Nunn, a single woman, is the owner of the following real n property in the City of Renton, County of King, State of Washington, described as � follows: � Tax Lot No. 21/Tax Account #162305-9021-06: � The North � of the Southwest �a of the Northeast �a of the Northeast �a of Section 'I `� 16, Township 23, Range 5, EWM, less North 125 feet. ' � �I � WHEREAS, the owner of said described property, hereinafter "the property," �� desires to impose the following restrictive covenants running with the land as to r- use, present and future, of the property; � � NOW, THEREFORE, the aforesaid owner hereby establishes, grants and imposes �-�f o restrictions and covenants running with the land as to the use of the land hereinabove 0 _ described with respect to the use by the undersigned, her successors, heirs and assigns, rn as follows: ;-... � ACCESS .-a ~� Development of the site shall be subject to provision of adequate access to and from the property per applicable city ordinances and regulations. The owner of the above described property, her successors, heirs and assigns, hereby agree and covenant to participate in, sign a petition in support of, and accept any future Local Improvement District (LID) or city initiated proposal, and pay their fair share therefore, for the purposes of providing the necessary off-site improvements, including but not limited to Union Avenue S.E. and N.E. 4th Street, required by the Renton Subdivision Ordinance. Said improvements shall include but may not be limited to the installation of curbs, gutters, sidewalks, street paving, sanitary sewers, storm sewers, undergrounding of utilities, and street lighting. SITE DEVELOPMENT All site and landscape plans shall require approval by the Planning Department, City of Renton. Retention of existing vegetation is recommended, and Planning Department approval is required prior to removal of any trees on the site. The building height shall not exceed 35 feet. The building setbacks along the southern and western boundaries shall not be less than 30 feet. DURATION These covenants shall run with the land and expire on December 31, 2025. If at any time improvements are installed pursuant to these covenants, the portion of the covenants pertaining to the specific installed improvements as required by the Ordinances of the City of Renton shall terminate without necessity of further documentation. Proper legal procedures in the Superior Court of King County may be instigated by either the City of Renton or any property owners adjoining subject property who are adversely affected by any violation or breach of these restrictive covenants. Reasonable attorneys' fees incurred during an enforcement proceeding will be borne by the parties whom the court determines are in error and shall be entered as a judgment in such action.
