between PUGET SOUND POWER & LIGHT COP•1PANY, a shingt
corporation ( "Grantor" herein) and the CITY OF RENTON, a
Municipal corporation of King County, Washington, ( "Grantee"
herein) ;
WITNESSETH:
That in consideration of Ten Dollars ( $10.00 ) and other good
and valuable consideration, in hand paid , receipt of which is
hereby acknowledged, and performance by Grantee of the covenants
hereinafter set forth, Grantor hereby grants unto Grantee a
perpetual easement over, across and under the following described
property, situated in Ring County , �Vashington: � � � +

maintaining, removing, repairing, replacing and using a storm

� sewer line with all connections, manholes and appurtenances
�}+ thereto, is granted on the following terms and conditions:

1. Grantee agrees to save and hold Grantor harmless from
all loss or damage which may be due to the exercise by Grantee of
the rights herein granted, and from all claims for such damage by
whomsoever made and to indemnify Grantor for all such loss,
damage and claims.
2. Grantor shall not be liable for any loss or damages to
Grantee' s facilities resulting from Grantor' s use of the lands
encumbered by this easement unless such loss or damage is due to
negligent act or omission of Grantor.
3 . Grantor reserves the right to develop and use the lands
encumbered by this easement for any purpose not inconsistent with
the rights granted herein. Without limiting the generality of
the foregoing, Grantor reserves the right at any time, and from
time to time , to construct or reconstruct electric lines (whether
AC or DC; whether now existing or hereafter to be construc� .��,on

� 4..�r1�'Grantor reserves the right to grant access rights to

to grant any other right which is not inconsistent with the
rights herein granted to Grantee.
5. Should the easement area be subsequently improved,
Grantee agrees that it shall, at its sole cost and expense,
replace or restore to its improved condition any such
improvements which are damaged or destrayed as the result of
Grantee's exercise of its rights of maintenance, repair or
replacement.
6. If the Grantee, its successors or assigns, make an
excavation in the Grantor's property, it shall, without delay,
restore the surface as nearly as practicable to the same
condition as it was immediately prior to such work.
7. The rights and obligations of the parties shall inure
to the benefit of and be binding upon their respective successors
and assigns.

EXHIBIT "A"
PARCEL A:
A 15 foot wide storm sewer easement having the following
described centerline:
Beginning at a point on the Northerly Right-of-Way margin of
Puget Drive, 62.95 feet Easterly as measured along said margin
from the intersection with the Easterly margin of the Talbot Road
Extension, being within the Northeast Quarter of Section 19 ,
Township 23 North, Range 5 East, W.M. ; thence ra15°37' 10"E throuqh
the Bonneville Power Administration' s 250 foot Right-of-Way,
48. 59 feet to an angle point; thence N17°08 ' 25"W, 216. 31 feet to
the Northeasterly margin of said power Right-of-Way and the
� terminus of said margin bearing S55°13 '32"E, 18.85 feet from the
� Talbot Road margin.
� The margin lines of this easement extend to their intersections
Jwith the Southerly and Northerly boundaries of the subject
� parcel.

PARCEL B:
A 15 foot wide storm sewer easement, a portion of which lies
, within the South 125 feet of the City of Seattle' s 200 foot
Diablo Right-of-Way as contained in instrument reco-rded under
Auditor' s File No. 3560496 , lying in the Northeast Quarter of
Section 19 , Township 23 North, Range 5 East, W.M. , and East of
the Talbot Road Extension Right-of-Way; having the following
described centerline:
Beginning on the South line of said South 125 foot portion of the
Right-of-ti�ay bearing N87°23 '49"E, 3.35 feet Easterly of the
Talbot Road margin; thence N17°08' 25"W, 14.71 feet to the
terminus on the said road margin, 14.24 feet Northerly, as
measured along said margin from the said South line. The
Easterly line of this easement extends North and South to
intersect the road margin and power line South line.

8 . The rights hereby granted shall cease and determine
whenever Grantee shall have permanently abandoned the use of its
facilities accommodated by this easement for a period of five
years.
