DECLARATION OF RESTRICTIVE COVENANTS
WHEREAS, Star Machinery Company is the owner of the following real property
in the City of Renton, County of King, State of Washington, described as follows:

WHEREAS, the owners of said described property, hereinafter "the property,"
desire to impose the following restrictive covenants running with the land as to
use, present and future, of the property in order to obtain a permit to fill the
described property;
NNOW, THEREFORE, the aforesaid owners hereby establish, grant and impose
� restrictions and covenants running with the land as to the use of the land
� hereinabove described with respect to the use by the undersi:gned, their successors,
Cheirs and assigns, as follows:
� LANDFILL OPERATIONS

Erosion control measures such as hydroseeding, if necessary, shall be approved by
the Planning and Public Works Departments, City of Renton, to afford maximum '
protection from siltation of adjacent properties and drainage ways.
Appropriate dust and mud control measures shall be taken as required by the Public
Works Department.
Coordination of the final elevation of the landfill with the northerly adjacent
properties per approval of the Public Works Department shall be required. �
Landfill operations shall be completed within one year.
_� TRAFFIC CONTROL DEVICES
� Traffic control devices as required by the Public Works Department shall be provided.
FINAL DEVELOPMENT APPROVAL
Final approval of the uses and site plan for the property shall be required by the
Hearing Examiner after conducting a public hearing. Submittal of rehabilitation
plans with the special permit application for development of the site shall be
required.
OTHER APPROVALS
Final approval of the proposal by the King County Department of Hydraulics Division
of the Flood Zone Control Permit shall be required.
DURATION
These covenants shall run with the land and expire on December 31, 2025. If at any
time inprovements are installed pursuant to these covenants, the portion of the
covenants pertaining to the specific installed improvements as required by the
Ordinances of the City of Renton shall terminate without necessity of further
documentation.
Any violation or breach of these restrictive covenants may be enforced by proper
legal procedures in the Superior Court of King County by either the City of Renton
or any property owners adjoining subject property who are adversely affected by
said breach. Reasonable attorneys' fees incurred during an enforcement proceeding
will be borne by the parties whom the court determines are in error and shall be
entered as a judgment in said action.

That portion of Government Lot 2 AND the Northeast 1/4 of the Northwest 1/4 of
Section 36, Township 23 North, Range 4 East, W.M. , in King County, Washington,
Nlying Easterly of West Valley Road and Westerly of Puget Sound Electric Railway
0 right of way and lying between lines 150 feet and 480 feet North of ineasured at
