initial canstructic�n oF its facilities, Grantee may from time to timc construct sucti
. additional facilities c�n tl�e Easemcnt Area as it may require, This easement is �rantec�
subjcct to the fc�llowing terms and conditions:
1. 7�e Grantee shall, upqn completion of any work within the EZsement Area,
restor� lhe surface of the EaSement Area, and any private imprc�vements disturbed or
, destroyed during execution of the work, as nearly as practicable to the condition they
were i�i immcdi�tely hefore cummettcement of the work c�r entry by the Crantee.
2. Grantur shall retain the right to use the surface uf the Easement Area as long as
such use cic�es not interfcre with thc easement rights granted �a the C7rantee. Grantor
shail not, h�wever, have the right to:

a. Erect or maintain any no,i-purtabl� or permanent buildin�s ar 5tructures
within the Easement Area; or
b. Plant trees, shrubs or vegetation havin� deep root patterns which may
cause damage to or inlerfere with the utilities to be p]aced within the E�sement Area by
ihe Grantee; or
c. llevelop, lanclscape, or beautify thc Easement �1rea in any way which
wo«lci unreasonably increase the costs t� the Grantee of restoring the Easernent Area
and any private imprcrveriients therein; provided, however, that (i) �ny exi�ting trces in
the Easement Area as uf the date of this Easement may remain, (ii} Crrantor m�y plant
any lawn, shrubs or plants in the �;asement Area, dnd (iii) Cirantor may plant any trees
in tl�e Easement Area s� long as such trees ar�e more than tt�ree feet in either direction
from the centerline of the utilities and sucl� trees do not have deep rnot patterns which
may c;ause damAge tc� or intcrfere with the utilities to bc placed in the Easement Area;
or
d. Nc� digging, tunnelling, or uther form of constructic�n activities shall be
cione on the property which woulc� disturb the cc�mpactic�n or unearth �'ir�ntee's facilities
�n the Easernent Ared, or endanger the lateral support faciiitics; or
e. No blasting shall he done within fiftecn (15) feet of the Easement Area.
� 3. AlI utilities shal! be exclusively undergruund �nd no utility facility shall be

f� constructed or maintained on or above the ground ]evel o!' the Easement Area; prc�videil,
!"� how�ver, that Grantee may maintain tempor:iry abovc-gr�uud structures in order to
� repair or maintain the t,tilities.

� 4. Grantce shalf be respontiihle f�r rnaintair�ing the utilities in the Easement Area in
� g►�od cc�ndition and repair, dt its sote expe»se.
S. Grantee shdll ilidemnify and hold harmless Grar�tor from xny anc3 all c3amages
s�affered by Grdntor, its success�rs and assigns, as a result of Gr�ntee 's exercise of its
rights set forth hereiii or Grantee�s failure to carry out its nbligations set forth herein;
providec� that Grantee shall not be responsihle to Grantc�r for any damages resulting
from the acts or omissions vf Grantor.
