Beginning at the northeast corner of said Government lot 9 ;

Said heretofore mentioned grantee, its successors or assigns, shall
have the right, without prior notice or proceeding at law, at such times as
may be necessary to enter upon said above described property for the purpose
of constructing, maintaining, repairing. altering or reconstructing sald
uti 1 i ty, or maki ng any connecti ons therewi th, wi thout i ncurri ng any legal
i � abligations or liabillty therefore. provided. that such construction. main-
taining� repairing, altering or reconstruction of such utility shall be
� accomplished in such a manner that the private irrQrovements existin9 in the right
�, right(s)-of-way shall not be disturbed . or damaged, or in the event they are
�' disturbed or damaged, they wi 11 be repiaced in as good a condi tion �s they were
� immediately before the property was entered upon by the Grantee.

� The Grantor shall fully use and enjoy the aforedescribed premises,
including the right to retain the right to use the surface of said right-of-way
if such use does not lnterfere with installation and maintenance of the utility
1 ine. However, the grantor shall not erect bui 1 dings or structures over, under
� or across the right-of-wa�y during the existence of such utillty.
This easement. sAall be a covenant running with the land and shall be bind-
ing on the Grantor. his successors . heirs and assigns. Grantors covenant that
they are the lawful owners of the above properties and that they have a good and
lawful right to exe,�cute thi agreement.
