Whereas, the City of Renton, a municipal corporation has established a limited exemption by
Ordinance No. 2 to the Special Utility Connection Charge granting exemptions
to Municipal Corporations for portions of property subject to the Special Utility Connection
Charge to the e�ent that those specific areas are available and maintained at all times for
public use, and those areas exempted shall be segregated from the fee determination as
provided by Ord. No.

are the owners of the following real property in the Ciry of Renton, County of King, State of
Washington, described as E�ibit "A" attached hereto.
WHEREAS, the owner(s) of said described property desire to impose the following restrictive
� covenants running with the land as a condition placed on the title of the remaining
d„ undeveloped property regarding the requirement, obligation and promise to pay the Special
� Utiliry Connection Charge when that portion of the property is developed. The Special
d Utility Connection Charge shall be at the rates in effect at the time a formal application is
Osubmitted which would involk the SUCC charge.
� NOW, THEREFORE, the aforesaid owner(s) hereby establish, grant and impose restrictions

, DURATION
These covenants shall run with the land and shall not expire. If at any time the
SUCC fee is paid on the exempted area pursuant to these covenants, the
portion of the covenants pertaining to the specific exempted area as required
by the ordinances of the City of Renton shall terminate by the filing and
recording of a Partial Satisfaction of Tap, Hook-up or Connection Charge
release form with King County.
Any violation or breach of these restrictive covenants may be enforced by proper legal
procedures in the Superior Court of King County by either the ciry of Renton or any property
owners adjoining subject property who ate adversely affected by said breach. Attorney's fees
are the responsibility of the ownets if enforcement of these restrictive covenants are
necessary.

WHEREAS, Dr. Gary F. Kohlwes, Superintendent of Schools of Renton School
District No. 403, is charged with various duties and responsibilities by Chapter
28A.400 RCW and resolutions of the Board of Directors of the District; and
WHEREAS, in his temporary absence from the District it is important to ensure
the timely administration of such duties and responsibilities;
� NOW, THEREFORE BE IT RESOLVED, that George McPherson is hereby authorized
� to exercise all authority vested in the Superintendent during the Superintendent's
� absence from the District during the 1990-91 school year.
