EASEMENT
The Grantor, Burlington Northern Railroad Company, a Delaware
corporation, hereinafter called Railway Company, for and in consideration of
Five Thousand Seven Hundred Seventy and No/100 Dollars ($5,770.00) to it paid,
and the agreements herein contained, does hereby grant to the City of Renton,
hereinafter called City, an easement for roadway pur poses over, upon, and across
the following described pr emises situated in King County, State of Washinqton :
That portion of the NE 1/4 NW 1/4 Section 36, Township 23
pNorth, Range 4 East, W.M. , as shown by green color on
� Exhibit "A" print dated 6-11-82, attached hereto and by this
p reference made a part hereof.

0 This easement is made subject to and upon the following express
� conditions:

The Railway Company, for itself and its successors and assigns,
reserves all rights to use the property hereinbefore described for any and all
pur poses wh atsoever not inconsistent with the easement hereby granted,
including, but not 1 imited to, the right to construct, maintain, repair, renew,
reconstruct, repl ace and operate present tracks and future tracks, communica-
tion, signal and electric power 1 ines, util ities and other types of facil ities
on said property when deemed necessary or expedient to the Railway Company.
Rights reserved shall be so exercised as not to d amage or interfere with the
roadway as above defined. This easement is subject to all existing interests of
third parties in said property of any kind or nature whatsoever and any and all
extensions or renewals thereof.

The City agrees to provide, at its sole cost and expense, adequate
drainage of the Railway Company's property in connection with construction and I�
maintenance of said roadway, also agrees to reimburse the Railway Company for
any and all expense incurred by it by reason of any failure of the City to
provide such drainage.
III
It is understood that the details of construction an� maintenance of
said roadway are covered by separate contract dated 1-5-83 , between
the Railway Company and the City, the terms of which are by this reference fully
incor por ated and made a part hereof.
IV
In the event that said property shall at any time cease to be used by
the city for roadway purposes, or shall by operation of law or otherwise become
vacated or abandoned, the easement herein gr anted shall immediately cease and
terminate without notice or other proceedings on the part of the Railway
Company, and the City, its successors or assigns, shall reconvey immediately
said property to the Railway Company.

instrument and that the seal affixed is the corporate seal of said Burl ington
Northern Railroad Company.
