Request for Park Mitigation Credit -Windstone. Windstone II. Windstone III. and Windstone IV
(Henning) _
The developer of Windstone has requested credit against the City's required Parks Mitigation Fee for on-site
recreation facilities. The plat of Windstone was originally submitted, reviewed and approved by King County in
2000/2001, and subsequently annexed into the City of Renton in April 2004. The project is currently under
construction. An on-site private park was required by King County, and the developer has included this in the plat.

The applicant has requested Environmental Review for the proposed rezoning of the
4.S4-acre annexation site (excluding streets) from King County's R-6 zone. In
addition, the City has asked the Boundary Review Board to invoke jurisdiction to
include the surrounding acres in the annexation for a total of 25.7 acres (21.2-acres
excluding street right-of-way). It is proposed that the zoning of the property be split
between R-4 and R-S to correspond with Low Density Residential (LOR) and
Residential Single Family (RS) designations in the Renton Comprehensive Plan.
Because annexations are SEPA exempt (RCW 43.21 C.222) this environmental
review is only for the rezone. The majority of the land subject to rezone has already
been fully developed as part of three County-approved plats. There are currently 59
dwelling units in the expanded annexation area, with a development potential of a
total of .:!:. 75 units under Renton's proposed zoning. The proposed rezone is
consistent with Renton's Residential Low Denisty and Residential Single Family land
use designation, as shown on the City's Comprehensive Plan Land Use Map.
The site is located south of the city boundary at S. 55th Street and east of the city
boundary at Talbot Rd. S. It is located in the NE 1/4 of Section 6, Township 22 N,
Range 5E.

addresses only those Impacts that are not adequately addressed under existing development .
standards and environmental regulations.
1. Transportation
Impacts: None identified for this non-project legislative action. At the most likely scenario for build-out 75 potential
dwellings could potentially create 750 average vehicle trip ends per week day. There are currently 59 dwellings which
create 590 average vehicle trip ends per week day. Spread out over a number of hours throughout the day this
potential number of trips is not anticipated to have a significant adverse impact on the surrounding area. However,
mitigation can be provided at the ti(Tle there are specific project proposals before the City.
Mitigation Measures: Impacts, if any, are better assessed at the project level.
Nexus: Not applicable.

PROJECT LOCATION: This project abuts the City boundary on three sides: south of S. 55th Street, east
of Talbot Avenue and north of the Springbrook area. It is located in the NE 1/4 of
Section 9, Township 22 North, Range 5 East.
OPTIONAL DETERMINATION OF NON-SIGNIFICANCE (DNS): As the Lead Agency, the City of Renton has determined
that significant environmental impacts are unlikely to result from the proposed non-project action. Therefore, as permitted
under the RCW 43.21 C.11 0, the City of Renton is using the Optional DNS process to give notice that a DNS is likely to be
issued. Comment periods for the project and the 'proposed DNS are integrated into a sjngle comment period. There will
be no comment period following the issiJance of the Threshold Determination of Non-Significance (DNS). A 14-day appeal
period will follow the issuance of the DNS.

Council accepted the proposed Direct Petition to annex at its public hearing on
January 24, 2005 and held the first of two required public hearings on the
proposed prezoning on this same date.
The subject site is located within the Residential Single Family (RS) and
Residential Low Density (RLD) Comprehensive Plan Land Use Map designation.
The proposed prezone is consistent with these land use designations, as well as
relevant land use policies adopted in November 2004.
Environmental Checklist dated March 2, 2005.
This non-project action will be subject to the City's SEPA Ordinance and
Development Regulations and other applicable codes and regulations as
appropriate.
The analysis of the proposed non-project action does not reveal any adverse environmental impacts requiring mitigation
above and beyond existing code provisions. However, mitigation may be necessary and may be imposed at the time of a

PURPOSE OF CHECKLIST:
The State Environmental Policy Act (SEPA), Chapter 43.21C RCW, requires all governmental agencies to
consider the environmental impacts of a proposal before making decisions. An Environmental Impact
Statement (EIS) must be prepared for all proposals with probable significant adverse impacts on the
quality of the environment. The purpose of this checklist is to provide information to help you and the
agency identify impacts from your proposal (and to reduce or avoid impacts from the proposal, if it can be
done) and to help the agency decide whether an EIS is required.
INSTRUCTIONS FOR APPLICANTS:
This environmental checklist asks you to describe some basic information about your proposal.
Governmental agencies use this checklist to determine whether the environmental impacts of your
proposal are significant, requiring preparation of an EIS. Answer the questions briefly, with the most
precise information known, or give the best description you can.
You must answer each question accurately and carefully, to the best of your knowledge. In most cases,
you should be able to answer the questions from your own observations or project plans without the need
to hire experts. If you really do not know the answer, or if a question does not apply to your proposal, write

This non-project action includes pre-zoning approximately 21.2 acres in Renton's Potential
Annexation Area. 4.84 acres (the Anthone annexation site) are currently being considered for
annexation using the 60% Direct Petition method. Under RCW 43.21.C.222 annexations are
specifically exempted from SEPA. RCW 35.A.14.330-340 provides for rezoning potential
annexation areas.

location of your proposed project, including a street address, if any, and section, township, and

The prezone area is south of city limits at S. 55th Street, east of city limits at Talbot Rd. S. and
north of city limits in the Springbrook area. The prezone area is adjacent to city limits on three
sides and the easterly boundary of the area is the eastern boundary line of Section 6, Township
22N, Range 5E. This site includes the Hi-Park 1st Addition, Talbot Estates and Spring Brook
Acres plats, plus the properties owned by Anthone, Molina and Ahluwalia.

proposed zoning regulations would be approximately 187 people. Under King County

Renton prezoning. This compares with 83 units and 830 AWDVTE at maximum development
under King County's zoning. This additional number of trips generated in either the Renton or the

ANTHONE ANNEXATION AND VICINITY PREZONE PROJECT NARRATIVE AND
PROPOSALS~Y
The applicants for the proposed Anthone Annexation have requested that the City prezone the
subject 4.84-acre site in advance of annexation, pursuant to RCW 35A.14.330, so zoning will be
in place at the time the subject site comes into the City. In addition, Renton will ask the
Boundary Review Board to invoke jurisdiction to annex an expanded area. Approximately 25.7
acres of land in the vicinity of the initial Anthone Annexation site form an unincorporated
peninsula surrounded on three sides by Renton City Limits. The area is composed of the Anthone
Annexation site (the Anthone and Molina properties), three fully developed plats (Talbot Estates,
Spring Brook Acres and Hi-Park 1 st Addition), and a portion of the Ahluwalia property that lies
south of S. 55th Street (the portion north of the right of way is within City Limits). Annexation of
either the initial Anthone Annexation site or the expanded area is considered to be exempt from
SEP A. However, the prezoning of the area does require SEP A review.
The City is proposing to prezone a portion of the expanded area R-4 and a portion of it R-8. The
total acreage to be prezoned is 21.2 acres (the gross acreage of the area without the streets). In
the Renton Comprehensive Plan the western portion of the area and the southern portion of the
area, which includes the Anthone and Molina properties, the Talbot Estates plat, and lot nine of
the Spring Brook Acres plat, is designated as Residential Low Density. The eastern portion of the
area, which includes the Spring Brook Acres plat (excepting lot nine), the Hi-Park 15t Addition
plat and the Ahluwalia property, is designated Residential Single Family. In order to be
consistent with the Comprehensive Plan, it is proposed to prezone the portion designated
Residential Low Density as Renton R-4 and to prezone the portion designated Residential Single
Family as Renton R-8. The proposed prezone is considered to be a non-project action under
SEPA.
Tht,: proposed prezoning site is located south of City Limits at S. 55 th Street, east of City Limits at
Talbot Road S., and north of City Limits at the Springbrook watershed site. The area is bounded
on the east by the section line for Section 6, Township 22N, Range 5E. The surrounding zoning
to the north ofthe site includes Renton R-14 residential 14 units per net acre, R-l residential one
unit per net acre and R-8 residential eight units per net acre. The property south of the site is
zoned Renton RC resource conservation. The site itself and the property to the east is zoned King
County R-6 residential six units per gross acre and the areas west of the site is King County R-l
residential one unit per gross acre.
The majority of the expanded annexation area has been fully developed in three plats. Talbot
Estates is fully developed with 17 single-family detached units. Hi-Park 1 st Addition is fully
developed with 15 single-family detached units. Spring Brook Acres is essentially fully
developed with 21 single-family detached units and one five-unit multi-family complex. There is
only one iJndeveloped lot in Spring Brook Acres, lot 9, which is entirely dominated by sensitive
areas and highly unlikely to develop. There is one small lot about 7500 ft2, owned by Ahluwalia,
which lies south ofS. 55 th Street and west of 99th Place S. This is a portion of the same property
north of S. 55th Street, but since the property is divided by a public right-of-way the lot could be
built upon as a separate lot. There are also the Molina and Anthone properties containing one
single-family dwelling: These 4.84 acres account for nearly all of the development potential for
the expanded annexation area.
Anthone Annexation and Vicinity Prezone Justification
The area proposed for prezoning has already been designated for Residential Low Density and
Residential Single Family development in the Renton Comprehensive Plan. King County's
Comprehensive Plan has designated the area for urban development at a density of 4-12 dwelling
units per gross acre. The portion that is designated Residential Single Family should be prezoned
R-8, eight dwelling units per net acre in accordance with Renton's Comprehensive Plan. This
area consists of two fully developed plats, Spring Brook Acres (except for lot 9) and Hi-Park 1 st
Addition, and the unincorporated portion of the Ahluwalia property. The lots range from 1/8-1/2
of an acre in siz~ and are consistent with the density requirements of the R-8 zone. The portion of
the area designated Residential Low Density should be zoned R-4, four dwelling units per net
acre in accordance with Renton's Comprehensive Plan. The low density area is comprised of the
Talbot Estates plat, lot 9 of Spring Brook Acres, and the Anthone and Molina properties. The
Talbot Estates plat has been fully developed with lots ranging from 1/6-113 of an acre and a
resulting density of about five dwelling units per acre. Lot 9 of Spring Brook Acres lies along the
entire southern portion of the prezone area and is dominated by sensitive areas. It is unlikely to
be developed due to critical area limitations. The area of the initial Anthone annexation
application (Anthone and Molina properties) contains only one dwelling unit on 4.84 acres and
basically represents the only developable area to be prezoned. R-4 zoning of this property would
be consistent with the Comprehensive Plan.
