Sai d heretofore menti oned grantee, i ts successors or assi gns , shal l have the right, without prior notice or proceeding at law, at such times as may be necessary to enter upon said above described property for the purpose of constructing, maintaining, repairing, altering or reconstructing said utility, or making any connections therewith, without incurring any legal obligations or liability therefore, provided, that such construction, main- taining, repai ri ng, al tering or reconstructi on of such uti 1 i ty shal l be accomplished in such a manner that the prtvate improverr�nts existing in the right right(s)-of-way shall not be disturbed or damag�d, or in the event they are di s turbed or damaged, they wi 11 be repl aced i n as good a condi ti on as they were immediately before the property was entered upon by the Grantee. The Grantor shall fully use and enjoy the aforedescribed premises, including the right to retain the right to use the surface of said right-of-way if such use does not interfere with installation and maintenance of the utility line . However, the grantor shall not erect buildings or structures over, under or across the �right-of-way during the existence of such utility. This easement, shall be a covenant running with the land and shall be �ind- ing on the Grantor, his successors , heirs and assigns.
