CYJ WITNESSETH: WHEREAS SERVICE LINEN SUPPLY, INC. , is the owner in fee of the following described real property situated in King County, Washington: Lot 19 and 20, Block 16, Town of Renton Addition as per plat recorded in Volume 1 of Plats, page 135, records of King County, Washington and the east 90 feet of Lot 1 and all of Lot 2, Block 16, Town of Renton Addition as per plat recorded in Volume 1 of Plats, page 135, records of King County, Washington; hereinafter referred to as Parcel A; and WHEREAS, 5 J COMPANY is wholly owned by Frank Raphael and Paul Jassny as tenants in common and is the owner in fee of the following described real property situated in King County, Washington: The west 30 feet of Lot l, Block 16, Town of Renton Addition as per plat recorded in Volume 1 of Plats, page 135, Records of King County, Washington; hereinafter referred to as Parcel B; and WHEREAS D B COMPANY is wholly owned by Robert B. Raphael, David H. Jassny and Camille B. Jassny as tenants in common and is the owner in fee of the following described real property situated in King County, Washington: Lot 8, Block 15, Town of Renton as per plat recorded in Volume 1 of Plats, page 135, records of King County, Washington except the westerly 5 feet thereof conveyed to the City of Renton for alley purpo�es by deed recorded under auditors' file No. 4571646 and Lot 7 in Block 15 of Town of � 4�� � � � , �:_ Renton, as per plat recorded in Volume 1 of plats, page 135, records of King, Washington except the westerly 5 feet thereof conveyed to the City of Renton for alley purposes by deed recorded under recording No. 4571646 and except that portion of said Lot 7 conveyed to City of NRenton for street purposes by deed recorded under � recording No. 730518-0522; -- hereinafter referred to as Parcel C; and � N WHEREAS SERVICE LINEN SUPPLY, INC. , applied to the City of � CD Renton for approval of conditional use permits to allow for a minor addition to the SERVICE LINEN SUPPLY, INC. , structure located on Parcels A and B to allow for the required parking under Renton City Ordinances to be provided by the parking lot located on Parcel C; and WHEREAS, the City is concerned that the approved parking lot remain available for use by the principal structure on Parcels A and B unless Parcels A and B can provide other sufficient parking; NOW, THEREFORE, in consideration of the sum of TEN AND NO/100 DOLLARS ($10. 00) , receipt of which is hereby acknowledged, and for other good and valuable consideration, the parties covenant and agree for themselves and all their future grantees, heirs, successors and assigns as follows: 1. D B COMPANY, as grantor, hereby grants and conveys to SERVICE LINEN SUPPLY, INC. , and to S J COMPANY, its successors and assigns, a perpetual easement subject to the terms and conditions set out below over and across Parcel C for surface parking for the benefit of Parcel A and B. 2 . D B COMPANY shall not build, maintain or permit any use on Parcel C during the life of this easement which interferes with SERVICE LINEN SUPPLY'S and S J COMPANY'S right to such surface parking. 3 . This easement shall be rescinded upon the request of the then owners of Parcel C at such time as: (a) the City of -2- . ,' , . • � , Renton eliminates the off-street parking requirements; (b) the structure on Parcels A and B is redesigned to provide on site all � parking as required by the then-effective City of Renton � ordinances; (c) other arrangements are made to provide for c "' required parking for Parcels A and B; or (d) the present use of N Parcels A and B is discontinued or abandoned. Any rescission tn � under this paragraph is subject to the approval by the City Council of the City of Renton and such approval shall not be unreasonably withheld. 4 . It is the intent of this easement and agreement to assure that, as long as Parcels A and B remain in their present use and require off-site parking to meet City requirements, Parcel C be used to provide that required parking, and this easement and agreement shall be interpreted accordingly. 5. The rights and obligations of the parties herein shall inure to the benefit of and be binding upon their respective heirs, successors and assigns, including, without limitation, all subsequent owners of Parcel A, Parcel B and Parcel C and all persons claiming under them.
