Awards: Free Speed Camp T-shirts for all in August Questions: Contact Mike at (206) 852-1454 We work core muscles in order to strengthen the mid-section to help with speed, and avoid injuries. We instruct in stretching, agility training, speed, and ballistic (power movement) drills. The training is designed to help the student athlete's coordination, base power, and overall speed. The training is effective for all athletes. The mental side of sports is also addressed during drills. This is the type of training used in university, Olympic, and professional level athletics. We are adapting the techniques for high school athletes and kids down to age ten. The earlier proper ballistic training is learned, the better you can do. Coaches: Mike Gunn played linebacker at Boston College('77' 81), and is currently coaching football at Renton H.S. and baseball with the Kent Bulldogs. James Norris graduated from Western Illinois University in 2005, where he excelled, averaging 154.1 all, purpose yards per game as a wide receiver and kick returner, and earning academic all-conference honors. This summer he is a football free agent seeking opportunities in the NFL and CFL. Brad Sessler ran track at Seattle Pacific University('89-90) and coaches junior football on Mercer Island. Matt Topping graduated from UW in 2004, where he ran track. He coaches at Northwest College. Jack Hovt was All'American in track at Seattle Pacific University. He competed in the decathalon in the 92' Olympic Trials, 3 U.S. National Championships, held the U.S. decathalon high jump record at 7'-2"3/4, and is currently the head track coach at Seattle Pacific University. FILING REQUIREMENTS In your exemption letter we indicated whether you must file Form 990, Return of Organization Exempt From Income Tax. UNRELATED BUSINESS INCOME TAX RETURN If you receive more than $1,000 annually in gross receipts from a regular trade or business you may be subject to Unrelated Business Income Tax and required to file Form 990-T, Exempt Organization Business Income Tax Return. There are several exceptions to this tax. 1. Income you receive from the performance of your exempt activity is not unrelated business income. 2. Income from fundraisers conducted by volunteer workers, or where donated merchandise is sold, is not unrelated business income. 3. PUBLIC INSPECTION OF APPLICATION AND INFORMATION RETURN You are required to make your annual information return, Form 990 or Form 990-EZ, available for public inspection for three years after the later of the due date of the return, or the date the return is filed. FUNDRAISING Contributions to you are deductible only to the extent that they are gifts and no consideration is received in return. Depending on the circumstances, ticket purchases and similar payments in conjunction with fundraising events may not qualify as fully deductible contributions. CONTRIBUTIONS uF HORE THAN $75 AND CHARITY PROVIDES GOODS OR SERVICES You must provide a written disclosure statement to donors who receive goods or services from you in exchange for contributions in excess of $75. Contribution deductions are allowable to donors only to the extent their contributions exceed the value of the goods or services received in exchange. Ticket purchases and similar payments in conjunction with fundraising events may not necessarily qualify as fully deductible contributions, depending on the circumstances. If your organization conducts fundraising events such as benefit dinners, shows, membership drives, etc., where something of value is received, you are required to provide a written statement informing donors of the fair market value of the specific items or services you provided in exchange for contributions of more than $75. You should provide the written disclosure statement in advance of any event, determine the fair market value of any benefit received, determine the amount of the contribution that is deductible, and state this information in your fundraising materials such as solicitations, tickets, and receipts. The amount of the contribution that is deductible is limited to the excess of any money (and the value of any property other than money) contributed by the donor less the value of goods or services provided by the charity. Your disclosure statement should be made, no later than, at the time payment is received. Subject to certain exceptions, your disclosure responsibility applies to any fundraising circumstances where each complete payment, including the contribution portion, exceeds $75. For additional information, see Publication 1771 and Publication 526, Charitable Contributions. EXCESS BENEFIT TRANSACTIONS Excess benefit transactions are governed by section 4958 of the Code. Excess benefit transactions involve situations where a section 501(c) (3) organization provides an unreasonable benefit to a person who is in a position to exercise substantial influence over the organization's affairs. If you believe there may be an excess benefit transaction involving your organization, you should report the transaction on Form 990 or 990-EZ. EMPLOYMENT TAXES If you have employees, you are subject to income tax withholding and the social security taxes imposed under the Federal Insurance Contribution Act (FICA). You are required to withhold Federal income tax from your employee's wages and you are required to pay FICA on each employee who is paid more than $100 in wages during a calendar year. To know how much income tax to withhold, you should have a Form W-4, Employee's Withholding Allowance Certificate, on file for each employee. Organizations described in section SOl(c) (3) of the Code are not required to pay Federal Unemployment Tax (FUTA). Employment taxes are reported on Form 941, Employer's Quarterly Federal Tax Return. The requirements for withholding, depositing, reporting and paying employment taxes are explained in Circular E, Employer's Tax Guide, (Publication 15), and Employer's Supplemental Tax Guide, (Publication IS-A). These publications explain your tax responsibilities as an employer. CHURCHES Churches may employ both ministers and church workers. Employees of churches or church-controlled organizations are subject to income tax withholding, but may be exempt from FICA taxes. Churches are not required to pay FUTA tax. In addition, although ministers are generally common law employees, they are not treated as employees for employment tax purposes. These special employment tax rules for members of the clergy and religious workers are explained in Publication 517, Social Security and Other Information for Members of the Clergy and Religious Workers. Churches should also consult Publications 15 and IS-A. Publication 1828, Tax Guide for Churches and Religious Organizations, also discusses the various benefits and responsibilities of these organizations under Federal tax law. PUBLIC CHARITY STATUS Every organization that qualifies for tax-exemption as an organization described in section 501(c) (3) is a private foundation unless it falls into one of the categories specifically excluded from the definition of that term [referred to in section 509 (a) (1), (2), (3), or (4) 1. In effect, the definition divides these organizations into two classes, namely private foundations and public charities. Public charities are generally those that either have broad public support or actively function in a supporting relationship to those organizations. Public charities enjoy several advantages over private foundations. There are certain excise taxes that apply to private foundations but not to public charities. A private foundation must also annually file Form 990-PF, Return of Private Foundation, even if it had no revenue or expenses. Letter 1045 (DOjCG) -7- HARAMBEE COMMUNITY DEVELOPMENT The Code section under which you are classified as a public charity is shown in the heading of your exemption letter. This determination is based on the information you provided and the request you made on your Form 1023 application. Please refer to Publication 557 for additional information about public charity status. GRANTS TO INDIVIDUALS The following information is provided for organizations that make grants to individuals. If you begin an individual grant program that was not described in your exemption application, please inform us about the program. Funds you distribute to an individual as a grant must be made on a true charitable basis in furtherance of the purposes for which you are organized. Therefore, you should keep adequate records and case histories that demonstrate that grants to individuals serve your charitable purposes. For example, you should be in a position to substantiate the basis for grants awarded to individuals to relieve poverty or under a scholarship or education loan program. Case histories regarding grants to individuals should show names, addresses, purposes of grants, manner of selection, and relationship (if any) to members, officers, trustees, or donors of funds to you. The Harambee Church consists of two parcels, the site is zoned Center Downtown (CD) and located within the Urban Center-Downtown Comprehensive Plan Designation. The Harambee Church proposes to utilize the site (the former Renton Eagles building) for church related uses. Community Development programs will also be offered. The existing structure is one story and totals approximately 10,650 square feet. Proposed improvements to the structure are improvements that are required by the City's adopted building codes, ADA requirements and some cosmetic changes. In addition Fire Codes require the applicant to upgrade the structure with a fire sprinkler system. No additions to the structure are proposed. The existing on-site parking will be utilized and the church is currently in negotiations with the neighboring mortuary for a joint use parking agreement. The project does comply with the policies concerning religious facilities. The project, however, does not reflect the density and intensity desired in the Urban Center-Downtown, the intensity of the proposed church is greater than that of past uses of the property. The current building does comply with the building lot coverage requirements. The building does not exceed the 95-foot height limit and no exterior building alterations are proposed as part of this conditional use permit. The existing structure does comply with the setback requirements with the exception of the front yard setback requirement. The church is located within the required front yard I O-foot setback, however, the building is existing and is a legal non-conforming structure and staff does not recommend the applicant to retrofit the building to meet compliance requirements. The site plan shows 23 on-site parking spaces, one of which is a handicap accessible space. The impact of the proposed church on the existing parking lot is not likely to exceed the impact of the Renton Eagles Club. The site is currently developed and no landscaping, street or utility improvements are required for this proposal. Bryan Nelson, 3223 S 1361h Street, Tukwila, W A 98168 stated that he is the Administrator for the church. The structure height is approximately 20-25 feet at the highest point. The parking agreement with the mortuary is still in process. The mortuary is a large international corporation and the parking agreement is somewhere in the corporation. He has spoken with the general manager of the mortuary and they most likely will reach an agreement. The Eagles did have a parking agreement with the mortuary. The services at the mortuary seem to be mostly on Saturday's and should not conflict with the church's services. Michael Gunn, 7641 S 1341h Street, Seattle, WA 98178 stated that he is one of the pastors of the church and wanted to confirm some of the projects they are working on. The idea behind the church is that it is more community development than church. They want to provide a place for teenagers and children to be able to come and have art and music programs, and sports programs. Their vision is much larger than just a church in the area. They are developing a solid quality mentorship program and tutoring program close to Renton High SchooL The Examiner called for further testimony regarding this project. There was no one else wishing to speak, and no further comments from staff. The hearing closed at 9:24 a.m. FINDINGS, CONCLUSIONS & RECOMMENDATION Having reviewed the record in this matter, the Examiner now makes and enters the following: Harambee Church Conditiona File No.: LUA-05-064, CU-H July 18,2005 Page 3 FINDINGS: e Permit 1. The applicant, Bryan Nelson, filed a request for a Conditional Use permit to establish a church in an existing building. 2. The yellow file containing the staff report, the State Environmental Policy Act (SEPA) documentation and other pertinent materials was entered into the record as Exhibit # 1. 3. The Environmental Review Committee (ERC), the City's responsible official determined that the proposal was exempt from SEPA review. 4. The subject proposal was reviewed by all departments with an interest in the matter. 5. There was no opposition from the public regarding the subject proposal. 6. The subject site is located at 316 South 3rd Street. The subject is also bounded by Whitworth A venue South along a portion of its east property line. Shattuck Avenue South is located west of the subject site. 7. The map element of the Comprehensive Plan designates the area in which the subject site is located as suitable for the development of Urban Center -Downtown uses, that is mixed urban residential and commercial uses in a high density environment, but does not mandate such development without consideration of other pol icies of the Plan. 8. The subject site is currently zoned CD (Center Downtown). 9. The subject site was annexed to the City with the adoption of Ordinance 156 enacted in M~y 1909. 10. The subject site is approximately 0.47 acres or 20,628 square feet. The subject site is an ilL-shaped" parcel that wraps around a third-party building that is located on the corner of S 3rd and Whitman. 11. The existing building had been used as the Renton Eagles Hall. 12. The subject site is essentially level. 13. The applicant proposes establishing a church in the existing 10,658 square foot building. The applicant proposes no expansion of the building. The building will meet current Building and Fire Codes. 14. The church would use the on-site parking lot. The church has also entered into negotiations to use the parking lot of the westerly adjacent funeral home. The former Eagles had a similar arrangement. The applicant also indicated that the nearby public parking garage could also serve their membership. 15. The applicant applied for the Conditional Use permit needed to establish a church at this location. 16. The church would provide a sanctuary, bookstore, offices, kitchen and storage space. Services would include prayer, daycare, worship concerts and counseling. There would also be a cafe. 17. Buildings in the CD Zone may be 95 feet tall whereas the current structure is between 20 to 25 feet tall. The current footprint takes up approximately 51.7 percent of the site whereas lot coverage of65 percent is permitted. 18. Access to the site is provided from Whitworth. It fronts along the 3rd Street arterial. 19. The use requires 1 parking stall for each 5 seats. The proposed use will provide 23 on-site parking stalls and with joint use of the funeral parking, an additional 22 stalls. This would accommodate approximately 200 or more parishioners. 20. Utility infrastructure will be unchanged by the new use. The City provides stormwater, sewer and domestic water to the site. CONCLUSIONS: 1. The applicant, for a Conditional Use Permit, must demonstrate that the use is in the public interest, will not impair the health, safety or welfare of the general public and is in compliance with the criteria found in Section 4-9-030.G which provides in part that: a. The proposal generally conforms to the Comprehensive Plan; b. There is a general community need for the proposed use at the proposed location; c. There will be no undue impacts on adjacent property; d. The proposed use is compatible in scale with the adjacent uses, if any; e. Parking, unless otherwise permitted, will not occur in the required yards; f. Traffic and pedestrian circulation will be safe and adequate for the proposed project; g. Noise, light and glare will not cause an adverse affect on neighboring property; h. Landscaping shall be sufficient to buffer the use from rights-of-way and neighboring property where appropriate; and I. Adequate public services are available to serve the proposal. The requested conditional use appears justified and should be approved 2. The Comprehensive Plan designates this site for intense commercial and residential uses befitting the City's downtown core. The plan also permits churches in most zones of the City. The one-stury church is not a very intense use but is merely reusing an existing building. It also allows the establishment of a church along an urban corridor lessening the potential impacts on lower-key residential neighborhoods where the spillover effects of churches can be more of a problem. The proposed use is compatible with the Comprehensive Plan. 3. This office generally avoids making determinations about community need when reviewing religious institutions. It is probably an inappropriate criteria given the variety of religious denominations that exist. There are other criteria that can be used to determine if the use is appropriate or intrusive, this one seems inappropriate for governmental review. The church will occupy a building that has handled larger gatherings in the recent past. The building is only one-story and will not be expanded limiting its impacts on neighbors or the streetscape. 5. The building already exists and the change in use makes it no less compatible than it was. Its setbacks are pre-existing conditions and apparently created no problems in the past. Of course, reuse of the existing facility probably does delay the day when a more intense use is developed on this urban parcel. 6. The parking seems adequate and existing circulation patterns are more than adequate. The road system can probably handle this use and arterial access is generally preferred for any type of place of public assembly. 7. There should not be any adverse noise, light or glare problems. 8. In addition, the structure would be upgraded with a fire sprinkler system as required by the City's fire department. No additions are proposed to the structure. The current building footprint of the structure is approximately 10,658 square feet, which equates to a building lot coverage of 51.7% (building footprint of 10,658 square feet / lot size of 20,628 square feet = 51.7%). The site fronts on S 3rd Street and Whitworth Avenue S, which abuts the eastern and southern property lines of the subject site. The subject site abuts commercially zoned properties along its northern and western property lines. The church proposes to utilize the existing onsite parking lot for the parking required for a church use. The church is in negotiations with the abutting Mortuary located to the west of the subject site for a joint use parking agreement. In addition, the church proposes to use the City's parking garage if the parking demand exceeds the existing capacity. 2. STAFF REVIEW COMMENTS Representatives from various city departments have reviewed the application materials to identify and address site plan issues from the proposed development. These comments are contained in the official file, and the essence of the comments has been incorporated into the appropriate sections of this report and the Departmental Recommendation at the end of the report. 5. CONSISTENCY WITH CONDITIONAL USE CRITERIA: hexrpt.doc Section 4-9-030.G lists 11 criteria that the Hearing Examiner is asked to consider, along with all other relevant information, in making a decision on a Conditional Use application. These include the following: (1) CONSISTENCY WITH THE COMPREHENSIVE PLAN, ZONING CODE & OTHER ORDINANCES: The proposed use shall be compatible with the general purpose, goals, objectives and standard of the Comprehensive Plan, the Zoning Ordinance and any other plan, program, map or ordinance of the City of Renton. (a) Comprehensive Plan Land Use Element The subject site is designated Urban Center -Downtown (UC-D) on the City's Comprehensive Plan Land Use Map. The Urban Center -Downtown (UC-D) is expected to redevelop as a destination shopping area providing neighborhood, citywide, and sub- regional services and mixed-use residential development. UC-D residential development is expected to support urban scale multi-family projects at high densities, consistent with Urban Center policies. Projects in the UC-D are expected to incorporate mixed-uses including retail, office, residential, and service uses that support transit and further the synergism of public and private sector activities. In the surrounding neighborhoods, infill urban scale townhouse and multi-family residential developments are anticipated. Site planning and infrastructure will promote a pedestrian scale environment and amenities. The following Comprehensive Plan Land Use policies are applicable to the proposal: Objective LU-OO: Create a balance of land uses that contribute to the revitalization of downtown Renton and, with the designated Urban Center -North, fulfill the requirements of an Urban Center as defined by Countywide Planning Policies. The proposal will contribute to the revitalization of downtown Renton as the proposed church use and subsequent accessory uses will result in a more intensive uses of the site than the previous Renton Eagles Hall (social service organization) did. However the proposed church use does not provide the level of intensity of a land use within an Urban Center as defined by Countywide Planning Policies as the proposal will not provide a minimum of 15,000 jobs within one-half mile of a transit center, an average of 50 employees per gross acre, and an average of 15 households per gross acre. Policy LU-217. Development and redevelopment of Urban Center Downtown should strive for urban density and intensity of uses. The proposed church use at the subject site will provide and increase in intensity from the previous use by the Renton Eagles Club, however the level of intenSity proposed is less than an urban intensity, which is desired within the downtown. Policy LU-219. Projects in the Urban Center -Downtown should achieve an urban density and intensity of development that is greater than typical suburban neighborhoods. The proposal would create an intensity that is greater than typical suburban neighborhoods and is greater than the previous intensity provided by the Renton Eagles Club as in addition to church services many accessory uses including mentoring, tutoring, arts, fitness, recovery programs, counseling services, and some retail sales in the form of a bookstore/cafe. However, the existing structure does not meet the characteristics of urban intensity as the structure is limited to one story, does not provide structured parking, and does not contain an urban plaza or amenity within the building. Objective LU-X: Site religious and ancillary facilities in a manner that provides convenient transportation access and minimized their adverse impacts on adjacent land uses. The proposed church would be accessed directly off of Whitworth Avenue S, a public right-of-way. The submitted materials indicate that church services would be held on weekends and evening, which minimizes the impacts of the church on adjacent businesses operating during typical business hours. Policy LU-10S. Parking should be provided on-site and buffered from adjacent uses. The proposed church would utilized the existing on-site parking, in addition the church is negotiating a joint parking agreement with the abutting property owner to use their spaces during church services. Policy LU-32S. Encourage shared parking to use urban land efficiency. In addition to the parking provided on-site, the church is negotiating a joint parking agreement with the abutting property owner to use their spaces during church services, and the church may utilize some of the parking spaces in the City owned parking garage located nearby for overflow parking. (b) Zoning Code The proposed church use is located within the Center Downtown (CD) zoning designation. The purpose of the Center Downtown Zone (CD) is to provide a mixed-use urban commercial center serving a regional market as well as high-density residential development. The proposed church use would be permitted in the CD zone subject to approval of a Hearing Examiner Conditional Use Permit. (c) Development Standards The Center Downtown (CD) development standards require a minimum front yard setback (S 3rd Street) of 10 feet for the first 25 feet of building height and 15 feet for that portion of the building over 25 feet in height. A 15 foot side yard along a street setback is required for buildings that are 25 feet or less in height and none is required for that portion of the building over 25 feet in height. No rear or side yard setbacks are required as the property is not adjacent to or abutting a property that is zoned residential. The existing structure meets the side and rear yard setback requirements, however the structure is located entirely within the front yard setback. The existing structure is a pre- existing legal non-conforming use and no exterior additions are proposed as a part of this proposal, therefore the proposed change of use from the Renton Eagles Hall to a church does not expand the existing non-conformity and the applicant is not required to retrofit the structure to comply with the front yard setback requirements. The Center Downtown (CD) zone permits a maximum lot coverage for buildings of 65% of the total lot area or 75% if the parking is provided within the building or within an on- site parking garage. Buildings in the Center Downtown (CD) zone are permitted up to a maximum building height of 95 feet, except when the lot abuts a residential zone, then the maximum height permitted is 20 feet above the maximum height permitted in the abutting residential zone. The subject site is not adjacent to a residentially zoned property; therefore the maximum height permitted is 95 feet. The applicant was not required to submit building elevations, as the proposed church will be located within an existing building. Therefore, staff was unable to determine the height of the building, however based on a site visit and the submitted photograph the existing building is 1 story and does not exceed the 95-foot height limit. No exterior building alterations are proposed as part of this conditional use permit. (2) COMMUNITY NEED: There shall be a community need for the proposed use at the proposed location. In the determination of community need, the Hearing Examiner shall consider the following factors, among all other relevant information: (a) The proposed location shall not result in either the detrimental over concentration of a particular use within the City or within the immediate area of the proposed use. The immediate vicinity of the subject site is primarily surrounded by various commercial uses. The applicant has indicated that this proposed church is intended to serve the entire community and would not result in the detrimental over concentration of this use within the City or within the immediate area of the site. Furthermore, as the subject site was previously used by the Renton Eagles as a place of assembly, the proposed church use is not expected to dramatically increase noise, odor, traffic, or produce other adverse impacts to surrounding properties. (b) That the proposed location is suited for the proposed use. The subject site is located within the commercially zoned downtown area of Renton. The location is suitable for the proposed use, as the church would not be situated immediately adjacent to less intensive uses; therefore neighboring properties should not be adversely impacted. In addition, the proposed church and other accessory uses would increase the intensity of the use at the subject site, which is desired in the downtown area. (3) EFFECT ON ADJACENT PROPERTIES: The proposed use at the proposed location shall not result in SUbstantial or undue adverse effects on adjacent property. The following site requirements shall be required: (a) Lot Coverage: Lot coverage shall conform to the requirements of zone in which the proposed use is to be located. The CD zoning designation has a maximum building coverage of 65% of the total lot area or 75% of the lot area if parking is provided within the building or within an on-site parking garage. The existing building currently has a building lot coverage totaling approximately 51.7%, which is within the allowed building coverage for the CD zone, and would not be modified as result of this proposal. (b) Yards: Yards shall conform to the requirements of the zone in which the proposed use is to be located. Additions to the structure shall not be allowed in any required yard. The Center Downtown (CD) development standards require a minimum front yard setback (S 3rd Street) of 10 feet for the first 25 feet of building height and 15 feet for that portion of the building over 25 feet in height. (c) Height: Building and structure heights shall conform to the requirements of the zone in which the proposed use is to be located. Spires, bell towers, public utility antennas or similar structure may exceed the height requirement upon approval of a variance. Building heights should be related to surrounding used in order to allow optimal sunlight and ventilation, and minimal obstruction of views from adjacent structures. The CD zone establishes a maximum building height limit of 95 feet, except when abutting lots zoned residential then the maximum building height is 20 feet more than the maximum building height permitted in the abutting residential zone. The subject site does not abut a residentially zoned property; therefore the site is subject to a height limit of 95 feet. As noted previously, the existing structure is one-story and does not exceed the 95-foot height limit for the CD zone. (4) COMPATIBILITY: The subject property is located within a predominantly commercial/retail area and is surrounded by commercial and retail buildings. As the existing building was previously used as a gathering place for the Renton Eagles Club; staff considers the proposed church and its associated uses to be compatible with the existing uses within the immediate vicinity of the project. (5) PARKING: Parking under the building structure should be encouraged. Lot coverage may be increased to as much as seventy-five percent (75%) of the lot coverage requirement of the zone, in which the proposed use is located, if all parking is provided underground or within the structure. The applicant has indicated that they have a congregation size of approximately 100 people. The applicant has also indicated that the congregation has the potential to grow to approximately 225 people before they will need to move to another facility. The site plan submitted by the applicant shows 23 on-site parking spaces 1 of which is a handicap accessible space. An additional 22 parking stalls are located on the abutting Mortuary site with whom the applicant is working to obtain a joint use parking agreement. The surface parking lot provides and adequate number of parking spaces for the 100 congregation members, and the additional parking spaces that would be shared with the Mortuary would provide sufficient overflow parking for the congregation as it grows. The applicant also indicated that the church parking demand is primarily during church services, which are likely to occur on weekends and evenings. In addition, according to RMC 4-4-080.F.10 the parking requirements for a religious institution are less than the requirements for a recreational and entertainment use (Renton Eagles). Therefore, the impact of the proposed church on the existing parking lot is not likely to exceed the impact of the Renton Eagles Club. (6) TRAFFIC: Traffic and circulation patterns of vehicles and pedestrians relating to the proposed use and surrounding area shall be reviewed for potential effects on, and to ensure safe movement in the surrounding area. The subject site consists of 2 parcels. The southern parcel fronts on S 3rd Street, however no access is gained from S 3rd Street. The northern parcel fronts and gains access from Whitworth Avenue S, in addition the northern parcel connects to the adjacent parking lot for the Mortuary, which gains access from Shattuck Avenue S. As stated above, church services will be held on weekends and evenings. (7) NOISE, GLARE: Potential noise, light and glare impacts shall be evaluated based on the location of the proposed use on the lot and the location of on-site parking areas, outdoor recreational areas and refuse storage areas. Staff does not expect any short-term construction noise as no construction improvements are proposed to the existing building. In addition, as the existing building was previously used as a meeting place for the Renton Eagles Club, staff does not anticipate any additional noise impacts associated with the proposed church use. Finally, light and glare should not be an issue as the building is existing and no exterior alterations are proposed as part of this conditional use permit application. No alternations are proposed. Separate tenant improvement and sign permits would be required prior to any building modifications. (8) LANDSCAPING: Landscaping shall be provided in all areas not occupied by building or paving. The Hearing Examiner may require additional landscaping to buffer adjacent properties from potentially adverse effects of the proposed use. This subject site is currently developed; staff does not anticipate the need for additional landscaping at this time. (9) ACCESSORY USES: Accessory uses to conditional uses such as day schools, auditoriums used for social and sport activities, health centers, convents, preschool facilities, convalescent homes and others of a similar nature shall be considered to be separate uses and shall be subject to the provisions of the use district in which they are located. The proposed primary use of the site, as a church requires approval of a Hearing Examiner Conditional Use Permit. The applicant has indicated that the proposed uses in addition to church services would include bible studies, classes, seminars, Sunday school, nursery, childcare, worship concerts, performances, weddings, recovery programs, counseling, tutoring, arts, fitness, and retail sales including a bookstore/cafe. Church services would be held on weekends and evenings with some of the community development uses occurring at the subject site during the weekdays. The church currently has a congregation size of approximately 100 people. (10) CONVERSION: No existing building or structure shall be converted to a conditional use unless such building or structure complies, or is brought into compliance, with the provisions of this Chapter. The previously existing Renton Eagles Hall is proposed to be converted into a church and associated church related uses, therefore, the applicant has requested a conditional use permit to convert the existing building to a church use. The building would also be required to be in compliance with all applicable building and fire codes. (11) PUBLIC IMPROVEMENTS: The proposed use and location shall be adequately served by and not impose an undue burden on any public improvements, facilities, utilities, and services. Approval of a conditional use permit may be conditional upon the provision and/or guarantee by the applicant of necessary public improvements, facilities, utilities, and/or services. As the subject site is existing and fully developed, no additional street or utility improvements are required as part of the proposal. Utilities Staff has indicated that all existing public utilities are currently sufficient to serve the proposed development associated with this conditional use permit. There are already seven churches within a three block radius, plus various community service offices. There is nothing listed in the project description that is missing in this area, except for retail sales, This is not a retail project. Main Street USA has determined the having retail businesses in street level locations in a downtown core is vital in maintaining a viable business district. This project will deny a prime revenue producing location to a future business and the City. Representatives from the UW Department of Architecture's Storefront Studio have said that a church in this location is not a wise use for this property. A better use of this site would be a mixed-use residential and retail development. How much does a church contribute in taxes to the city? In a time when the city is considering across-the-board budget cuts, allowing a church in a sales tax revenue producing area makes no sense. The city is making great strides in enhancing the downtown core, and this project will do nothing to compliment that effort. It will add little to the overall "quality of life" in this area. As the area currently exists, there are few reasons for tonsumers to visit the west end of S. Third Street. Allowing this project will hamper any effort to include this area into revitalization plans. 1 There is no need to locate any church here. There is no reason to place any church here. Neither the residents, nor the other business and property owners of this area asked for a church here. Denying this application does not make the City anti-church. It seems to indicate that City government is committed only to ensuring the vitality of its core east of Logan Avenue S. Thank you for your attention. Consistency with the Comprehensive Plan: The existing development is located within the Urban Center -Downtown (UC-D) Comprehensive Plan Land Use designation. The following proposed policies are applicable to the proposal: Land Use Element Objective LU-OO: Create a balance of land uses that contribute to the revitalization of downtown Renton and, with the designated Urban Center -North, fulfill the requirements of an Urban Center as defined by Countywide Planning Policies. LU-216. Uses in the Urban Center Downtown should include a dynamic mix of uses, including retail, entertainment, restaurant, office, and residential, that contribute to a vibrant city core. Zoning Requirements: The subject property is located within the Center Downtown (CD) zoning designation. Parking requirements may be based on one of the following uses: Religious Institutions: 1 fo; each 5 seats in the main auditorium, however, in no case shall there be less than 10 spaces. For all existing institutions enlarging the seating capacity of their auditoriums, 1 additional parking space shall be provided for each 5 additional seats provided by the new construction. If the applicant proposes to utilize additional parking spaces from a neighboring site, a Joint Parking Agreement in accordance with RMC4- 4-080F must be completed. Eating and drinking establishments and taverns: 1 per 100 square feet of net floor area. Retail sales and big-box retail sales: A maximum of 0.4 per 100 square feet of net floor area, except big-box retail sales, which is allowed a maximum of 0.5 per 100 square feet of net floor area if shared and/or structured parking is provided. Dance halls, dance clubs, and skating rinks: 1 per 40 square feet of net floor area. Net floor area for the eating and drinking establishments, retail sales, and dance hall were not provided, staff was unable to determine the number of required parking spaces for these uses. Sensitive Areas: The City's Critical Areas Maps indicate the site is located in a seismic hazard area. The seismic hazard is related to potential liquefaction of soils during an earthquake event. Conditional Use Criteria: In order to obtain approval of a conditional use and expansion of the conditional use, the proposal must satisfy specific criteria. The purpose of a conditional use permit is to allow certain uses in districts from which they are normally prohibited. The evaluation of the proposed use must be deemed consistent with other existing and potential uses within the general area of the site. It is the applicant's responsibility to adequately demonstrate the facts justifying the approval of the conditional use permit based on the use's compatibility with ALL of the following criteria (RMC section 4-9-030G): • Comprehensive Plan • Community Need • Effect on Adjacent Properties, including lot coverage, yards and height • Compatibility • Parking • Traffic • Noise, Glare • Landscaping • . Accessory Uses • Conversion • Public Improvements The criteria listed above must be clearly and thoroughly substantiated. Staff examines the existing uses located adjacent to the subject site when evaluating the conditional use criteria. It is the burden of the applicant to demonstrate that this site is appropriate for the use proposed. It is important to note that staff is only able to make a recommendation and that the Hearing Examiner makes the final decision for a conditional use permit. Staff would also like to inform the applicant that a couple of rental halls are currently located in the downtown area Pilgrim's Rest, and St. Paul Ministries. There may be an opportunity to conduct services in one of these two facilities in lieu of seeking a separate conditional use permit. A handout listing all of the City's Development related fees in attached for your review. cc: Jennifer Henning Harambee Center Conditional Use Permit Project Narrative Existing Conditions: The Harambee Center will be located at 316 S. 3rd St. in Renton, W A. The building is a one story, 10,658 sf, CMU structure. The area is zoned CD and the site is currently being used as a service organization (The Renton Eagles). The current soil type is unknown and drainage is from existing surfaces to existing city surface water drainage system. Proposed Use: Harambee is proposing to use the site primarily as a religious institution for worship services and other church related activities (bible studies, classes, seminars, sunday school, nursery, childcare, worship concerts, performances, weddings, recovery programs, counseling, etc.). It will be used for these purposes primarily on evenings and weekends, but may be used at other times throughout the week. We will also operate our offices at the site during the week. In addition, we propose to use the site for community development (after school mentoring, tutoring, arts, fitness and other programs), and some retail sales (bookstore, cafe). It will be used for these purposes primarily during the day on weekdays, but may be used a~ other times throughout the week. Given the calculations in the parking analysis, we plan to be able to accommodate seating for up to 225 people at a given time for our activities. Proposed Improvements: Proposed on-site improvements will consist of city required upgrades (life safety, ADA, etc.) and cosmetic changes. No substantial improvements or expansion are proposed at this time. Proposed off-site improvements include the installation of a fire sprinkler system supply line from the water main in S. 3rd St. An estimated 100 cy will be excavated and used for fill for this project. Cost of improvements to the building (fire sprinkler and alarm system, ADA, life safety) is estimated to be $100,000, and estimated fair market value of the building upon completion of improvements is $900,000. Harambee Center Conditional Use Permit Justification A. Comprehensive Plan: Harambee's presence will contribute to the Urban Center Downtown's objective of having a dynamic mix of uses, resulting in a vibrant city core and the revitalization of downtown Renton. This will be accomplished through our emphasis on community development (see community need) and our aesthetic improvements to the site. B. Community Need: Churches serve a vital role in any community, addressing and meeting many of the physical, spirituaL and emotional needs of the community. Harambee will accomplish this not only through our worship services and other church related activities (bible studies, classes, weddings, etc.) but also through our community development programs that will include mentoring and tutoring for youth; arts, fitness, and recovery programs; finance, marriage and parenting seminars; counseling services, and more. Our location in downtown Renton is perfect for meeting many of these needs and for working in conjunction with Renton High School and forming strategic partnerships with other community groups. And, while there are other churches in the area, our strong emphasis on community development makes us unique to other churches. Furthermore, there is an endless supply of needs to be met and the addition of another church in the area will only increase the amount of resources directed towards meeting those needs. Thus, Harambee's presence will not result in an over concentration of churches in the area, particularly when seen as a contribution to the current diversity of uses. C. Effect on Adjacent Properties: Since we will not be using the space for both worship services and community development at the same time, Harambee's presence will have no more, and possibly even less, impact on parking, traffic, noise, etc. than the existing usage and tenants. There are 22 parking stalls in our back parking lot, another 22 in the adjoining lot, where we are negotiating a parking agreement, an additional 20-30 off-site street parking stalls in the vicinity, and multiple parking stalls in the nearby downtown Renton public parking garage off S. 2nd St., which is only a couple blocks away, and the city of Renton has indicated we may use. Harambee Center Conditional Use Permit Parking Analysis MAY 1 3 2005 The existing lot size is 20,628 sf, composed almost entirely of impervious surfaces: structure (l0,658 sf) and parking lot & surrounding areas (9970 sf) (see site plan). There are no proposed increases to either. The number of parking spaces required by city code (section 4-4-080F) for our current use and size is 23 [3 for office use (min 3 required for spaces less than 1000 sf) and 20 for church/mUltipurpose use (the primary use, and the most specific category for multiple uses as defined in section lOb, is for church, where 1 stall is required for every 5 seats, so for 100 seats, 20 stalls are required)]. There are 23 existing parking stalls in our back parking lot [including 1 with ADA accessibility (only I is required for parking lots with less than 25 spaces)), which meets the required number of spaces by the code. In addition, there are another 22 parking stalls in the adjoining lot, where we are negotiating a parking agreement, for a combined total of 45 stalls between the shared lots. This will allow for future growth, accommodating parking for up to 225 seats at a given time (45 stalls * 5 seats per required parking stall = 225 seats). Furthermore, there is also an additional 20-30 off-site street parking stalls in the vicinity, and multiple parking stalls in the nearby downtown Renton public parking garage off S. 2nd St., which the city of Renton has indicated we may use (parking agreement TBO). The combination of these four parking sources (our lot, adjoining lot, street, and Renton public garage) will be more then enough to meet our current and future parking needs. As for the parking lot landscaping, there is 120' of bushes along the property line at the rear (north) of the parking lot. Harambee Center Conditional Use Permit Construction Mitigation Proposed construction for the Harambee Center includes the installation of a fire sprinkler system, water supply line from the water main in S. 3rd St., and other life safety, ADA and aesthetic improvements. Construction will begin in June and will last a few months. Times, routes and traffic control will be determined by the contractor( s) and the city of Renton.
