these presents, grant, bargain, sell , convey, and warrant unto the said Grantee, its
successors and assigns, an easement for public utillties (including water and sewer) with
necessary appurtenances over, through, across and upon the fol )owing described property
in King County, Washington� more particularly described as follows;
That portion of Government Lot lU in Section 17, Township 23 North, Range 5 East,
W.M. in King County, Washington lying within that portion of land described in
Statutory Warranty Deed to H&M Associates, a Washington General Partnership re-
corded under King County Recording No. 88102UU461 described as follo�vs:
Commencing at the Southeast corner of said land; thence South 89°18'37" West
� parallel to the South line of said Government Lot lU, a distance of 230.63 feet
to an angle point on said land; thence North UO°46'U8" Eas� along the Wes-ierly
line of said land, a disiance of 50.5� feet to the TRUE POINT OF BEGINNING: then

° ' 'Said heretofore mentioned grantee� its successors or assigns� shall have
� the right� without prior notice or proceeding at law� at such times as may be
n�cessary to enter upon said above described property for the purpose of construct-
ing. maintaining� repairing� altering or reconstructing said utilities. or making
any connections therewith, without incurring any legal obligations or liability �.
therefore. provided. that sucl� construction� maintaining� repairing� altering or
reconstruction of said utilities shall be accomplisi�ed in such a mar�ner that tlie
private improvements existing in the right(s)-of-way shall not be disturbed or
damaged. they will be replaced in as good a condition as they were immediately
before the property was entered upon by the Grantee.
The Grantor shall fully use and enjoy thA� aforedescribed premises, includin�
the right to retain the right to use the surface of said right-of-way if such use
does not interfere with installation and maintenance of the utilities. However�
the grantor shall not erect buildings or structures over� under or across the
right-of-way during the existence of such utillties.
This easement. shall be a covenant running with the land and shall be binding
on the Grantor� his successors. heirs and assigns. Grantors covenant that they
are the lawful owners of the above properties and that tliey have a good and lawful
rlght to execute thls agreement.
