may be necessary to enter upon said above described property for the purpose
� ' of constructing, maintaining, repairing, alteriny or reconstruct�ing said
utility, or making any connections therewith, vrithout incu��ring any legal
obl i gations or 1 i abi 1 i ty there�fore, provi ded, ti�at such constructi ar� , main-
tai ni ng, repai ri ng, a1 teri ng or reconsi:ruc�ti on of such uti 1 i ty si�al l be
accomplished in such a manncr that the �rtvate improvements existing in the righi:
right(s)-of-way shall not be disturbed or dama��d, or in the event they are
disturbed or damaged, they will be replaced in as good a condition as they were
imn�ediately before the properi;y was entered upon by the Grante�.
The Grantor shall fully use and enjoy the aforedescribed premises ,
. including the right to retain the right to use the surface of said right-of-way
if such use does not interfere with installation and maintenance of the ut�ility
line . However, the gra�7tor shall not erect buildings or structures over, under
or across the •ri�ght-of-way during the existence of such ut�ility.
This easement, shall be a covenant running w�ith the land and shall be l�ind-
ing on the Grantor, his successars , heirs and assigns. Grantors covenant ti�at
they are the lawful owners of the above properties ancl �hat they have a good and
� lawful right to execute this agreement.
