C. Project Description / Background:
The applicant, Bruce Bell, is requesting approval of an administrative variance from the
required front yard setback in the R-8 zone (section 4-2-110A). The subject site is located at
431 Renton Avenue South.
The site is 8,430 square feet in area. Abutting the lot at the northeastern corner is City of
Seattle Cedar River Pipeline right-of-way that runs through Renton from the southeast to the
northwest. The otherwise rectangular lot has the appearance of having lost its northeastern
corner to the City of Seattle Cedar River Pipeline right-of-way.
The site is currently developed with a two-story 3,880 square foot house built in 2000. The
existing house is located approximately 8 feet from the front lot line.
The development standards of the R-8 zone require a minimum front yard setback of 15 feet
for the primary structure and 20 feet for garages. The setback is measured from the property
line to the closest point of the structure. The applicant is proposing a reduction of the
minimum front yard setback for the primary structure to 6 feet.
The project meets all other R-8 development standards including: maximum building height,
lot coverage, rear and interior side yard setbacks.
FINDINGS, CONCLUSIONS & DECISION
Having reviewed the written record in the matter, the City now makes and enters the
following:
D. Findings
1) Request: The applicant, Bruce Bell, has requested approval for an administrative
variance from RMC 4-2-110A in order to reduce the required 15-foot front yard
setback for the primary structure in the R-8 zone for the property located at 431
Renton Avenue South. A 6 foot front yard setback is being requested.

2) Administrative Variance: The applicant's administrative variance submittal materials
comply with the requirements necessary to process a variance. The applicant's site
plan and other project drawings are entered as Exhibits No.1 through 5.
3) Existing Land Use: Land use surrounding the subject site is single-family residential
on all sides. City of Seattle Cedar River Pipeline right-of-way abuts the lot to the
northeast.
4) Existing Site Conditions: The existing residence is 8 feet from the front lot line.
5) Zoning: The site is located in the Residential - 8 (R-8) dwelling units per acre zone.
The development standards for this zone require a 15-foot front yard setback for the
primary structure, 20-foot front yard setback for the garage, 20-foot rear yard setback
and 5-foot interior side yard setback. Maximum lot coverage for lots over 5,000
square feet in size is 35% or 2,500 square feet, whichever is greater.
6) Topography: The site slopes approximately 18% downward from southeast to
northwest.
7) Lot and Building Size: The site is 8,249 square feet in size. The existing two-story
3880 square foot residence has a building footprint of 2,220 square feet. The addition
would be 161 square feet. Building lot coverage for this site would be 29% with the
addition.
8) Consistency With Variance Criteria:
Section 4-9-250B.5.a. Lists 4 criteria that the Zoning Administrator must consider,
along with all other relevant information, in making a decision on an Administrative
Variance application. These include the following:
The Zoning Administrator shall have authority to grant an administrative variance upon
making a determination, in writing, that the conditions specified below have been
found to exist:
a. That the applicant suffers undue hardship and the variance is necessary
because of special circumstances applicable to subject property, including
size, shape, topography, location or surroundings of the subject property,
and the strict application of the Zoning Code is found to deprive subject
property owner of rights and privileges enjoyed by other property owners in
the vicinity and under identical zone classification:
The applicant contends that special circumstances apply to the subject site, which
impose limitations on the lot. Specifically, the applicant indicates that the lot is
oddly shaped and constrained by the City of Seattle Cedar River Pipeline right-of-
way. The otherwise rectangular lot has the appearance of having lost its
northeastern corner to the City of Seattle Cedar River Pipeline right-of-way. Thus
the use of the front of the lot is limited more than other lots along Renton Avenue
South. Therefore, the applicant is requesting to encroach into the front yard
setback nine feet with the addition, resulting in a front yard setback of 6 feet.
b. That the granting of the variance will not be materially detrimental to the
public welfare or injurious to the property or improvements in the vicinity and
zone in which subject property is situated:
The applicant contends that the addition would be hardly visible to neighbors
because of its small size, its location and the.topography at the front of the lot. The
addition would be a 161 square foot, one-story structure attached to the lower floor
of the main structure. It would only extend two feet further into the setback than
the house, which is located 8 feet from the front lot line. It would only be an
incremental change over the existing conditions. The proposed mud-room would

be constructed at the level of the daylight basement and thus low enough that it
would not obstruct views from neighboring properties or the street. The addition
appears to be designed in keeping with the existing house, with elevations showing
lap siding, windows and a glass door. It is staff's opinion that granting of the front
yard variance would not be detrimental or injurious to the public and neighbors.
c. That approval shall not constitute a grant of special privilege inconsistent
with the limitation upon uses of other properties in the vicinity and zone in
which the subject property is situated:
Due to the unusual shape of the lot, most lots in the vicinity are not as limited by
the setbacks in the R-8 zone as the subject lot. Of the few lots with similar
problems because of their location along the City of Seattle Cedar River Pipeline
right-of-way, several have structures that have been located closer than 15 feet to
the sidewalk. Recognizing the existing encroachments, the addition would only be
an incremental expansion into the setback.
d. That the approval as determined by the Zoning Administrator is a minimum
variance that will accomplish the desired purpose:
The addition is proposed to an existing residence, so placement of the room was
dictated by the existing floor plan of the home. Placement of the addition at the
rear of the house, where there is more buildable area, would not allow the addition
to serve the intended purpose. Approving a setback of 6 feet from the front
property line is the minimum necessary to allow the applicant to build a mud-room
onto his existing home.
E. Conclusions
1. The subject site is located at 431 Renton Avenue South, within the Residential - 8
Dwelling Units per Acre (R-8) zoning deSignation.
2. The R-8 zone requires a minimum 15-foot front yard setback from the lot line for the
primary structure and 20-foot front yard setback for the garage (section 4-2-110A).
The applicant is proposing a 9-foot reduction of this requirement to 6 feet for an
addition to the primary structure.
3. The analysis of the proposal according to variance criteria is found in the body of the
Staff Report.
F. Decision
The Administrative Setback Variance for Bell Setback Variance, File No. LUA05-105, V-
A is approved.

The administrative land use decision will become final if the decision is not appealed within 14 days of the date of
approval. An appeal of the decision must be filed within the 14 day appeal period (RCW 43.21.C.075(3); WAC
197-11-680). An appeal to the Hearing Examiner is governed by Title IV, Section 4-8-11.B, which requires that
such appeals be filed directly with the Hearing Examiner via the City of Renton City Clerks Office. Appeals must
be made in writing on or before 5:00 PM on October 21, 2004. Any appeal must be aCCQmpanied by a
$75.00 fee and other specific requirements.
THE APPEARANCE OF FAIRNESS DOCTRINE provides that no ex parte (private one-on-one) communications
may occur concerning the land use decision. The Doctrine applies not only to the initial decision, but to Appeals
to the Hearing Examiner as well. All communications after the decision/approval date must be made in writing
through the Hearing Examiner. All communications are public record and this permits all interested parties to
know the contents of the communication and would allow them to openly rebut the evidence in writing. Any
violation of this doctrine could result in the invalidation of the appeal by the Court.

Justification for variance request AUG 26 2005
I am requesting this variance for the purpose of building a mud room so that I RECEIVED
And guests may enter my home without tracking dirt, rain, mud, etc. directly
Onto the carpet while entering the home. I am a single guy and I am tired of
Cleaning up!! I had been planning to include it during the original construction
But somehow it fell through the cracks. The foundation was included in the
Original construction and is already in place, but has been serving only as a
Patio up to this point.
The reason for the variance request is because construction of this room would
Push the limits of the "setback" criteria on the northeast corner. The lot would
Normally be rectangular and there would be no problem, but because it fronts
Beacon Way South on Renton Hill, the northeast corner of the lot is chopped off.
Beacon Way South is a right of way for a Main water line feed located under the
Street. Construction of this room would impact no one and present no environ-
Mental concerns. The room would not encroach on anyone's property, would not
Affect anyone's view, and would have no impact on Beacon Way South whatsoever.
In fact, I seriously doubt if anyone would even notice that it had been built because
Of its location and small footprint.
