Re: Special Fence Permit Application enclosed
I am writing to request approval of my 6 foot cedar fence at my home residence in the
new development of Maureen Highlands. I received a violation and notice on March 10,
2005 and would like to apply for a special permit to keep my side fence at the height
and location it currently is. I am basing my request on several points:
1. My attractive cedar fence is an upgraded style from many other fences that I have
witnessed in newer Renton neighborhoods that are also within the set back areas.
(See photos-examples A)
2. My fence is complementary to others in the area, of good quality and craftsmanship
and is aesthetically pleasing. The cost was $4600.00. (See site plan and photos-
example B)
3. I am on the corner of NE 6th street and Rosario PI Ave. My fence is set back from
the front street 38 feet and from the side street 6 feet. I have an 8 inch set back from
the sidewalk on the side street and will be using landscaping gravel there. I am not
within the "clear vision area".
4. The finished face of the fence fronts the street and provides sufficient visibility to
pedestrians and vehicular traffic. Our larger lots eliminate a feel of "fence walls" like
some other neighborhoods.
5. The fence improves privacy and security as I have children, pets and a hot tUb. I
have witnessed coyotes in the area and actually one killed my cat in November 2004
after I moved in. They are well know for predating domestic animals. I lived one mile
from here prior to this and have also witnessed fishers, coyotes and cougar in the ten
years in that area. My 6 foot fence provides me with security and safety.
6. I wish to retain my privacy and large lot size. I paid a ten thousand dollar premium
to have a large corner lot where I could have a private yard to raise my family. My land
was flat upon purchasing it and after the house was built, my yard has a downward
slope grade for drainage. If I am forced to move my fence, it will be a big financial
burden and cause the value of my home and land investment to decrease. If I am
forced to cut my fence down 2 feet, my privacy and security are gone. I will be forced

7. When I planned my fence placement, I perused your web site and found no required
permits for a 6 foot cedar fence. It also did not prompt me to "read further in the
Renton Municipal Code". I also took a short drive around many of the new
neighborhoods in Renton and saw many examples of fences abutting the sidewalks.
(See photos-examples A)
8. We will have no neighborhood parks. When I purchased my home, we were
promised that mitigation fees would go towards 2 playground parks to be built in our
neighborhoods. Now Harbour Home informs us "they are not required to give us
parks". My larger lot and private fence offer my children an alternative, please don't
take it away.
Please approve my fence. I was told that your Department is "only enforcing these
fence rules within the newer neighborhoods"! Is this true? My new and expensive
house and large lot is assessed a high tax level which adds to the City coffers. I feel
penalized for this. I would hope that ALL residents are being treated the same way and
that all the fences in my pictures have been granted special permits like I am hoping to
obtain.
We have a beautiful City. Arbitrary enforcement of the RMC will not make it more
beautiful or aesthetically pleasing. Drive down SE 128'" (NE 4th street) to your newly
annexed neighborhoods and look at the ugly fences and weeded landscape ribbons on
the side of the road. (See photos-example C) Are these folks being cited for not
maintaining that space? That is certainly not adding to the beautification of our City.
am sure this is very difficult to enforce.
I appreciate the opportunity to apply for a special permit and I wish to keep my private
yard "my private yard" and not a public space. I am hopeful you will approve my
request. If it is necessary I would be happy to state my case to you personally, or to our
Public Works Commission or City Council. I would rather not waste your time or tax
dollars. I hope our time spent, this $100.00 fee, application, and explanation will

Work Exempt From Permits
A building permit shall not be required for (he following:
1. One-story detached accessory buildings used as tool and storage sheds, playhouses, and similar uses,
provided the floor area does not exceed 120 square feet.
2. Fences not over 6 feet high. ~",::.----
3. Movable cases, counters and partitions not over 5 feet 9 inches high.
4. Retaining walls that are not over 4 feet in height measured from the bottom of the footing to the top of the
wall, unless supporting a surcharge or impounding Class I, II or I II-A liquids.
5. Painting, papering and similar finish work.
6. Window awnings supported by an exterior wall of Group R, Division 3, and Group U occupancies when
projecting not more than 54 inches
Unless otherwise exempted separate plumbing, electrical and mechanical permits will be required for the above
exempted work.

CORRECTIVE ACTION:
THE CITY OF RENTON HAS ADOPTED REGULATIONS GOVERNING FENCE HEIGHT FOR
RESIDENTIAL PROPERTIES. THE MAXIMUM HEIGHT OF A FENCE LOCATED ON THE SIDE
LOT LINE ABUTTING A STREET IS FORTY EIGHT (48) INCHES, EXCEPT IN CLEAR
VISION AREA. THE MAXIMUM HEIGHT OF A FENCE LOCATED IN THE CLEAR VISION
AREA IS FORTY TWO (42) INCHES. A SIDE YARD FENCE OF A CORNER LOT MAYBE
SEVENTY TWO (72) INCHES IF THE FENCE IS NOT LOCATED IN THE REQUIRED SIDE
YARD SET BACK AREA. THE MINIMUM SIDE YARD SETBACK IS TEN (10) FEET FOR
LOTS LESS THAN OR EQUAL TO FIFTY (50) FEET IN WIDTH, AND UP TO FIFTEEN
(15) FEET FOR LOTS GRATER THAN FIFTY EIGHT (58), FEET IN WIDTH.
IN THIS REGARD BY APRIL 18,2005 LOWER THE FENCE TO A MAXIMUM HEIGHT OF
FORTY EIGHT (48) INCHES ON THE SIDE LOT LINE ABUTTING THE STREET OR BY
MARCH 31,2005 MAKE APPLICATION FOR A SPECIAL FENCE PERMIT.
YOU MAY BE ELIGIBLE FOR A "SPECIAL FENCE PERMIT" THAT WOULD ALLOW A
A DEVIATION FROM THE REQUIRED SETBACK DISTANCE. IF THE DEVIATION IS
APPROVED, THE SEVENTY TWO (72) INCH HIGH FENCE WOULD HAVE TO BE RELOCATED
AND REQUIRED LANDSCAPING INSTALLED AND MAINTAINED BETWEEN THE FENCE AND
SIDEWALK.
