` "Sa1d heretofore mentioned grantee� its successors or asslgn5� shall have
the right. withaut prior notice or proceeding at law� at sucl� times as may be
necessary to enter upon sald above descrlbed property for the purpose of construct-
ing, maintaining� repairing� altering or reconstructing said ut111t1es, or making
any cannections thPrewith, wjthout incurring any legal obligations or liability
therefore� provided, that such construction� maintaining� repairing� altering or
reconstructlon of sald utilitles shall he accomplished in such e rnanner that the
private ,lmprovements existing 1n the rlyht(s)-of-way shall not be disturbed or
damaged� they w111 be replaced in a5 good a conditlon as they were immedlately

before the property was entered upon by the Grantee.
The Grantor shall fully use and en,�oy the aforedescribed premises� including
the rlght to retain the right to use the surface of sald right-of-way 1f such use
does not interfere wlth in5tallatlon and maintenance of the utilities. However�
the grantor shnll not erect buildings or structures over� under or across the
rlght-of-way during the existence of such ut111ties.
Th1s easement� shall be a covenant running with the land and shall be binding
on the Grantor, h1s successors� heirs and assigns. Grantors covenant that they
are the lawful owners of the above properties and that they have a good and lawful
rlght to execute this agreement. ,
