C. Project Description / Background:
The applicant is requesting approval of an administrative variance from the rear yard setback
of 20 feet required in the Residential - 8 units per acre (R-8) zone. Surrounding properties
are zoned R-8. The applicant has constructed a 537 sq. ft. deck with sfeps and railings,
approximately 41 ft. by 21 ft. in size, that is attached to the existing single-family residential
home at the rear ground floor or finished basement level. The deck extends from the house
to 6 feet from the rear property line. Per RMC 4-2-11 OA, the rear yard setback for properties
zoned R-8 is 20 ft., although uuncovered steps and decks not exceeding 18 inches above
the finished grade may extend to the property line. The rear edge of the deck, which is
constructed on a slope, is approximately 1 ft. high at the lowest point (west side) and 4 ft. 4
in. high at the highest point (east side).
According to building records, the existing home was constructed in 1999 with an approved
140 sq. ft. attached deck on the second floor level, which is still present above the new deck.
An attached concrete patio, approximately 540 sq. ft. in size, was also constructed at the
rear ground floor or finished basement level, and has been incorporated into the design of
the new deck.
FINDINGS, CONCLUSIONS & DECISION
Having reviewed the written record in the matter, the City now makes and enters the
following:
D. Findings
1) Request: The applicant has requested approval for an administrative variance from
the required 20-ft. rear yard setback in the R-8 zone for the property located at 320
S. 20th Place. A 6-ft. rear yard setback is requested.

2) Administrative Variance: The applicant's administrative variance submittal materials
comply with the requirements necessary to process a variance. The applicant's site
plan and other project drawings are provided as Exhibits 3-5.
3) Existing Land Use: Land uses surrounding the subject site include: North: single-
family residential (R-8); South: single-family residential (R-8); East single-family
residential (R-8); and West: single-family residential (R-8).
4) Zoning: The site is located in the Residential - 8 units per acre (R-8) zone. The
development standards for this zone require a 20-ft. rear yard setback, although
uuncovered steps and decks not exceeding 18 inches above the finished grade may
extend to the property line. The applicant is requesting approval for a deck that is 4
ft. 4 in. at maximum height and extends to 6 ft. from the rear property line.
4) Topography: The topography of the site slopes Significantly from south to north.
5) Lot and Building Size: The lot area is 4,517 sq. ft. with a 2,230 sq. ft. single-family
home. The new deck area is approximately 537 sq. ft.
CONSISTENCY WITH VARIANCE CRITERIA
Section 4-9-2508.5.a. lists four criteria that the Zoning Administrator is asked to consider,
along with all other relevant information, in making a decision on an Administrative Variance
application. The Zoning Administrator shall have authority to grant an administrative
variance upon making a determination, in writing, that the conditions specified below have
been found to exist:
a. That the applicant suffers undue hardship and the variance is necessary
because of special circumstances applicable to subject property, including
size, shape, topography, location or surroundings of the subject property, and
the strict application of the Zoning Code is found to deprive subject property
owner of rights and privileges enjoyed by other property owners in the vicinity
and under identical zone classification:
The applicant contends that special circumstances apply to the subject site, which
impose limitations on the lot and create a hardship. SpeCifically, the applicant
indicates that because of the sloping topography, they are prevented from having a
useable back yard area where they can enjoy their outdoor space.
The existing house currently has an approved upper deck and concrete patio which
were constructed with the house, and which provide areas for outdoor enjoyment.
The applicant can construct a smaller deck or a stepped deck which would be less
than 18 in. above grade, or create a level yard with fill and a retaining wall, and then
construct a deck in the resulting area that meets code requirements. In this case,
the applicant is creating a hardship by proposing to construct a deck that does not
meet code requirements. If the applicant revised the deck size, design and/or
location, setback requirements could be met and the need for a variance would be
eliminated. If fill and a retaining wall are proposed, permits for grading and building
may be required.

b. That the granting of the variance will not be materially detrimental to the
public welfare or injurious to the property or improvements in the vicinity and
zone in which subject property is situated:
The proposed reduction of the rear yard setback to 6 feet would be a 70%
reduction of the 20-foot setback, which is intended to buffer neighboring single-
family residential properties from the impacts of adjacent development and provide
rear yard privacy. The setback reduction to 6 feet would result in reduced quality of
life for neighboring residents. Although the property to the rear of the subject site is
a large lot that is currently being used for horse pasturage, in future it will likely be
subdivided and developed with single-family residential homes, consistent with its
R-8 zoning and Comprehensive Plan designation of Single Family Residential.
c. That approval shall not constitute a grant of special privilege inconsistent
with the limitation upon uses of other properties in the vicinity and zone in
which the subject property is situated:
The approval of the variance request would be a grant of special privilege, as other
property owners in the vicinity would not be allowed to reduce setback
requirements when the stated hardship is self-imposed by the size and design of
the project.
d. That the approval as determined by the Zoning Administrator is a minimum
variance that will accomplish the desired purpose:
The applicant contends that the request is a minimum variance needed in order to
construct a deck and have a useable rear yard area. However, as previously
noted, the existing house already has an upper deck and concrete patio which
allow use of the outdoor area. The applicant could construct a smaller or stepped
deck which would be less than 18 in. above grade, or create a level yard with fill
and a retaining wall, and then construct a deck in the resulting area that would
meet code requirements without a variance. If fill and a retaining wall are
proposed, permits for grading and building may be required.
E. Conclusions
1. The subject site is located at 320 S. 20th Place, within the Residential - 8 units per
acre (R-8) zoning designation.
2. The R-8 zone requires a minimum 20 rear yard setback. The applicant is proposing
a reduction of the setback to 6 feet.
3. The proposal has been analyzed according to the four variance criteria as described
above. The variance request does not satisfy the criteria for granting the variance, in
that it does not meet the hardship test, the public welfare test, the special privilege
test, or the minimum variance test. The proposal's stated hardship is self-imposed
due to the size and location of the proposed development. It is anticipated that
negative impacts to surrounding single-family properties would result from the effect
of the requested variance The variance would constitute a grant of special privilege
that would not be allowed for other property owners in the vicinity. A revised deck
plan could be built on the site without the requested variance.

The administrative land use decision will become final if the decision is not appealed within 14 days of the date of
approval. An appeal of the decision must be filed within the 14 day appeal period (RCW 43.21.C.075(3); WAC
197-11-680). An appeal to the Hearing Examiner is governed by Title IV, Section 4-8-11.B, which requires that
such appeals be filed directly with the Hearing Examiner via the City of Renton City Clerks Office. Appeals must
be made in writing on or before 5:00 PM on October 28, 2005. Any appeal must be accompanied by a
$75.00 fee and other specific requirements.
THE APPEARANCE OF FAIRNESS DOCTRINE provides that no ex parte (private one-on-one) communications
may occur concerning the land use decision. The Doctrine applies not only to the initial decision, but to Appeals
to the Hearing Examiner as well. All communications after the decision/approval date must be made in writing
through the Hearing Examiner. All communications are public record and this permits all interested parties to
know the contents of the communication and would allow them to openly rebut the evidence in writing. Any
violation of this doctrine could result in the invalidation of the appeal by the Court.

RECI=/VFD We would like to request a variance due to the fact that we have a non-useable backyartl',
due to topography. The property has slope that prevents us from having an area that we
can enjoy the outdoors. Neighboring properties has similar slope but they were allowed
to construct similar decks and additions which allows them to make use of the outdoor
space and backyard.
Granting this variance will not be materially detrimental to the public welfare of other
property owners since the backyard backs up to a gravel driveway and a horse pasture.
