Project Description: The applicants for the proposed Lindberg Annexation have requested that the City
prezone the subject site in advance of annexation, pursuant to RCW 35A.14.330, so zoning will be in place at
the time the subject site comes into the City. The City is proposing to prezone this 9.72 acre proposed
annexation area R-8. This corresponds with the Residential Single Family designation in Renton's
Comprehensive Plan. Whereas the proposed annexation is considered to be a non-project action under SEPA,
the proposed zoning is not.
Location: This site is to the east of 138th Ave SEt Duvall Ave NE, north of 132nd St
SEt NE 2nd St, south of City limits, and extends apprOXimately 200 ft.

The Environmental Review Committee (ERC) has completed their review of the
environmental impacts of the above-referenced project. The Committee, on September 20,
2005, decided the project would be issued a Determination of Non-Significance.
The City of Renton ERC has determined that it does not have a probable significant adverse
impact on the environment. An Environmental Impact Statement (EIS) is not required under
RCW 43.21 C.030(2)(c). This decision was made by the ERC under the authority of Section
4-6-6, Renton Municipal Code, after review of a completed environmental checklist and other
information, on file with the lead agency. This information is available to the public on
request.
Appeals of the environmental determination must be filed in writing on or before 5:00
PM on October 10, 2005. Appeals must be filed in writing together with the required $75.00

Based on analysis of probable impacts from the proposal, staff recommends that the Responsible Officials

In compliance with RCW 43.21 C. 240, the fol/owing non-project environmental review
addresses only those impacts that are not adequately addressed under existing development
standards and environmental regulations.
1. Transportation
Impacts: None identified for this non-project legislative action. At the most likely scenario for build-out 63 potential
dwellings could potentially create 630 average vehicle trip ends per week day. There are already 9 dwellings and
approximately 90 average vehicle trip ends per week day in the area and development of additional units is likely to
occur regardless of the change in zoning. However, mitigation can be provided at the time there are specific project
proposals before the City.
Mitigation Measures: Impacts, if any, are better assessed at the project level.
Nexus: Not applicable.

OPTIONAL DETERMINATION OF NON-SIGNIFICANCE (DNS): As Iho Lead Agency, tho Clly 01 Ronlon has d.l.rmlned
that significant environmental impacts are unlikely to resutt from the proposed zoning. Therefore, as permitted under the
RCW 43.21 C.ll0, the City of Renton is using the Optional DNS process to give notice that a ONS is likely to be Issued.
Comment periods for the project and the proposed DNS are integrated into a single comment period. There will be no
comment period following the issuance of the Threshold Determination of Non-Significance (DNS). A 14-day appeal
period will follow the issuance of the DNS.

December 20, 2004 and held the first of two required public hearings on the
proposed prezonlng on this same date.
The subject site Is located within the Residential Single Family (RS)
Comprehensive Plan Land Use Map designation. The proposed A-a prezone is
consistent with this land use designation, as weI! as relevant land use policies
adopted in November 2004.

I have reviewed the above referenced annexation prezone review submittal and have the
following comments:
The Land Use Permit Master Application, under the "PROJECT/ADDRESS(S)ILOCATION
AND ZIP CODE" block and the "LEGAL DESCRIPTION OF PROPERTY" block, incorrectly
notes the "Section" as "14". The section is actually 15.
The review package includes a "Vicinity Map" that is for the annexation, not the prezone. The
prezone vicinity map should not highlight (or shade) the public streets shown on the annexation
map.

OPTIONAL DETERMINATION OF NON-SIGNIFICANCE (DNS): As the Lead Agency, the City of Renton has determined
that significant environmental impacts are unlikely to result from the proposed zoning. Therefore, as permitted under the
RCW 43.21 C.11 0, the City of Renton is using the Optional DNS process to give notice that a DNS is likely to be issued.
Comment periods for the project and the proposed DNS are integrated into a single comment period. There will be no

Council accepted the proposed Direct Petition to annex at its public hearing on
December 20, 2004 and held the first of two required public hearings on the
proposed prezoning on this same date.
The subject site is located within the Residential Single Family (RS)
Comprehensive Plan Land Use Map designation. The proposed R-8 prezone is
consistent with this land use designation, as well as relevant land use policies
adopted in November 2004.

appropriate.

LINDBERG ANNEXATION PREZONE PROJECT NARRATIVE AND PROPOSAL
SUMMARY
The applicants for the proposed Lindberg Annexation have requested that the City prezone the
subject site in advance of annexation, pursuant to RCW 35A.14.330, so zoning will be in place at
the time the subject site comes into the City. This site is adjacent to City Limits on three sides
and adjacent to the proposed Mosier II annexation proposal on the fourth side. It is bordered by
138 th Ave SElDuvall Ave NE on the west, on the South by 132nd St SE/ NE 2nd St, on the east the
boundary ends approximately 200 ft. east of 140th Ave SE, and on the north the boundary ends at
City Limits. Annexation is considered exempt from SEP A. However, the prezoning of the
subject 9.72-acre area does require SEPA review.
The City is proposing to prezone the proposed annexation area R-8. This corresponds with the
Residential Single Family designation in Renton's Comprehensive Plan. The proposed prezone is
considered a non-project action under SEP A. Surrounding zoning to the north is Renton
Commercial Arterial (CA) and to the east and west of the site is Renton R-8 residential 8 units per
net acre, and King County R-4, residential 4 units per gross acre to the east.
Currently 9 single-family housing units exist in this area. At full build out it is estimated there
will be 63 homes. Since this prezone is a non-project proposal, development of additional
housing units will be subject to additional project specific review at the time of development.
Lindberg Annexation Prezone Justification
The area proposed for prezoning has already been designated for Residential Single Family in the
Renton Comprehensive Plan. King County's Comprehensive Plan has designated the area for
urban development at a density of 4-12 dwelling units per gross acre. R-8 zoning of this property
would be consistent with both Comprehensive Plans. Renton's zoning uses net developable area
to determine project density, not gross developable area. This results in less intensive
development adjacent to sensitive areas. With current bonuses and incentives, King County
zoning at 4 units per gross acre can easily be increased to over 6 units per acre. This is
comparable to Renton's proposed zoning of 8 units per acre.

will limit future development to single-family detached housing currently prevalent in the area.
King County zoning allows both detached and attached units in its R-4 zone. Renton's zoning
uses net developable area to determine project density, not gross developable area. This results
in less intensive development adjacent to sensitive areas. With current bonuses and incentives
King County zoning at 4 units per gross acre can easily be increased to over 6 units per acre.
This is comparable to Renton's proposed zoning of 8 units per net acre.
