SUMMARY OF PROPOSAL: The applicants for the proposed Falk II Annexation have requested that the City prezone the subject
site in advance of annexation, pursuant to RCW 3SA.14.330, so zoning will be in place at the time the subject site comes into the City.
The City is proposing to prezone the 6.29 acre proposed annexation area R-8. This corresponds with the Residential Single Family
designation in Renton's Comprehensive Plan. Whereas the proposed annexation is considered to be a non-project action under
SEPA, the proposed zoning is not.

This is to inform you that the Environmental Review Committee (ERC) have completed
their review of the environmental impacts of the above-referenced project. The
Committee, on November 8, 2005, decided that your project will be issued a
Determination of Non-Significance.
The City of Renton ERC has determined that it does not have a probable Significant
adverse impact on the environment. An Environmental Impact Statement (EIS) is not
required under RCW 43.21C.030(2)(c). This decision was made by the ERC under the
authority of Section 4-6-6, Renton Municipal Code, after review of a completed
environmental checklist and other information, on file with the lead agency. This
information is available to the public on request.
Appeals of the environmental determination must be filed in writing on or before
5:00 PM on November 28, 2005. Appeals must be filed in writing together with the
required $75.00 application fee with: Hearing Examiner, City of Renton, 1055 South

In compliance with RCW 43.21 C. 240, the following non-project environmental review
addresses only those impacts that are not adequately addressed under existing development
standards and environmental regulations.
1. Transportation
Impacts: None identified for this non-project legislative action. At the most likely scenario for build-out 40 potential
dwellings could potentially create 400 average vehicle trip ends per week day. There are already 5 dwellings and
approximately 50 average vehicle trip ends per week day in the area and development of additional units is likely to
occur regardless of the change in zoning. However, mitigation can be provided at the time there are specific project
proposals before the City,
Mitigation Measures: Impacts, if any, are better assessed at the project level.
2. Surface waterl waste water
Impacts: Surface water issues have been identified in the area of this proposed prezone.
Mitigation Measures: At the time of permitting, future development must comply with either the 2005 King county
Surface Water Design Manual Conservation Flow Control Standard and King County Water Quality Treatment
Standards, or the City of Renton storm water standards, whichever is stricter.

PROJECT DESCRIPTION: The applicants for the proposed Falk II Annexation have requested that the City
prezone the subject site in advance of annexation, pursuant to RCW 35A.14.330, so zoning will be in place at the time the
subject site comes into the City. The City is proposing to prezone the 6.29 acre proposed annexation area R-8. This
corresponds with the Residential Single Family designation in Renton's Comprehensive Plan. Whereas the proposed
annexation is considered to be a non-project action under SEPA, the proposed zoning is not.
PROJECT LOCATION: This site is adjacent to City Limits on two sides and is bordered by 102nd Ave SE
on the east. It is in the SW Yo of Section 32, Township 23 N, Range 5 E.
OPTIONAL DETERMINATION OF NON-SIGNIFICANCE (DNS): As the Lead Agency, the City of Renton has determined
that significant environmental impacts are unlikely to result from the proposed zoning. Therefore, as permitted under the
RCW 43.21C.110, the City of Renton is using the Optional DNS process to give notice that a DNS is likely to be issued.
Comment periods for the project and the proposed DNS are integrated into a single comment period. There will be no
comment period following the issuance of the Threshold Determination of Non-Signifi~ance (DNS). A 14-day appeal
period will follow the issuance of the DNS.

Council accepted the proposed Direct Petition to annex at its public hearing on
August 1, 2005 and held the first of two required public hearings on the proposed
prezoning on this same date.
The subject site is located within the Residential Single Family (RS)
Comprehensive Plan Land Use Map designation. The proposed R-8 prezone is
consistent with this land use designation, as well as relevant land use policies
adopted in November 2004.

FALK II ANNEXATION PREZONE PROJECT NARRATIVE AND PROPOSAL
SUMMARY
The applicants for the proposed Falk II Annexation have requested that the City prezone the
subject site in advance of annexation, pursuant to RCW 35A.14.330, so zoning will be in place at
the time the subject site comes into the City. This site is adjacent to City Limits on two sides and
is bordered by 1 02nd Ave SE on the east. Annexation is considered exempt from SEP A.
However, the prezoning of the subject 6.29-acre area does require SEPA review.
The City is proposing to prezone the proposed annexation area R-8. This corresponds with the
Residential Single Family designation in Renton's Comprehensive Plan. The proposed prezone is
considered a non-project action under SEPA. Surrounding zoning to the north and west is Renton
R-8 residential 8 units per net acre, and King County R-6, residential 6 units per gross acre lies to
the east and south.
Currently five single-family housing units exist in this area. At full build out it is estimated there
will be 40 homes. Since this prezone is a non-project proposal, development of additional
housing units will be subject to additional project specific review at the time of development.
Falk II Annexation Prezone Justification
The area proposed for prezoning has already been designated for Residential Single Family in the
Renton Comprehensive Plan. King County's Comprehensive Plan has designated the area for
urban development at a density of 4-12 dwelling units per gross acre. R-8 zoning of this property
would be consistent with both Comprehensive Plans. Renton's zoning uses net developable area
to determine project density, not gross developable area. This results in less intensive
development adjacent to sensitive areas. With current bonuses and incentives, King County
zoning at 6 units per gross acre can easily be increased to over 8 units per acre. This is
comparable to Renton's proposed zoning of 8 units per acre.

The State Environmental Policy Act (SEPA), Chapter 43.21 C RCW, requires all governmental agencies to
consider the environmental impacts of a proposal before making decisions. An Environmental Impact
Statement (EIS) must be prepared for all proposals with probable significant adverse impacts on the
quality of the environment. The purpose of this checklist is to provide information to help you and the
agency identify impacts from your proposal (and to reduce or avoid impacts from the proposal, if it can be

None at this non-project level. Development of additional dwelling units under this proposal must
comply with City of Renton regulations and with Renton's Critical Areas Ordinance. Any

The proposed non-project action will not deplete energy or natural resources. Future project level

The proposed prezoning of this area will increase compatibility with the surrounding uses since it
will limit future development to single-family detached housing currently prevalent in the area.
King County zoning allows both detached and attached units in its R-8 zone. Additionally, the
County R-6 zone is based on gross density, and can be easily bon used to more than 8 dwelling
units per acre. Renton's zoning is based on net density, so Renton R-8 zoning is actually about
the same, or a slightly lower intensity use of the land than County zoning.

6. How would the proposal be likely to increase demands on transportation or public services and
utilities?
At current levels of development there are 5 units and approximately 50 AWDVTE in this area.
