Grantor shall not be liable for any loss or damages to Grantee' s facilities resulting from Grantor' s use of the lands encumbered by this easement unless such loss or damage is due to negligent act or omission of Grantor. 3 . Grantor reserves the right to develop and use the lands encumbered by this easement for any purpose not inconsistent with the rights granted herein. If the Grantee, its successors or assigns, make an excavation in the Grantor's property, it shall, without delay, restore the surface as nearly as practicable to the same condition as it was immediately prior to such work. 7.
