LUA05-154, SA-A REPORT AND DECISION OF March 16, 2006 Page 2 of B II PART ONE: PROJECT DESCRIPTION/BACKGROUND The applicant is requesting Administrative Site Plan Review in order to construct a 1,312 square foot two-story office addition to an existing 7,868 square foot two-story structure and a 2,183 square foot addition with a 432 square foot mezzanine of storage space. The proposed two-story office addition would be located on the east side of the existing building and the storage space is proposed on the western side of the existing office/storage building. The proposed two-story office addition would result in the loss of 4 parking spaces. The two story office addition is proposed at a height of 28 feet and the office/storage addition is proposed at a height of 22 feet 7 inches feet. A Development Agreement was recorded over the subject site January 12, 2000 (Recording Number 20000112000255). The Development Agreement limits that addition area to an Administrative Headquarters Office to 3,500 square feet, requires that the addition be reviewed through Site Development Plan Review, and provides requirements in addition to those required under the Development Standards for Building Height, Landscaping, and Access. The subject site is located at the northeast corner of the intersection of Maple Valley Highway (SR 169) and Monroe Avenue SE. The site is zoned Commercial Neighborhood (CN) and totals 58,950 square feet in area (1.4 acres). The topography of the site is relatively flat and slopes to the south towards the Cedar River. The subject site contains and existing two-story office building, a secondary office building that is used as a training center, and associated parking and landscaping improvements. The landscape plan proposes landscaping along the perimeter lines of the northwest portion of the subject site surrounding the addition area. Additional landscaping is proposed around the proposed addition areas. The proposed vegetation to be used as landscaping includes trees (Weeping Yellow Alaska Cedar and Chanticleer Flowering Pear), and shrubs (Warty Barberry, Parney Cotoneaster, Hebe 'Autumn Glory', Pacific Wax-myrtle, Compact Heavenly- bamboo, H.D. Conformance with the comprehensive plan, its elements and policies; The subject site is designated Commercial Neighborhood (CN) on the City's Comprehensive Plan Land Use Map. The CN designation is intended provide small scale, low-intensity commercial areas located within neighborhoods primarily for the convenience of residents who live nearby. Uses should be those that provide goods and services. In addition, a limited amount of residential opportunities should be provided. The proposal is consistent with the following CN Land Use Designation policies: Policy LU-425. The small-scale uses of Commercial Neighborhood designated areas should not increase in intensity so that the character of the commercial area or that of the nearby residential area is changed. The proposed addition to the existing office building would not change to character of the nearby residential neighborhood. Policy LU-42B. Products and services related to large-scale motorized machinery, vehicles, or equipment should not be allowed in Commercial Neighborhood designated areas. Nor should uses that result in emissions, noise, or other potential nuisance conditions be allowed in such areas. The proposal is an addition to an existing Administrative Headquarters Office and would not utilized large- scale motorized machinery, vehicles, or equipment except during the construction of the addition. Policy LU-430. Commercial structures in Commercial Neighborhood designated areas should be compatible with nearby residential areas in height, front yard setbacks, lot coverage, building design, and use. The proposed addition would be compatible with near by residences in the height, setbacks, lot coverage, and design of the building and the building materials. 2. Conformance with existing land use regulations; The subject site is deSignated Commercial Neighborhood (CN) on the City's Zoning Map. New Administrative Headquarters Offices are not permitted within the CN zoning designation; however per the Development Agreement (2000112000255) a one-time expansion of the existing office is permitted. The compliance of the proposal with the development standards of the CN zone, Development Agreement, and Renton Municipal Code parking regulations is addressed below: Lot Coverage -The CN zone allows building coverage at a maximum of 65% of the lot area for projects not providing structured parking. All of the parking spaces are provided on an existing surface parking lot. Based on the overall site area (58,950 square feet), after the construction of the proposed addition, the total square foot of the building footprint would be 9,012 square feet and would result in a 15% building lot coverage, which is well below the maximum coverage required in the CN zone. Setbacks - A minimum 10-foot building setback is required from the front yard and a maximum front yard setback of 15 feet is permitted, a minimum 10-foot side yard along a street setback is required, no interior side or rear yard setbacks are required unless the site abuts or is adjacent to a residential zone, then a 15- foot setback is required. The existing office building complies with all of the minimum setback requirements; however it exceeds the maximum front yard setback permitted. The existing structure is an existing legal non-conforming structure and is therefore not required to comply with the maximum front yard setbacks. The proposed additions are located to the side and rear of the existing buildings and are required to comply with the interior side and rear yard setback requirements. The proposed two-story office addition would be located on the eastern side of the existing building and would have a 31-foot side yard setback. The proposed one-story addition would have an interior side yard setback of 10 feet (the site does not abut a residential zone at this location so no setback would be required) and a 15-foot rear yard setback. The proposed additions would comply with the required setback areas. Landscaping -The CN zone has minimum landscaping requirements, however the Development Agreement Recorded of the property (2000112000255) states that the landscaping requirements found in the development standards will not apply to the subject site, instead the landscaping requirements outlined in the development agreement will apply. The Development Agreement requires a minimum of 10 feet of on-site landscaping along street frontages except where reduced through the site plan review process. The proposed additions are located to the side and rear of the existing structures, therefore the applicant is not required to retrofit the existing landscaping along street frontages to comply with this requirement. A 10-foot wide sight-obscuring landscape strip shall be required along the side and rear property lines where the site is abutting a residential zone. A maintenance agreement or easement for the landscape strip shall be secured. The solid barrier wall shall not be located closer than 5 feet to an abutting residentially zoned lot. A conceptual landscape plan and irrigation plan were submitted with the project application. The plan proposes a range of between 8 and 10 feet of landscaping along the northwestern property line around the proposed additions. Additional landscaping is proposed within the interior of the subject site around the addition areas. The proposed plantings to be installed within the landscaped areas include trees and shrubs. The proposed tree species include Weeping Yellow Alaska Cedar and Chanticleer Flowering Pear and the shrub species include Warty Barberry, Parney Cotoneaster, Hebe 'Autumn Glory', Pacific Wax- myrtle, Compact Heavenly-bamboo, H.D. Nandina, and Fragrant Sarcococca. The proposed landscape plan does not comply with the requirements found in the Development Agreement. The portion of the landscaped strip that is proposed to be 8 feet in width is less than the 10 feet mandated by the Development Agreement and no wall was provided within the landscaped area. Therefore, staff recommends as a condition of approval that a revised site plan and a revised landscape plan be submitted with the building permit application widening the proposed 8-foot portion of the landscape strip to 10 feet and showing a 6-foot barrier wall. Height -The CN zone has standards limiting the height of buildings; however the Development Agreement states that the height limits of the zoning designation shall not apply to the site, instead the height requirements in the Development Agreement shall apply. The Development Agreement limits the permitted building height to 35 feet. The proposed heights of the additions would be 28 feet and 23 feet, which is below the maximum height permitted. Screening -No screening details were submitted with the site plan application. If any surface mounted or roof top utility eqUipment is proposed, it shall be screened from public view per the screening regulations. Pedestrian Connections -All development in the CN zone is required to provide a direct and clear pedestrian connection from sidewalks to building entrances. The site plan indicates a direct connection via a combination of a concrete walkway and painted stripes would be provided between the entrance of the existing building and the existing sidewalk along Maple Valley Road (SR 169). Parking -The parking regulations require a specific number of off-street parking stalls based on the proposed use. General Office uses require a minimum of 3 spaces per 1,000 square feet of net floor area and a maximum of 4.5 spaces per 1,000 square feet of net floor area. Storage uses require 1 space per 1,500 square feet of net floor area. After the proposed additions, the total building area onsite would be 11,100 square feet of office area and 2,183 square feet of storage area. A minimum of 33 parking spaces and a maximum of 50 spaces would be required for the office, and 1 stall would be required for the storage. Based on the information submitted by the applicant, the proposed additions would result in the removal of 4 parking spaces from the site. A total of 57 spaces would be provided on the site after the construction of the proposed additions, which exceeds the number of parking spaces permitted, however the parking lot is existing and the proposed additions would reduce the number of parking spaces provided, therefore modification of the existing parking lot to comply with these requirements is not required. In addition, 3 ADA accessible spaces are provided on the subject site, which complies with the ADA requirements. 3. Mitigation of impacts to surrounding properties and uses; Currently, the subject site is developed with an existing Administrative Headquarters Office and associated outbuildings. Single Family reSidences, an auto repair shop, and an espresso stand surround the subject site. A minimum of 10 feet of sight-obscuring landscaping with a 6-foot barrier wall is required to screen the proposed additions from the surrounding residentially zoned properties. The proposal will improve the character of the site, as additional landscaping will be provided around the proposed addition areas to screen the proposed additions from the surrounding residential uses. Impacts to surrounding properties and uses are expected to be minimal. There are potential short-term impacts to adjacent businesses and nearby residents (e.g., noise), which would result from the construction of the project. These impacts will be mitigated by the applicant's construction mitigation plan, which limits work and haul hours to those permitted by City Code. 4. Mitigation of impacts of the proposed site plan to the site; The proposed additions would be located to the rear of the subject site. The 1-story office/storage building would be located to the west of the existing training center and 15 feet from the nearest property line. Adequate parking will be provided on-site for the patrons of the office use. The Development Agreement requires sight-obscuring landscaping and a 6-foot barrier wall along the property lines abutting a residential zone. The proposed additions are located towards the rear of the subject site and should therefore be sufficiently screened from noise cause by traffic traveling along Maple Valley Road (SR 169). 5. Conservation of area-wide property values; The proposal would allow existing uses in the vicinity to continue operating in their present locations and would provide additional office space for the existing Administrative Headquarters Office. The proposal is anticipated to conserve or enhance property values in the vicinity. 6. Safety and efficiency of vehicle and pedestrian circulation; Access to the subject site is provided via existing commercial driveways onto Monroe Avenue SE and SE 6th Street. In addition a driveway access is provided to the abutting property to the east of the subject site. The vehicular circulation around the subject site would not change with the construction of the proposed additions. The pedestrian circulation would improve as a pedestrian connection from the sidewalk on Maple Valley Road (SR 169) would provide direct access to the Administrative Headquarters Office. The proposed additions are antiCipated to generate additional traffic on the City's street system. In order to mitigate transportation impacts, staff recommends a condition of approval be placed on the project requiring a Transportation Mitigation Fee based on $75.00 per net new average daily trip attributed to the project. The proposed additions are anticipated to generate 27.89 new average weekday trips per lot. The fee for the proposed project is estimated at $2,091.75 ($75.00 x 27.89 trips = $2,091.75) and is payable prior to the issuance of the building permit. 7. Provision of adequate light and air; The proposed building is designed appropriately toallow adequate light and air circulation to the building and the site. The design of the building will not result in excessive shading of the property. In addition, there is ample area surrounding the building to provide for normal airflow. 8. Mitigation of noise, odors and other harmful or unhealthy conditions; The proposal is not expected to create any harmful or unhealthy conditions. Noise, dust, and odors, which may result from the temporary construction on the site, will be mitigated by the applicant's construction mitigation plan and code requirements for the use of Best Management Practices. 9. A vai/ability of public services and facilities to accommodate the proposed use; Fire -Fire Department staff have indicated existing facilities are adequate to accommodate the subject proposal, subject to the applicant's payment of the necessary impact fees. A Fire Mitigation Fee, based on $0.52 per square foot of new commercial building area with credit given for the existing building, is recommended in order to mitigate the proposal's potential impacts to City emergency services. The fee is estimated at $1,817.40 for the proposed addition. Water -The site is currently supplied and connected to the City of Renton Water system. There are existing 12 and 16-inch water mains in Monroe Ave SE. The fire-flow available to the site is approximately 2300 gpm. Static water pressure is approximately 55 psi. The site is within the 196-water pressure zone and within Aquifer Protection Zone 1 (modified). The preliminary fire flow is 2,250 gpm. Per the City of Renton Fire Marshall, a new sprinkler system shall be provided to provide sufficient fire flow. A new water main connection will need to be constructed for the new fire sprinkler system. One hydrant is required within 150 feet of the structure and two additional hydrants are required within 300 feet of the structure. This distance is measured along the travel route. The existing hydrants are adequate. System Development fees are triggered for the new fire service. The fee for redevelopment has been calculated at $986.07. The Development Charges are collected as part of the construction permit. Sewer -The site is currently connected to the City of Renton sewer system. The drainage narrative submitted with the application provides enough information to determine that no new improvements are necessary. 10. Prevention of neighborhood deterioration and blight. No deterioration or blight is expected to occur as a result of the proposal. The site will be developed with two additions to the existing Administrative Headquarters Office. Both additions are proposed to be located towards the rear of the subject site. Parking would be provided onsite in an eXisting surface parking lot. Findings, Conclusions & Decision Having reviewed the written record in the matter, the City now enters the following: 1. Request: The Applicant has requested Site Plan Approval for the Taco Time Office Addition project, File No. LUA05-154, SA-A. 2. Site Plan Review: The applicant's site plan application complies with the requirements for information for site plan review. The applicant's site plan and other project drawings are entered as Exhibits No.2 through 10. 3. Comprehensive Plan: The subject proposal is consistent with the Comprehensive Plan land use designation of Commercial Neighborhood (CN). 4. Zoning: The Site Plan as presented complies with the zoning requirements and development standards of the Commercial Neighborhood (CN) zoning designation, provided all conditions of approval are satisfied. 5. Existing Land Uses: Land uses surrounding the subject site include: North: Residential - 8 dwelling units per acre (R-8) zoning; East: Commercial Neighborhood (CN) zoning; South: Maple Valley Highway (SR 169) and Residential-8 dwelling units per acre (R-8) zoning; and West: Commercial Neighborhood (CN) and Residential - 8 dwelling units per acre (R-8) zoning. 6. Development Agreement: The project is subject to Development Agreement 20000112000255 which limits the proposed expansion of the Administrative Headquarter's Office to 3,500 square feet, and provides specific landscaping, height, and access requirements in addition to the CN development Standards. E. Conclusions 1. The subject complies with the policies and codes of the City of Renton, provided all conditions of approval are satisfied. 2. The proposal complies with the Comprehensive Plan designation of Commercial Neighborhood (CN) and the Zoning designation of Commercial Neighborhood (CN) as superceded per Development Agreement 20000112000255. 3. The proposal complies with Development Agreement 20000112000255 F. Decision The Site Plan for the Taco Time Addition, File No. LUA05-154, SA-A, is approved subject to the following conditions: 1. These notes are provided as information only, they are not subject to the appeal process for administrative determinations. Planning 1. RMC section 4-4-030.C.2 limits haul hours between 8:30 am to 3:30 pm, Monday through Friday unless otherwise approved by the Development Services Division. The Development Services Division reserves the right to rescind the approved extended haul hours at any time if complaints are received. 2. Commercial construction activities shall be restricted to the hours between seven o'clock (7:00) a.m. and eight o'clock (8:00) p.m., Monday through Friday. Work on Saturdays shall be restricted to the hours between nine o'clock (9:00) a.m. and eight o'clock p.m. No work shall be permitted on Sundays. 3. Separate plans and permits are required for the installation of signs. Fire Department 1. The preliminary fire flow is 2,250 GPM. One hydrant is required within 150 feet of the structure and two additional hydrants are required within 300 feet of the structure. All hydrants shall have a Stortz fitting. 2. Automatic fire sprinklers are required. Separate plans and permits are required for the installation of sprinkler and fire alarm systems. 3. Fire department access roadways are required to within 150 feet of all portions of the building exterior. Roadways are a minimum of 20 feet in width with a turning radius of 45 feet outside and 25 feet inside. 4. Fire department dead end access roadways over 150 feet in length are required to have an approved turnaround. Plan Review -Water 1. System Development Charges are estimated at $986.07 for the proposed project. The Development Charges are collected as part of the construction permit. 2. The following is a list of requirements that may apply to a proposed project in Zone 1 Modified. This list is provided for general guidance and is not meant to substitute for review of the Renton Municipal Code (RMC) cited in parentheses. Critical Areas Regulations (RMC 4-3-050): Certain uses prohibited (subsection C8), pesticide and fertilizer use restrictions (H3a), constructed secondary containment may be required if more than 20 gallons of regulated hazardous materials will be on site at the new facility (H2di); hazardous material release restrictions enforced (H10). Aquifer Protection Permits (RMC 4-9-015): Certain uses require operating permits. Construction Activity Standards (RMC 4-4-030C7): Standards shall be followed if, during construction, more than 20 gallons of hazardous materials will be stored on site or vehicles will be fueled on site. Fill Source Statement (RMC 4-4-060L4): A fill source statement is required if more than 50 cubic yards of fill material will be imported to the project site. Surface Water Management Standards (4-6-030E2 and 3): Biofilters, stormwater conveyance, and water quality ponds may require a groundwater protection liner. Impervious surfaces shall be provided for areas subject to vehicular use or storage of chemicals. Sanitary Sewer Standards (4-6-040J): New construction shall connect to a sanitary sewer (septic tanks not allowed) unless the wastewater utility determines that sanitary sewer is not available. Business License Requirements (RMC 5-5-5): New facilities shall provide an inventory of hazardous materials to the Water Utility prior to occupancy. If, upon review of the inventory, the Water Utility determines that an operating permit is required, the permit shall be obtained prior to occupancy of the building. Plan Review -Surface Water 1. EXISTING CONDITIONS WATER -The site is currently supplied and connected to the City of Renton Water system. There are existing 12 and 16-inch water mains in Monroe Ave SE. The fire-flow available to the site is approximately 2300 gpm. Static water pressure is approximately 55 psi. The site is within the 196-water pressure zone. SEWER -There is an existing 15-inch sewer line adjacent to the proposed short plat. STORM -This site is within the Cedar River drainage basin. STREET -There is currently a paved and fully improved public right-of-way adjacent to the site. CODE REQUIREMENTS WATER 1. In accordance with the Fire Department requirement, a new sprinkler system is required to provide sufficient fire flow. 2. A new water main connection will need to be constructed for the new fire sprinkler system. 3. System Development fees are triggered for the new fire service. The fee for redevelopment has been calculated at $986.07. SURFACE WATER 1. Drainage requirements must meet the King County 2005 Surface Water Design Manual. The drainage narrative submitted with the application provides enough information to determine that no new improvements are necessary. WATER: • This project site' is located in the 196 Pressure Zone. Static pressure is approximately 55 psi at street level. (T~J • There is an existing 16" watermain and an existing a,,/'watermain located in Monroe Ave SE, which are only capable of delivering 2,300 GPM. • Per the City of Renton Fire Marshall, the preliminary fire flow demand for the new building is 3,500 GPM, which is above the available fireflow of 2,300 GPM. • The applicant shall reduce the fireflow demand down to 2,300 GPM by using other construction methods, or reducing building size and or adding a fire sprinkler system. • Any new construction must have one fire hydrant capable of delivering a minimum of 1,000 GPM and shall be located within 150 feet of the structure and additional hydrants (also capable of delivering a minimum of 1,000 GPM) within 300 feet of the structure. This distance is measured along the travel route. The applicant is proposing to construct a two-story 3,441 square foot addition on the south end of their existing one-story training center. This will be in addition to their existing 1,920 square foot training facility and 7,792 square foot two-story office building. Although there are relevant land use policies for this project (see attachment) a Development Agreement between the City and the Taco Time takes precedent in terms of what is allowed to occur on the site and what must be done to protect the existing neighborhood. This development agreement was approved by Council as part of a compromise made during review of the Comprehensive Plan and zoning for the site. The Development Agreement (attached) limits the applicant to a one-time expansion of their existing administrative headquarters, as depicted on Exhibit C, by up to 3,500 square feet, subject to: 1) The expansion being limited to office and parking uses; and 2) The site plan review process; and 3) The building expansion being addressed in a single site plan review application with no phasing, and 4) Complete building and construction applications being submitted to the City no later than June 1,2006. A valid approved. site plan for an addition to this facility was approved by the Hearing Examiner in 2002. The amount of development proposed in the current proposal and the approved site plan will not comply with the 1999 Development Agreement which limited future expansion to up to 3,500 square feet for the administrative headquarters building, and parking. Analysis: The proposed two-story addition is not "generally consistent with the conceptual plan in Exhibit C" which placed the one-time, maximum, 3,500 square foot addition on and abutting the south side of the existing administrative headquarters office building. The current expansion proposal shows it going in along the northwest property line in the area labeled "existing portable storage units." Although the Development Agreement allows departure for the conceptual plan shown in Exhibit C it states that "it shall be when changes are warranted in order to meet all applicable City regulations and requirements." Staff is not aware of any such changes. I Taco Time One-time Otp_ Building Expansion 12117/03 • 2 The current proposal for a two-story, 30-foot high storage/office building along the northwest property line, appears to be in conflict with the intent of the landscaping and screening provisions which were to protect Maplewood Park, an adjacent single~family residential area. These provisions include a lO-foot wide "sight-obscuring" landscape strip along the common property line. Staff believes it would be virtually impossible to provide landscaping adequate to visually obscure a two-story high, 61-foot long wall approximately 30-feet high paralleling the c()ffiIllQP .. property linewiththe.residentialneighoorn6odt6:UienoithwesF-:: _. .... . -... . The currently proposed 3,400 square foot expansion of the existing training facility with a ±14-foot high garage and second story for storage and office would, if allowed, require rescinding the applicant's existing site plan approval for expansion and eliminate any further expansion on the Taco Time site. This is because the 1999 Development Agreement clearly stated that the proposed expansion was "to allow existing, legal administrative headquarters offices with a moderate expansion of offices, and parking;" and that this was to be a "one time" allowance, subject to site plan review. In regards to relevant land use policies, there is no indication that the proposed use would reduce automobile travel in the area (Objective LU-FF). Parking expansion apparently is not proposed as part of this one-time expansion. Also, there is no indication that the current proposal complies with Policy LU-219 that states: " ... commercial structures in adjacent Convenience Commercial designations should be compatible with the single-family character of the residential area in height, front yard setbacks, lot coverage and building design. " Clearly, a 121-foot long building 30-feet high on its southern half is not compatible with the adjacent Maplewood Park single-family residential neighborhood. Recommendation: Do not support the proposed two-story 3,441 square foot addition since it does not appear to conform to the provisions of the 1999 Development Agreement nor relevant Convenience Commercial (CC) policies related to protecting the adjacent single-family residential areas. The applicant is cautioned that information contained in this summary may be subject to modification and/or concurrence by official decision-makers (e.g., Hearing Examiner, Zoning Administrator, Board of Adjustment, Board of Public Works, and City Council). Review comments may need to be revised based on site planning and other design changes required by City staff or made by the applicant. The applicant is encouraged to review all applicable sections of the Renton Municipal Code. The Development Regulations are available for purchase for $50, plus tax, from the Finance Division on the first floor of City Hall. Project Proposal: The subject site is addressed as 3300 Maple Valley Highway. The proposal is to construct a two-story 3,441 square foot, wood-framed storage building. The building is proposed to be located directly abutting the existing training facility. According to King County Assessor Records, the site is approximately 58,950 square feet (1.35 acres) and is currently developed with an 8,128 square foot office building and a 1,920 square foot storage warehouse building. Zoning: The site is designated Convenience Commercial (CC) on the City's Zoning Map. General offices require an Administrative Conditional Use to locate in the CC zone, with the following additional restriction noted in Renton Municipal Code Section 4-2-080.A17.b: "Administrative Headquarters Office: New administrative headquarters offices ar~ not permitted [in the CC zone]. For existing, legal administrative headquarters offices greater than three thousand (3,000) square feet in size, and in existence prior to January 1, 1999, the following expansions may be allowed: (i) parking expansion may be allowed; (ii) a one-time expansion of building square footage, not exceeding three thousand five hundred (3,500) square feet, may be permitted subject to site plan review. This provision allowing expansion of building square footage shall expire on December 1, 2006, consistent with any approved Development Agreements or covenants." In addition to the development standards and regulations in the Renton Municipal Code, a Development Agreement was recorded on the property (rec# 20000112000255), as a condition of approval for a previous rezone that specifies additional development restrictions and standards. A copy of the Development Agreement is included in the pre-application file . Taco Time Storage Pre-application Mee. December 23, 2003 Page 2 of 4 The compliance of the proposed building expansion with the applicable development standards of the Development Agreement, the CC zone (where not superceded by the agreement), and the parking regulations is discussed below. Lot Coverage -The CC zone allows building coverage at a maximum of 65% of the lot area for projects not providing structured parking. The combined footprint area of the proposed addition and the eXisting buildings would be approximately 7,788 square feet (3,993 square foot office, 1,950 sqyare foot training facility, 1,845 square foot proposed storage), resulting in building lot covera'ge of approximately 13.2 percent, which meets the requirements of the CC zone. Setbacks -The CC zone requires a minimum setback of 10 feet from all street frontages. In addition, a maximum setback of 15 feet also applies to the street facing fa9ade of the building. The CC zone requires a minimum rear and side yard setback of 15 feet if abutting or adjacent to a residentially zoned property. In this case, the entire property is abutting or adjacent to property designated -R-8 on the City's Zoning Map, with the exception of the eastern boundary, which abuts CC zoned property. Neither the existing storage structures nor the proposed storage structure meet the minimum setback requirement of 15 feet from the north property line. Landscaping -Pursuant to the Development Agreement for the property, a minimum landscape width of 10 feet is required along all street frontages. In addition, minimum sight- obscuring landscaping of widths specified by the Development Agreement are required along property lines that are adjacent or abutting residentially zoned property. Property zoned R-8 exists on the south side of Maple Valley Highway, which is considered to be adjacent to the southern boundary of the property, as well as northeast of the site across SE 6th Street and west of the site across Monroe Avenue SE. The Development Agreement specifies a minimum width of 15 feet for property lines adjacent to residentially zoned parcels. In addition, the site's northwest and northern most boundaries would be considered abutting to R-8 zoned property. The project is required to comply with the standards established by the Development Agreement, which requires a minimum 10-foot sight-obscuring landscape strip along with a solid 6-foot barrier wall, along the north side of the site. The wall is not to be located closer than 5 feet to the property line and a maintenance agreement or easement for the landscape strip must be secured. Pursuant to the Development Agreement, the landscaping must be installed prior to final City inspection of: 1) Any building demolition permits; and/or, 2) Building construction which expands the footprint of current buildings or adds additional buildings on site; and/or, 3) Parking stall additions/reconfigurations which add parking/access areas. A landscape plan was not submitted with the pre-application materials. Therefore, staff could not evaluate the compliance of the proposal with the landscaping requirements of the Development Agreement. Staff discovered, during site visit, that landscaping along the north and northwest property lines had been removed. A landscape plan must be submitted that shows either existing or proposed landscaping and screening that meets the requirements discussed above. Based on the building elevation plans submitted with the pre-application materials, the height of the proposed storage building would be approximately 30 feet. Parking/Circulation -The parking regulations require a specific number of spaces based on the amount of square footage dedicated to certain uses. For office use, a minimum of 3 to a ma><.ir:nu~rT1 oL4:S parkil}gspaces would beJequired for every-l,OOQ~sgl!(3r~feetdedicated to -dflceuse. For theexistihg~officeandtraiiiing ~area-(9,712square feet), a minimum of 29 to a maximum of 44 parking spaces would be required. In addition, indoor storage [requires 1 parking space for every 1,SOO square feet. For the proposed storage area (3,441 square feet), 2 parking spaces would be required. Based on staff calculations, a minimum of 31 and a maximum of 46 parking spaces would be required for the site. The site presently contains 61 parking spaces, as approved through LUA-03-01-11S. No additional parking is proposed as part of the requested storage development. Maximum Expansion -As discussed above, both the City of Renton Development Standards, and the recorded Development Agreement limit the expansion of the existing Administrative Headquarte~§ J(LlL one-time expansion of 3,SOO square feet or less. A previous Land Use Actio't (LUA-01 ~ was evaluated and approved with conditions for a building addition on the east Side of the existing office building. The Site Plan Approval expires on February 28, 2004. A building permit has not been issued for the proposed building expansion. Neither the development standards nor the Development Agreement would permit both the office building expansion and the proposed storage building development. If the applicant wishes to proceed with the requested storage building development prior to the expiration of the already approved Site Plan, a written forfeiture of the approved office building expansion must be given to the Development Services Division by February 1, 2004. General Conformance -Section 3.A.2.c of the Development Agreement states, "Parking and building expansion related to the Taco Time Corporate Offices should be generally consistent with the conceptual plan in Exhibit C, unless, based upon City review, changes are warranted in order to meet all applicable City regulations and requirements." The Development Services Division has reviewed the proposed storage building expansion and does not find that it is consistent with the conceptual plan referenced in the Development Agreement. Staff would not likely support an Administrative Site Plan request for the proposed storage building, due to the inconsistency with the conceptual site plan included with the Development Agreement. Staff recommends that the applicant request an extension to the previously approved Site Plan (LUA-01-115) and proceed with the expansion on the east side of the existing office building, as approved and conditioned. Lot Line Adjustment -In addition to the standards previously discussed, the property was required to complete a lot line adjustment to conform to the approved CC zoning boundary and allow access· across the entire property. As required, the lot line adjustment was completed with the City's approval and recgrded under recording number 20000522900016 in May of 2000. Permit Requirements: The proposed project will require Administrative Site Plan Review. As stated in the Development Agreement, Site Plan Review is required for all development on this parcel. The land use application will be completed in an estimated time frame of 6 to 8 weeks once a complete application is accepted. The application fee will be $1,000 for the Administrative Site Plan Review, plus $0.37' per mailing label required for notification of all property owners within 300 feet of the site. December 23, 2003 • Page 4 of 4 Site Visit Observations While visiting the site, staff noticed several conditions that should be remedied to bring the existing development into compliance with City regulations. The following is a brief summary of some of the conditions observed on site and suggested means of bringing the site into compliance: 1. Existing Condition: Unscreened mechanical equipment next to dumpster in an area that appears to be dedicated as a fire lane. Applicable Code Section: RMC 4-4-095, Screening and Storage Height/Location Limitations Suggested Remedy: Screen all mechanical equipment. Please note: Nothing may be placed in a manner that blocks the posted Fire Lane. Location 0 f mechanical equipment must be cleared with Fire Department. 2. If the subgrade is stable. we recommend that utilities and ut.ility ducts be installed in advance of placing any subbase fill. Utility trenches should be backfilled to pavement suhgrade level with structural fill compacted as previously recommended. If the native subgrade soils can be rOlled to a firm and nonyielding condition during dry weather, a subbase layer is not necessary. However, it ~h.:! pavement areas are prepared during w~.t weat·her, a subbase section consistin& of 12 inches or more of sand and gravel with less than 5 percent passing the No. 200 sieve. based on that fraction passing the 3/4-inch sieve, may be necessary to prepare a stahle subgrade for the pavement sect.ion. The b~se course and asphalt concrete (AC) section should consist of 6 inches of crushed rock and 3 inches of AC in roadway and truck traffic areas.
