ANALYSIS OF REQUEST:
On November 14, 2005 the City of Renton issued a variance for the Armondo's Cafe Italiano
Sign. Following the variance approval, the approved sign was installed for Armondo's Cafe.
Since 2005 Armondo's Cafe has closed and a new restaurant, Marianna's Ristorante, has moved
into the commercial space. Marianna's Ristorante has requested to utilize the Armondo's sign
to advertise for their business, with minor changes to represent the new business. The minor
changes to the approved sign include a new sign face in the circular portion along the top of the
sign, new letters which spell out IIMarianna" on the front and back face of the sign and new
letters that spell out IIRistorante * Pizzeria * Bar" on the side of the sign. The proposal would
not change the size, height, location, or configuration of the approved Armondo's Cafe sign.
Pursuant to RMC 4-4-100D.6.b.ii, conforming signs and sign structures may be utilized by a new

sign. As such, the applicant is permitted to utilize the new sign. However, to ensure the same
circumstances that applied to the original variance are the same with the new business a
modification to the original variance request has been required. The applicant contends that
the same circumstances exist for the new business, Marianna's Ristorante, as existed for
Armondo's Cafe. Marianna's Ristorante has also relocated their restaurant from another part
of Renton in hopes to attract more customers not only to their restaurant, but to the overall
area, continuing in the revitalization of downtown Renton. The applicant contends that
Marianna's Ristorante is now facing the same challenges that Armondo's Cafe faced in the "loss
of visibility and familiarity of a prominent location" known to their customers for years.
Staff has evaluated the justification provided with the original variance application and concurs
with the application that the same circumstances exist for Marianna's Risotrante as existed for
Armondo'sCafe. The building remains on the same roadways and the sign is necessary to
compensate for the loss of visibility and to establish the new site. The sign would establish the
identity of the restaurant in the new location. The sign would not be materially detrimental to
the public welfare or injurious to the property or improvements in the vicinity and zone. The
changes are the minimum necessary to represent the new business and the modifications
would not amend the size, height, lo.cation, or configuration of the original approved
Armondo's Cafe sign, therefore resulting in the minimum necessary to accomplish the desired
purpose. Approval of the modification would not grant a special privilege, as the previous
owner used the same sign to advertise their business. Because the same circumstances exist for
Marianna's Ristorante as did for Armondo's Cafe, staff recommends approval of the variance
modification to allow the change in paint color, circular graphic, and letters needed to identify
the new business in the same commercial space subject to the same conditions applied to the
original permit.
DECISION
The proposal satisfies all of the variance criteria listed in RMC 4-9-2S0B.5.a for approval of
variances. Therefore, the modification ofthe sign variance, Project Number LUAOS-132, V-A, is
approved and subject to the following conditions:
CONDITIONS:
1. The applicant must obtain an Annual Right-of-Way Use Permit (RMC 4-4-100LS) and
pay the associated annual fee. Based on the area of right-of~way use, the fee is--
determined to be $10 per year. The fee is payable yearly in advance.
2. The applicant shall provide sufficient public liability and property damage insurance
with limits of not less than one hundred thousand dollars/three hundred thousand
dollars ($100,000.00/$300,000.00) to cover public liability and not less than fifty
thousand dollars ($50,000.00) to cover property damage. Copies of the insurance
policy or policies must be furnished to the City with special endorsement in favor of
the City within 30 days of the date of this decision.

When Armondo1s restaurant closed its doors in 2011 , a new restaurant, Marianna, has since
opened its doors for business in its place February of this year. Like Armondo1s, they
relocated their restaurant from another part of Renton in hopes to attract more customers not
only to their restaurant, but to the overall area, continuing in the revitalization of downtown
Renton. Marianna is now facing the same challenges that Armondos faced; 11he loss of
visibility and familiarity of a prominent locationll known to their customers for year. Like any
business, they need visible signage in order to succeed.
Marianna is proposing to re-use Armondo1s old sign that was granted a Variance but alter it to
make it their own. The sign would not change in size, but will be painted a different color,
have different graphics, will downsize in illumination, and the neon letters will be changed to
LED, making the sign more energy efficient. If Marianna is granted the variance modification,
they are prepared to uphold the same rules/conditions set forth to Armondo1s in compliance
with the variance.
All we are asking is for you to give Marianna Ristorante the same tools and opportunity to not
only succeed, but to thrive as a local business at their new location in the City of Renton.

c. Project Description / Background:
The applicant, Armondo Pavone, is requesting approval of an administrative variance from
the required City Center Sign Regulations (RMC 4-4-100H) in the Center Downtown (CD)
zoning designation. The subject site is located at 310 Wells Avenue South, on the corner of
Wells Avenue South and Houser Way South. The proposed projecting sign would be
mounted on the business fa<;ade to which it would be associated with. The Armondo's Cafe
Italiano business is relocating after 20 years from the corner of Main Street and South 3rd St.
The applicant proposes one projecting sign on the southwest corner of the two-story building.
The sign is to be mounted by two brackets with a total projection over the public right of way
48 inches. The overall square footage is proposed to be approximately 82 square feet for
the three-sided sign. The maximum proposed letter height for the sign is 12 inches that
would be exposed 15mm neon.
The sign code permits a maximum cumulative area of all faces of 12 square foot for an
internally illuminated sign. The applicant is proposing approximately 82 square feet. The
code requires that the sign shall not be higher than 25 feet above the grade, measured to the
top of the structure, which the applicant proposes to comply with at 22.2 feet.
The code permits the sign to be no taller than 3 feet; the overall height of the proposed sign
is 14.2 feet. The code requires a separation the faces of a projecting sign to be no more than
12 inches, the proposed sign width is 19 inches.
The projecting sign in the City Center Sign regulations is required not to extend over the
public right-of-way by more than 4 feet from the wall it is mounted on and to be a minimum of
8 feet clearance above the surface of the sidewalk. The proposed sign complies with both of
these requirements with a projection of 48 inches and mounted 8 feet above the sidewalk.
Therefore, the applicant is requesting a variance of 70 square feet for cumulative size, 11.2
feet of sign height, and a side width allowance of 7 inches between sign faces.

FINDINGS, CONCLUSIONS & DECISION
Having reviewed the written record in the matter, the City now makes and enters the
following:
D. Findings
1) Request: The applicant has requested approval for an administrative variance from
the required height, area and separation of the sign faces of the City Center Sign
Regulations (RMC 4-4-100H 5d.) for the property located at 310 Wells Avenue South.
2) Administrative Variance: The applicant's administrative variance submittal materials
comply with the requirements necessary to process a variance. The applicant's site
plan and other project drawings are provided as Exhibit 1.
3) Existing Land Use: Land uses surrounding the subject site include: North, South
East: and West: mixed-use commercial -restaurant, retail, office uses, and United
States Postal Service.
4) Zoning: The site is located in the Center Downtown zone. The site is also located in
the City Center Sign Overlay.
5) Topography: The topography of the site is flat.
6) Right of Way Use: The sign would be mounted approximately 8 feet above grade
and extend 48-inches into the right-of-way for Wells Avenue South and South Houser
Way.
CONSISTENCY WITH VARIANCE CRITERIA
City Ordinance 5157 adopted October 30, 2005 granted the Planning/Building/Public Works
Administrator the authority to grant a variance upon making a determination, in writing, that
the conditions specified below have been found to exist. RMC 4-9-250B.5.a. lists four criteria
that the Administrator is asked to consider, along with all other relevant information, in
making a decision on an Administrative Variance application
a. That the applicant suffers undue hardship and the variance is necessary
because of special circumstances applicable to subject property, including
size, shape, topography, location or surroundings of the subject property,
and the strict application of the Zoning Code is found to deprive subject
property owner of rights and privileges enjoyed by other property owners in
the vicinity and under identical zone classification:
The applicant contends that special circumstances apply to the subject site, which
impose undue limitations on the lot. The applicant is a member of the Alpine One,
LLC, which has renovated the western half of the city block between South Third
Street, Wells Avenue South and Houser Way South. The business for the
proposed sign is located in the portion of the building at the southwest corner of this
block. The applicant plans to relocate the Armondo's Cafe from its long established
site on the corner of Main Avenue South and South Third Street, which is a high
trafficked site. The new location is located on a one-way north bound only street,

Wells Avenue South and a low volume street, Houser Way South., that is also the
railroad right of way through the City Center.
The applicant contends the additional square footage and overall height of the
proposed projection sign is necessary to compensate for the loss of visibility, the
establishment of a newly remodeled site, and impact to the familiarity of a landmark
establishment for the City of Renton.
b. That the granting of the variance will not be materially detrimental to the
public welfare or injurious to the property or improvements in the vicinity and
zone in which subject property is situated:
For over 20 years, the Armondo's Cafe Italiano has helped anchor this block of the
city center. As a member of the Alpine One, LLC, the applicant is an active
participant in the revitalization of the downtown core. The relocation of the
restaurant into a newly remodeled multi-tenant two-story building is key to ensuring
the feasibility of the building. And the proposed sign is warranted to establish the
identity of the restaurant in the new location. Staff supports the proposed sign and
has determined it would not be materially detrimental to the public welfare or
injurious to the property or improvements in the vicinity and zone.
The variance request is to exceed the sign area and height. The location of the
sign on the building, the mounting and extension of the sign into public right of way
would all comply with code regulations. While the sign does exceed the 12 square
feet total sign area permitted by code, the design of the sign appears to be in
balance with the building fa<;ade and in fact enhance the angled corner of the
structure. The ability to clearly see the sign from multiple angles may in fact
enhance the public welfare by avoiding confusion in locating the business.
c. That approval shall not constitute a grant of special privilege inconsistent
with the limitation upon uses of other properties in the vicinity and zone in
which the subject property is situated:
Approval of the variance request would not provide the applicant with greater
benefit or privileges than have been previously extended in similar cases. Prior to
the current City Center Sign Regulations which greatly reduced the permitted size
and height of signage, larger signs were permitted and many still exist within the
downtown. The current City Center Sign Regulations are often cumbersome to
apply to businesses requesting new or replacement signs. Signage in business
districts is a vital marketing tool as well traditionally adding a layer of character to
an area and identity.
d. That the approval as determined by the Administrator is a minimum variance
that will accomplish the desired purpose:
The applicant contends that the request is a minimum variance needed in order to
compensate for the relocation of his business and loss of high visibility of the
previous site. The applicant operated in good standing his establishment on the
same corner for over 20 years. By relocating his establishment, signage will play
an important role in identifying the business in its new location. The proposed sign
is consistent with the historical and current character and layout of the downtown
commercial neighborhood.

Staff supports the request for the projecting sign as a minimum variance, as the
requested additional square footage, width of sign and height produce a reasonable
sign for the angled corner of the structure and appears to finish the fac;ade of the
recently renovated building. This variance allows the applicant to maximize visibility
of one sign on a corner allowing visibility along Wells Avenue South and Houser
Way South.
E. Conclusions
1. The subject site is located at 310 Wells Avenue South, within the Center Downtown
(CD) zoning designation.
2. The sign regulations for the proposed site are covered under the City Center Sign
Regulations (4-4-100H5d).
3. The analysis of the proposal according to variance criteria is found in the body of the
Staff Report.
4. The sign would extend into the right-of-way, and requires that the applicant obtain an
annual right-of-way use permit, and provide a certificate of liability insurance to the
City, and sign and record a hold harmless and indemnity agreement approved by the
City of Renton.
F. Decision
The Administrative Sign Variance and Right of Way Use Permit for the Armondo's
Restaurant Variance, File No. LUA-05-132, V-A, are approved subject to the following
conditions:
1. The applicant must obtain an Annual Right-of-Way Use Permit (RMC 4-4-100l5)
and pay the associated annual fee. Based on the area of right-of-way use, the fee
is determined to be $10 per year. The fee is payable yearly in advance.
2. The applicant shall provide sufficient public liability and property damage insurance
with limits of not less than one hundred thousand dollars/three hundred thousand
dollars ($100,000.00/$300,000.00 to cover public liability and not less than fifty
thousand dollars ($50,000.00) to cover property damage. Copies of the insurance
policy or policies must be furnished to the City with special endorsement in favor of
the City within 30 days of the date of this decision.
3. The applicant shall agree to sign and record a Hold Harmless and Indemnity
Agreement approved by the City of Renton, prior to issuance of the sign permit.

The administrative land use decision will become final if the decision is not appealed within 14 days of the date of
approval. An appeal of the decision must be filed within the 14 day appeal period (RCW 43.21.C.075(3); WAC
197-11-680). An appeal to the Hearing Examiner is governed by Title IV, Section 4-8-11.B, which requires that
such appeals be filed directly with the Hearing Examiner via the City of Renton City Clerks Office. Appeals must
be made in writing on or before 5:00 PM on November 28, 2005. Any appeal must be accompanied by a
$75.00 fee and other specific requirements.
THE APPEARANCE OF FAIRNESS DOCTRINE provides that no ex parte (private one-on-one) communications
may occur concerning the land use decision. The Doctrine applies not only to the initial decision, but to Appeals
to the Hearing Examiner as well. All communications after the decision/approval date must be made in writing
through the Hearing Examiner. All communications are public record and this permits all interested parties to
know the contents of the communication and would allow them to openly rebut the evidence in writing. Any
violation of this doctrine could result in the invalidation of the appeal by the Court.

of downtown Renton. In an arca filled with dilapidated buildings and antique shops.
Alpine One has successfully filled a newly remodeled building with valuable businesses.
Nevertheless, the success of this revitalization project is solely based on the relocation of
Annondo' s Cafe Italiano to 310 Wells. The significant downside to this move is the
extreme loss of visibility and familiarity Of a prominent location that Armondo's has
occupied for over twenty years. Over the last twenty years Armondo's has become a
well-known landmark hi the downtown Renton area. It is fQJ' lhili rc::ason that every
resource be utili:zed to market the restaurant's new location. The proposed sign is the
most important asset availabJe to help offset any oegative impact caused by the
relocation. The move from 3td Avenue, where there is continuous traffic, to Wells, will
definitely influence the amount of guests that visit the restaurant. However, with the
proposed sign Armondo's Cafe Italiano will attract locals and visitors to tbe downtown
Renton area.
