Parcel "C" Temporary Construction Easement A strip of land, 5 feet wide, lying easterly of and coincident with the easterly line of the above-described, 15-foot strip of land, Parcel "A". E,��s�� T��i i��I ����li�t�i� ,. kin�Co.Rec r��v��:s,a�r By �-'�'; �'Q9 #44 r$ F RECFEE 2.Oi1 RECG F 6.00 CASHSL �**��.00 Said temporary construction easements are to be in full force and effect for a continuous one-hundred twenty day period to be chosen by the City which period shall be sometime between July 1, 1990 and September 30, 1992. 90-092:MB:jg - 1 - I � , � � � '�_ i.� ' � � �""' � � Said heretofore mentioned grantee, its successors or assigns, shall have the right, without prior notice or proceeding at law, at such times as may be necessary to enter upon said above described property for the purpose of constructing, maintaining, repairing, altering or reconstructing said utilities, or making any connections, therewith, without incurring any legal obligations or liability therefore, provided, that such construction, maintaining, repairing, altering or reconstruction of said utilities shall be accomplished in such a manner that the private improvements existing in the right(s)-of-way shall not be disturbed or damaged, or in the event that they are disturbed or damaged, they shall be restored as nearly as possible to the condition existing immediately before the property was entered upon by the Grantee. The Grantor shall fully use and enjoy the aforedescribed premises, including the right to retain the right to use the surface of said right-of-way if such use does not interfere with installation and maintenance of the utilities. However, the grantor shall not erect buildings or structures over, under or across the right-of-way during the existence of such utilities, except upon written approval by the Director of Public Works. This easement, shall be a covenant running with the land and shall be binding on the Grantor, his successors, heirs and assigns.
