real property("Property")described above,the Grantor(s),the owner(s) in fee of that Property, hereby
cavenan#s{covenant}with City or Renton,a politica] suhdivision af the state of Washington,that
he/she{they)will observe,consent to.and abide by the conditions and obli�ations set farth and dcscribed
in Paragraphs 1 throu�,h 8 below with regard to the Property. Grantor(s)hereby grants(grar�t),
covenants(c�venant}, and agrees(a�,ree}as follows:
1. Cirantor(s}ar hisJher(their}successors in interest and assigns{"tJ�vners"}shall retain, uphold,
and pratect the stormwater management devices,features,pathways, limits,and restrictions,known as
flow conlrol best managernent practices('BMPs"), shown on the approved Flow Cantrol BMP Site E'lan
for the Property atiached hereto anci incorporated herein as Exhibit A.
2. "I'he Owners shali at their own cost,operate, maintain, and keep in good repair,the Property's
BMPs as described in the approved Design and Maintenance Details for each BMP attached hereto and
incorporated herein as Exhibit B.
3. City or Rer�ton sl�all pravide at least 30 days written notice to the Owners that entry on the
Peoperty is planned for the inspection af the BMPs. After the 30 clays,the Owners shall allow tl�e City af
Renton to ente�•for thc sale purpose of inspecting tl�e F3MPs. In lieli of inspection by the City,the
Owncrs may elect to engage a licensed civil engineer registered in the state of Washington who has
expertise in drainage to inspect the BMPs and provide a written repart describing their condition, If the
engineer option is chosen,the C)wners sha11 provide written notice to the City of Renton within fifteen
days of receivinb t}�e City's notice of inspection. W ithin 30 days of giving this notice,the t?�vners,ar the
engineer on behalf of the Owners,shall provide the engineer's report to the City of Renton. Ifthe repork
is not provided in a timely manner as specified above,the City of Renton may inspect the BMPs witi�out
further»o#ic.e.
4. If the City determines from its inspection,or from an engineer's report provided in accordance
with Naragraph 3, that maintenance,repair, restoration,and/or mitigatian work is required for ihe BMPs,
Tl�e C.'ity shall notify the Owners of the specific maintenance, repair,restoration,and/or mitigation work
(Wark}reqiiired u«dcr RMC'4-6-U30. TI}e City shall also set a reasanable deadline far campieting the
Work or pravic�ing an engineer's report that verifies completion of the Wark. After the deadline has
passed, the Owners shall allow the City access to re-inspect the BMPs unless an engineer's report has
been provided verifying completion of the Work. [f the work is not completed properly within the time
frame set by the City,the City may initiate an enforcement action. Failure to properly maintain the BMPs
is a violation of RMC 4-6-030 and may subject the Owners to enforcement under the RMC 1-3, including
fines and penalties.
5. Apart from performing routine landscape maintenance,the Owners are hereby required to
obtain written approval from the City or Renton before performing any alterations or modifications to the
BMPs.
6. Any notice or approval required to be given by one party to the other under the provisions of
this Declaration of Covenant shall be effective upon personal delivery to the other party, or after three(3)
days from the date that the notice or approval is mailed with delivery confirmation to the current address
on record with each Party. The parties shall notify each other of any change to their addresses.
7. This Declaration of Covenant is intended to promote the efficient and effective management of
surface water drainage on the Property,and it shall inure to the benefit of all the citizens of the City of
Renton and its successors and assigns. This Declaration of Covenant shall run with the land and be
binding upon Grantor(s), and Grantor's(s')successors in interest and assigns.
8. This Declaration of Covenant may be terminated by eYecution of a written agreement by the
Owners and the City of Renton that is recorded by King County in its real property records.

EXHIBIT B
BASIC DI5PERSION MAINTENANCE INSTRUCTIONS
Your property contains a stormwater management fiaw controi BMP(best management practice) called
"basic dispersion," which was installed to mitigate the stormwater quantity and quality impacts of some
or all of the impervious surfaces or non-native pervious surfaces on your praperty. Basic dispersian is a
strategy for utilizing any avai(abie capacity of ansite vegetated areas to retain, absorb, and filter the
runoff fram develaped surfaces. This flow control BMP has two primary components that must be
maintained: (1)the devices that disperse runaff fram the developed surfaces and �2}the vegetated area
over which runoff is dispersed.
Dispersian Devices
The dispersion devices used on yaur property include the following as indicated on#he flow cantrol BMP
site plan:�splash blocks, ,� rack pads,�gravel filled trenches,�,sheet flow.The size, placement,
composition, and dawnstream ffowpaths of these devices as depicted by the flow contral BMP site pian
and design details must be maintained and may nat be changed withaut written approval from the City
of Renton.
Dispersion devices must be inspected annually and after major storm events to identify and repair any
physical defects.When native sail is exposed or erosion channels are present,the sources of the erosion
or concentrated flow need ta be identified and mitigated. Concentrated flaw can be mitigated by
leveling the edge of the pervious area and/or realigning ar replenishing the racks in the dispersion
device,such as in rock pads and gravel fifled trenches.
Vegetated Flowpaths
The vegetated area over which runoff is dispersed must be maintained in good condition free of bare
spots and obstructions that would cancentrate flows.
