THIS INSTRUMENT, made this � day of , 19 ��, by
and between Union Avenue Company, a Limited Partnership, organized
under the laws of Washington, and Metropolitan Federal Savings and Loan
Association of Seattle, as beneficiary under the Deed of Trust
hereinafter called "Grantors" , and the CITY OF RENTON, a Municipal
Corporation of King County, Washington, hereinafter called "Grantee" .
WITNESSETH:
The said Grantor( s) , for and in consideration of the sum of
$10 .00 paid by Grantee, and other valuable
� consideration, do by these presents , grant , bargain, sell , convey, and
�p warrant unto the said Grantee , its successors and assigns , an easement
� for a water line with necessary appurtenances over, through, across and
� upon the following described property in King County, Washington, more
� particularly described as follows:

� A portion of the Northeast 1/4 of the Southeast 1/4 of Section 16 ,
� Township 23 North , Range 5 East , W.M.
Said easement being 20. 00 feet in width and having 10. 00 feet of
said width on each side of the centerline described as follows : �
COMMENCING at the point referred to as Point "C" in that water �,
line easement granted to the City of Renton under Auditor' s File I
No . 8405110646 Records of said Co unty; thence N 89°00 '35" W along
the centerline of the 40.00 foot wide easement , 168.52 feet to the
beginning of a curve to the left having a radius of 250. 00 feet;
thence Southwesterly along said curve and centerline through a
central angle of 50°08 '35" an arc distance of 218. 79 feet ; thence
N 49 °09 ' 10" W 20.00 feet to the Northwesterly margin of said
easement and the POINT OF BEGINNING; thence continuing
N 49°09 ' 10" W 11 .00 feet to the terminus of said easement .
The sidelines of said easement shall lengthen or shorten as
necessary to begin on said Northwesterly margin.
Said heretofore mentioned Grantee, its successors or assigns ,
shall have the right, without prior notice or proceeding at law, at
such times as may be necessary to enter upon said above described
property for the purpose of constructing , maintaining , repairing ,
altering or reconstructing said utilities , or making any connections
therewith, without incurring any legal obligations or liability
therefore, provided , that such construction, maintaining , repairing,
altering or reconstruction of said utilities shall be accomplished in
such a manner that the private improvements existing in the
right( s)-of-way shall not be disturbed or damaged, they will be
replaced in as good a condition as they were immediately before the
property was entered upon by the Grantee.
The Grantor shall fully use and enjoy the aforedescribed premises ,
including the right to retain the right to use the surface of said
right-of-way if such use does not interfere with installation and
maintenance of the utilities . However, the Grantor shall not erect
buildings or structures over, under or across the right-of-way during
the existence of such utilities .
This easement shall be a covenant running with the land and shall
be binding on the Grantor, his successors , heirs and assigns . Grantors
covenant that they are the lawful owners of the above properties and
that they have a good and lawful right to execute this agreement .
