This agreement is made by and between the City of Renton, Washington, a municipal
corporation of the State ofWasbington ("City") and Bob and Shirley Blayden ("owners")
Recitals. -
The-owners own real-property in the City legally deSCribed on EXhibit A, attached:
The owners have submitted an application for a Temporary Use Permit to operate an
existing family business on the property. For the duration of the Temporary Use Permit
the City requires the Owner to execute an indemnification agreement
Agreement
The parties agree to the following:
1. The City authorizes the owners to operate the existing family business as
described in the Temporary Use Permit application # LUA-05-084, TP.
2. The Owners assume the risk that the business must be removed from the site
and the building converted to a legal use and therefore release and discharge
the City and its representatives from all known and unknown losses, claims,
damages or causes of actions which the Owners have or may have relating to
the activities authorized by the Temporary Use Permit.
3. As a condition of granting Owner permission to operate a business on the real
property, Owner agrees to indemnify, defend and hold the City of Renton
harmless from any claims or liens that may be executed against the property
as a result of the Temporary Use Permit.
4. The Applicant has also provided an Abatement Agreement acceptable to the
City to ensure removal of the business at the time of the expiration of the
Temporary Use Permit. .
5. The provisions of this agreement shall bind the parties, their legal heirs,
representatives, successors and assignS and shall expire upon the issuance of

6. The applicant shall submit an abatement agreement and indemnification agreement to
Development Services Division, subject to the approval of the City Attorney within two (2)

7. The applicant's compliance with these requirements will be subject to the review and
approval of the Development Services Division for the duration of the temporary use.
8. If the temporary use permit is abandoned, and the structure removed, the disturbed area
of the site shall be restored.

RE: Blayden Temporary Use Permit Application
Dear Ms. Weil:
Now that we have had the opportunity to read the comments of those in our
neighborhood and others with regard to our request for a Temporary Use permit, which
would allow us to operate our business until the time outlined in our request. It is
important to us to clarify some issues brought up and present our side.
1) First of all, we are not "real estate developers" and we are not the parties
responsible for the proposed development around our property. Nor were we the
"principal force in the efforts to have our property annexed". We did agree to
sign a petition, which was originated by Mike Merritt (this is now known as the
Merritt II annexation), to start the annexation pr9ceedings. '
2) We moved our business (Blayden DesignlBuild) here in 1985 from our home in
Kent, where we started the business in 1975. We are a General Contracting
company that specializes in residential remodeling. We are not now and never
have been a "real estate developer", as Mr. Duffus states in his letter. Except for
selling a part of our property to Langley Development, we have nothing to do
with the proposed development in this neighborhood. When we moved here it was
just Bob and myself and a small field crew. We felt this six-acre property would
be a good location to live on and run our business from. When we built our
office/shop building the COUIlty "'J~3 fi;Jly a\vare of it's intended use. As it was
then and is now, our intention was to run the business as unobtrusively as
possible. It is unfortunate that Mr. Duffus chose to use a very outdated photo
(taken 7 years ago) to depict our company. Currently, we have two employees
that work out of the building on a daily basis. Our field crew of four employees
does not report to the office on a daily basis. Most days it is more convenient to
have these employees report to a specific job site. These same employees do not
report back to the office at the end of the day. I might add, that one of these
employees is our son. I don't think there are any laws that prevent our son from
visiting us when he gets off work. As to the neighbors objecting to the speeding
vehicles, we have always encouraged our employees to operate their vehicles in a
responsible manner. More than once, in the past, neighbors in the Summerwind
development, which we drive through, had the Renton Police monitor vehicles
with radar. I am pleased to report that not one ticket was issued to anyone

Speed is a matter of perception. The only deliveries that are made are usually a
UPS truck (mostly delivering items that were ordered from the internet for
personal use and not business related), and deliveries, such as from our lighting
store on an infrequent basis. We do not have a constant stream of delivery trucks
coming thru on a daily basis. I too am concerned about children playing in the
street and their safety. However, I am also concerned that many of these same
children do not seem to realize that the streets are for vehicles and not
indiscriminate playing. I have had the experience of children not moving out of
the street when I drive by.
3) We make no apologies for running our business on the property, even though it is
a non-conforming use of the property. Both Bob and I have been good citizens
over the 19 years we have lived here. Volunteering much of our time, through
our memberships in the Renton Chamber of Commerce, the Rotary Club of
Renton, Renton River Days Rubber Ducky Race, the Business and Professional
Women, and the Renton School District. We have always made an effort to give
something back to the community.
4) As far as having our dumpster picked up and emptied, it is not as intrusive as the
regular refuse pickups that occur on a weekly basis in the neighborhood. We
usually only have the dumpster picked up and emptied once a month.
5) We recognize that we have to move the business. This is not a small undertaking,
which is why we have requested the Temporary Use permit. It is our intention to
remodel the "office building" into a house (plans have already been drawn) as
soon as sewer lines have been run and a building permit has been issued for the
remodel. When these sewer lines are put in and the permit is issued, is out of our
hands. As I said above, we are not the developer and have no input into the
timeline of when things get done. We cannot sell the remodeled shop as a home
until the final plat is recorded.
It is apparent from all of the letters generated by our neighbors that there are many
rumors created and spread about what we do. This is evidenced by the fact that Mr.
Duffus and Ms. Rollins (who are husband and wife) wrote their letters making
statements about us when they don't even live in our "neighborhood". They live on
the property directly North of us and we do not impact them at all. In fact, they have
impacted us, when their exotic birds come on to our property each spring. That is

Blayden DesignlBuild operates a reputable construction and remodeling business in an
area zoned residential. In fact, we have used their services for work on our home. We
have not been impacted by the noise from Blayden Design/Build experienced by our
neighbors nearer the business site.
However, we are concerned about the traffic generated by the employees of the business.
Even though Hanson Consulting has reported in their letter of May 31, 2005 to City of
Renton on behalf of Blayden DesignlBuild that there are two employees at the business
site, the impact is much higher. It appears from the amount of traffic and the traffic
pattern, that the business site is used daily as a staging area for construction crews. There
is an influx of vehicular truck traffic in the morning and evening accessing Blayden' s
business site at 2533 Dwaco avenue N.E. (9933 143rd Avenue S.E.). It appears crews
check-in before heading out to job sites and return to check-in at day's end. Speeding by
the employees is a problem, especially since there are small children on our street.
Frequently southbound vehicles do not slow exiting Dwaco Avenue (previously 143rd
Avenue S.E.) when turning to go west on N.E. 24th Street. This is a cause for concern for
westbound traffic on 24th. Southbound traffic from Dwaco comes exclusively from the
Blayden's business/residence. There is also traffic from delivery trucks.
Mr. And Mrs. Blayden have been the principal force in the efforts to have their property
and neighboring properties annexed so that residential development could commence on
their parcel. Many neighbors, including us, have expressed support for their efforts once
proper guidelines were established for development of an Urban Separator. We feel that,
since this is the case, allowing a non-conforming use to continue indefinitely is
inappropriate. Therefore, granting Blayden Design/Build an ambiguous or non-existing
deadline for the cessation of the non-conforming use and/or the "conversion" of the
business structure into a single-family residence is inappropriate. Our suggestion to the
City of Renton is to work with Blayden DesignlBuild to come to an agreement on a
specific date at which the nonconforming use ceases.

On December 22,2003, the proponent of this temporary permit stood before Renton City Council and
asked to be annexed to the City of Renton. He emphasized he would be a good citizen of Renton. A
good citizen plays by the rules. Renton's rules do not allow a contractor business in a residential area.
This business was never allowed in King County. The proponent asked to be annexed. Annexation
incurs benefits which facilitate development but also incurs benefits which protect the City of Renton's
citizens. The newly annexed Renton citizens, Blayden's neighbors, deserve the benefit of Renton's
higher standards. These higher standards are proudly and vigorously upheld by the City via their
pl8.nning, public works and code enforcement departments.
This business has had a free ride long enough. Do not allow this free ride to continue. Do not allow
these negative impacts to the surrounding neighborhoods to continue. Do not issue a temporary use
permit for this illegal business.

Dear Ms. Weil:
The owners of this property were petitioners for the annexation that ultimately brought this property
and the surrounding neighborhood into the City of Renton. The owners were actively involved and
strongly supported the annexation proceedings, (as did this writer). The owners of the property are
professional contractors, involved in remodeling and real estate development They know and
understand the ramifications of Renton's single family zoning and related codes. Why should they feel
that they can now simply ask the City to waive its code? Especially when they were very instrumental
in becoming citizens of Renton, and presumably, want to be good citizens and good neighbors?
";Operating a business in a single family R-1 neighborhood with more than 1 outside employee is illegal
under King County code. In fact, King County had an active enforcement case (#E0101467) when the
property was annexed into the City of Renton.
The letter accompanying this application states that there are; "only two employees are on site." (Copy
enclosed.) There are more than two employees on site. A recent advertisement in the Renton Reporter
pictures 10 people posing proudly in company logo shirts on site under the BLAYDEN
DESIGN/BUILD office sign. (Copy enclosed) The 3600 square foot office building contains work
space, offices and conference areas that accommodate more than two people!
This application for a temporary use permit is predicated upon a completely separate and distinct
event, (possibility). That is, a proposed preliminary plat. The request is for the operatioh to be
allowed to continue until the plat is recorded. The letter from the applicant/project contact person, Jim
Hanson, accompanying the request is vague as to timeline. In his letter, Mr. Hanson refers to the
business "operating on the site until a proposed plat is constructed and the existing building can be
converted to a residence." Later Hanson states; "The existing building will be converted to a residence
after the Langley Ridge at Mat (sic) Creek plat is approved and constructed." The two words
"platted" and "constructed" have distinctly different meaning.
REGARDLESS, predicating this temporary use request on a completely separate possible event
is unacceptable. The plat may never be recorded due to anything, ranging from lack of financial
feasibility, bankruptcy, withdrawal of optioned real estate parcels, disagreement among parties, death,
dissolution, etc.

permit's cancellation that wouldforce the UlegaUy operating business to cease and desist in a timely
manner?
Renton Municipal Code 4-9-090 is very specific on home occupation businesses. This business
operation far exceeds the limited nonresidential activities allowed in the code ... (See appendix to this
letter)

opinion i~ this matter. May we begin by saying the Blaydens' have been unfair to the -community by not obeying the law. One of the reason the land was sold to him is because
the area is zone for single"-family residential only. We have put up with large trucks
tridlic and speeding cars for years, because when we complajn to the County they stated
they would take care of it. Th~n when we would talk to the Blayden about the speeding
. cars and trucks they would slqw down for aw1:.rile and then back to speeding again. We
feel the single-family residence law should be upheld and we should not have to put up
with the traffic problem that a business has.

Dear Development Services Staff:
This letter outlines the application for the Blayden Temporary Use Permit at 2533 Ilwaco
Ave NE Renton W A. The request is to allow an existing design build construction
company to remain operating on the site until a proposed platis constructed and the
existing building can be converted to a residence on one of the new lots within the
Langley Ridge at May Creek plat.
The current zoning of the site and surrounding area is R -1. The current use of the site is
for one single family residence which will remain and a remodeling construction
company offices and storage. The existing house and office gets access from a driveway
entering off of Ilwaco Ave NE. Only two employees are on site. Very little traffic is
generated. The business has operated on the site for about 15 years with little impact on
neighboring properties.
The existing business building is about 3600 square feet. No new construction is
proposed for the business. The existing building will be converted to a residence after the
Langley Ridge at Mat Creek plat is approved and constructed.
