That said Grantor(s) , for and in consideration of the sum of $

� A strip of land being 20 ft. in width lying 10 ft. southerly and northerly as measured
at right angles to the following described centerline, located in the SW 1/4 of Section
3 Township 23 N. , Range 5 E. , of the IN.M. :
Commencing at intersection of Sunset Blvd. NE and Whitman Ct. NE; thence S. 1°05'18"
W. a distance of 193.24 ft. along the centerline of Whitman Ct. NE; thence N. 82°31 '34"
W. a distance of 30.3 ft. to the westerly right-of-way line of Whitman Ct. NE and the
noint of beginning of said easement centerline; thence N. 82°31'34" N'. a distance of
365.53 ft. more or less to the terminus of said easement centerline.
The owner shall be permitted to construct permanent structures over the proposed storm
drain easement provided the construction does not interfere with the structural
stability or functional operation of the pipe. The owner agrees to hold the City
harmless for any damage to any building or other appurtenances constructed over the
pipe, caused by malfunctioning or failure of the pipe, and to repair or relocate said pipe
if necessary at no expense to the City of Renton.
Any plans for construction over the proposed pipe shall be approved by the City of ;
Renton Public Works Department prior to construction.

Together with a temporary construction easement described as :
Said temporary construction easement shall remain in force during construc-
tion and until such time as the roadway, utilities and appurtenances have been
accepted for the ope ration and maintenance by the Grantee but not later than

Sai d heretofore mentioned grantee, i ts successors or assi gns , shal l have
the right, without prior notice or proceeding at law, at such times as may be
necessary to enter upon said above described property for the purpose of construct-
ing, maintaining, repairing, altering or reconstructing said roadway and utilities ,
or making any connections therewith, without incurring any legal obligations o r
liability therefore, provided, that such construction, maintaining, repairing,
altering or reconstruction of said roadway and utilities shall be accomplished in
such a manner that the private improvements existing in the right(s)-of-way shall
not be disturbed or damaged, they will be replaced in as good a condition as they
were i mmedi ately before the property was entered upon by the Grantee.
The Grantor shall fully use and enjoy the aforedescribed premises , including
the ri ght to retai n the ri ght to use the s urface of sai d ri ght-of-way i f s uch use
does not interfere with installation and maintenance of the roadway or utilities .
However, the grantor shall not erect buildings or structures over, under or across
the right-of-way during the existence of such roadway and utilities .
This easement, shall be a covenant running with the land and shall be bind-
ing on the Grantor, his successors , heirs and assigns . Grantors covenant that they
are the lawful owners of the above properties and that they have a good and lawful
ri ght to execute thi s agreement.
