise acquires actual knowledge of any such defect, lien, encumbrance, adverse claim
or other matter, the Company at its option may amend Schedule 8 of this Commitment
accordingly, but such amendment shall not relieve the Company from liability previously
incurred pursuant to paragraph 3 of these Conditions and Stipulations.
3. Liability of the Company under this Commitment shall be only to the named proposed
Insured and such parties included under the definition of Insured in the form of policy or
policies committed for any only for actual loss incurred in reliance hereon in undertaking in
good faith (a) to comply with the requirements hereof, or (b) to eliminate exceptions shown
in Schedule 8, or (c) to acquire or create the estate or interest or mortgage thereon
covered by this Commitment. In no event shall such liability exceed the amount stated in
Schedule A for the policy or policies committed for and such liability is subject to the
insuring provisions, the Conditions and Stipulations, and the Exclusions from Coverage of
the form of policy or policies committed for in favor of the proposed Insured which are
hereby incorporated by reference and are made a part of this Commitment except as
expressly modified herein.
4. Any action or actions or rights of action that the proposed Insured may have or may bring
against the Company arising out of the status of the title to the estate or interest or the
status of the mortgage thereon covered by this Commitment must be based on and are
subject to the provisions of this Commitment.
All notices required to be given the Company and any statement in writing required to be furnished
