t,';� THIS INSTRUMEN'1', made this �j'A { i day of May, 1985 , by and
� between THE FRANCK-THOMAS PARTNERSHIP, a Washington general
`"� partnership consisting of James Franck and Donald Thomas herein-
�
� after called "Grantor, " and the CITY OF RENTON, a municipal
�7 corporation of King County, Washington, hereinafter called
� "Grantee. "
W I T N E S S E T H:
That said Grantor, for and in consideration of the sum of
$1 . 00 paid by Grantee, and other valuable consideration, do by
these presents grant, bargain, sell, convey, and warrant unto the
said Grantee, its successors and assigns, an easement for public
utilities consisting of water and sewer with necessary appurte-
nances over, through, across and upon the following described
property in King County, Washington, more particularly described
as follows:
The Westerly 127 feet of the Southerly 15 feet of
Lot 5 , Earlington Industrial Park No. 1 , as recorded
September 22, 1967 , in Volume 83 , page 10 , Subdivision
Records of King County, Washington.
Said heretofore mentioned Grantee, its successors or as-
signs , shall have the right, upon reasonable notice (unless an
emergency exists in which case notice may be dispensed with) or
proceeding at law, at such times as may be necessary to enter
upon said above described property for the purpose of construct-
ing, maintaining, repairing, altering or reconstructing said
utilities, or making any connections therewith, without incurring
any legal obligations or liability therefor, provided, that such
construction, maintaining, repairing, altering or reconstruction
of said utilities shall be accomplished in such a manner that the
private improvements existing in the right (s) -of-wa_y shall not be
disturbed or damaged, and if disturbed or damaged, they will be
replaced in as good a condition as they were immediately before
the property was entered upon by the Grantee and Grantee will
indemnify and hold Grantor harmless from and against all damages,
claims and liabilities that arise from Grantee ' s exercise of its
rights hereunder.
The Grantor shall fully use and enjoy the aforedescribed
premises, including the right to retain the right to use the
surface of said right-of-way if such use does not interfere with
installation and maintenance of the utilities. However, the
Grantor shall not erect buildings and structures over, under or
across the right-of-way during the existence of such utilities.
This easement shall be a covenant running with the land and
shall be binding on the Grantor, his successors, heirs and
assigns. Grantor covenants that it is the lawful owner of the

above properties and that it has a good and lawful right to
execute this agreement.

� On this i�T� day of May, 1985, before me, the undersigned,
a Notary Public in and for the State of Washington, duly commis-
sioned and sworn personally appeared JAMES FRANCK to me known to
be one of the General Partners of The Franck-Thomas Partnership,
the partnership that executed the foregoing instrument, and
acknowledged the said instrument to be the free and voluntary act
and deed of said partnership for the uses and purposes therein
mentioned, and on oath stated that he was authorized to execute
the said instrument.
WITNESS my hand and official seal hereto affixed the day and
year in this certificate above written.
