The project involves the removal of overgrown vegetation in order to reduce blockage to the forward flow of the channel. Vegetation will be removed from the site and disposed of outside of the flood plain. The project is to begin September 15th and will be completed by December 31 5t of each year. The applicant seeks to have the expiration date extended into the future to the maximum extent possible. An HPNJARPA approval was issued on November 1, 2002 to expire on November 7,2007. Along Springbrook Creek from SW 43rd Street to SW 16th Street. That portion of the drainage ditch originally condemned in King County, WA, Superior Court Case No. 32912, lying within: Section Township 13, 24, 25, 36 23 North 06, 30, 31 23 North Springbrook Creek Range 04 East 05 East An exemption from a Shoreline Management Substantial Development Permit is hereby granted on the proposed project described on the attached form for the following reason(s): Exemption from Shoreline ManBgement.doc (b) Normal Maintenance or repair of existing structures or developments, Including damage by accident, fire or elements. "Normal maintenance" includes those usual acts to prevent a decline, lapse, or cessation from a lawfully established condition. "Normal repair" means to restore a development to a state comparable to its original condition, including but not limted to its size, shape, configuation, location, and external appearance, within a reasonable period after decay or partial destruction, except where repair causes substantial adverse effects to shoreline resource or environment. Replacement of a structure or development may be authorized as repair where such replacement is the common method of repair for the type of structure or development and the replacement structure or development is comparable to the original structure or development including but not limited to its size, shape, configuration, location and external appearance and the replacement does not cause substantial adverse effects to shoreline resources or environment.
