DECLARATION OF RESTRICTIVE COVENANTS

— WHEREAS, Frank C. Rice and his wife Glenna B. Rice, Dale F. Hollister and his
� wife Elsie M. Hollister, and Norman W. McCue, a single man, are the owners of the
:�:; following real property in the City of Renton, County of King, State of Washington,
-� described as follows:

�_�, Tract 181 , C.D. Hillman 's Lake Washington Garden of Eden Addition to SeattTe,
�� N Division No. 3, according to the Plat recorded in Volume 11 of Plats, page
;:; N 81 , in King County, Washington, lying southeasterly of the southeast margin
� '�' of Lake Washington Boulevard Northeast (Kennydale Newport Road) ; together
' with that portion of vacated County Road No. 34 described as follows:

N Beginning at the southeast corner of said Tract 181 ; thence northerly along '
� � the easterly line of said tract 181 , to the southwesterly line of said
`a � vacated County Road No. 34; thence continuing northerly along the last

� �p described line extended to a point of intersection with the southeasterly
�;� margin of Lake Washington Boulevard Northeast (Kennydale Newport Road) and
the terminus of said line.
;� WHEREAS, the owners of said described property, hereinafter "the property,"

�'� desire to impose the following restrictive covenants running with the land as to
�
� � use, present and future, of the property;
NOW, THEREFORE, the aforesaid owners hereby establish, grant and impose
restrictions and covenants running with the land as to the use of the land
hereinabove described with respect to the use by the undersigned, their successors,
heirs and assigns, as follows:
RESTRICTION OF HEIGHT
No building or structure developed on the property shall exceed a height of twenty-
five (25) feet.
SETBACKS
Pursuant to the City of Renton Zoning Ordinance, a twenty-five (25) foot rear yard
setback shall be maintained along the eastern property line; and a twenty (20)
foot front yard setback shall be maintained along the western property line adjacent
to Lake Washington Boulevard Northeast.
DURATION
These covenants shall run with the land and expire on December 31 , 2025. If at
any time improvements are installed pursuant to these covenants, the portion of
the covenants pertaining to the specific inst,alled improvements as required by the
Ordinances of the City of Renton shall terminate without necessity of further
documentation.
Proper legal proceduresin the Superior Court of King County may be instigated by I
either the City of Renton or any property owners adjoining subject property who
are adversely affected by any violation or breach of these restrictive covenants.
Reasonable attorneys' fees incurred during an enforcement proceeding will be borne
by the parties whom the court determines are in error and shall be entered as a
judgment in such action.
