The pipeline shall be located upon the Westerly 15 � feet of the following described property: �--- The North 320 feet of the North one-half of � that part of the East one-half of the West one-half of the Southwest one-quarter of the Southeast one-quarter (East one-half of the West one-half of the Southwest one-quarter of the Southeast one-quarter) of Section 3, Township 23 North, Range 5 East, W.M. , lying South of the Center Line of Sunset Highway, as now located thereon, located in King County, Washington. Grantee shall bear and promptly pay all costs and expenses associated with the construction of the drainage pipeline. Said pipeline shall be built according to plans approved by the City of Re.nton. Grantees, their successors and assigns, shall have the right, without prior notice or proceeding at law, at such times as may be necessary to enter upon said described property for the purpose of constructing, maintaining, repairing, altering or reconstructing said drainage pipeline or making any connections therewith, without incurring any legal obligations or liability therefrom, provided that said construction, maintaining, repairing, altering or reconstruction of said drainage pipeline be accomplished in a manner in which the private improvements existing in the easement shall not be disturbed or damaged, or they be replaced in as good a condition as they were immediately before the property was entsred upon by the Grantees. The Grantors shall have the full use and enjoyment of the easement area to the extent not inconsistent with the rights granted herein, including the right to retain and continue use of the surface and subsurface of said easement if such use does not interfere with the installation, use, and maintenance of the drainage pipeline. However, the grantor shall not erect buildings or structures over, under or across the easement, nor permit or plant any trees or large vegetation within said easement during the existence of the drainage pipeline. �- Grantor, its successors and/or assigns, shall have the right to connect drainage of surface storm water from Grantor's property to the pipe in the easement at Grantor's, its successors and/or assign' s expense, upon approval by the City of Renton of plans and permits, providing that such connection does not exceed the capacity of the pipe to carry surface storm water runoff without backup of the water in the pipe or the Summerwind storm water drainage. This easement shall be a covenant running with the land and shall be binding upon the grantor, its successors, heirs and assigns. Grantors covenant that they are the lawful owners of the above properties and that they have a good and lawful right to execute this Agre�ment.
