This covenant is made by Stonehenge III Limited Partnership, �, _.�V�shington

RECITALS
WHEREAS, Owner is the owner of certain real property located in the City of
Renton, State of Washington, the legal description of which is set forth on Exhibit A
attached hereto and incorporated herein; and
WHEREAS, the City, on August 6, 199Q, passed Ordinance No. 4283 establishing a
joint public and private transportation improvement program for the area south of
I-405, east of the westerly city limits, north of S.W. 43rd (S. 180th), and west of SR167
(the Valley Freeway); and
WHEREAS, Owner wishes to develop the Property which lies within the
boundaries of said area;
NOW, THEREFORE, it is agreed as follows:
C� 1. Owner acknowledges that the City may require property owners within
� the boundaries of said area to paRicipate in LID No. 1 and LID No. 2 as described and
� set forth in Ordinance No. 4283 and further acknowledges that the consideration for
� this covenant shall be the approval for development of the Property.
� 2. Owner agrees to participate in LID No. 1 and LID No. 2 under the terms
� and conditions set foRh in Ordinance No. 4283.

Q� 3. This Agreement shall be a covenant running with the land and shall be
' filed and recorded in the records of King County, Washington, in the Department of
� Records and Elections and shall be binding upon and inure to the bene�t of Owner I
and its heirs, succcssors and assigns. j
