WHEREAS, Renton Mart, a �_ general partnership, having its
principal office at 9440 Santa Monica Boulevard, Suite 305, Beverly Hills,
California 90210 ("Owner") , i.s the owner of certain real property located in
the City of Renton, County of King, State of Washington, as described in � y
Exhibit A attached hereto (the "Land") . �`

WHEREAS, Owner and the City of Renton desire to impose the following ,�,,
restrictive covenants, present and future, which shall run with the Land, 'i
relating to Landscaping and landscape maintenance on the Land. '

NOW, THEREFORE, Owner hereby establishes, grants, and imposes ��

restrictions and covenants with respect to landscaping and landscape �
maintenance by Owner, its successors, heirs, assigns, and tenants as follows: �-

RESTRICTIVE COVENANTS
Owner shall maintain the landscaping and related site i�►provements
on the Land in accordance with accepted standards for the greater Seattle, '
Washington, area relating to landscaping the landscape maintenance of retail
shopping centers, and in accordance with the City of Renton, Examiner's Report
and Decision issued February 8, 1993, a copy of. which i� attached hereto as
E:thibt B including, without limitation, replacement of any landscaping that
dies or is severely damaged through improper maintenance (i.e. , improper or
'" excessive pruning) .
DURATION
These covenants shall run with the Land and expire on December 31, 2025. If
� at any time improvements are installed pursuant to these covenants, the
!� portion of the covenants pertaining to the specific installed improvements
� as required by the Ordinances of the City of Renton shall terminate without
� necessity of further documentation.
� Any violation or breach of these restrictive covenants may be enforced by
,�,i proper legal procPdures in the Superior Court of King County be eitt�er t:�e I
� City of Renton or any property owners adjoining the Land who are adversely
� affected by said breach.

4. The applicant shall submit a revisod landscape plan which incorporates street trees aiong �
Shattuck Ave and increases street trees aiong atl boundaries oP tht site. The plan shaTl
be submitted to the DSD for review and approval priar to the issuanct af builtiing ,
permits. Street trees shail match existing trees in terms of type and sizt.
